In the judgment in question, the Court of Justice of the European Union (CJEU) for the first time ever carried out such broad interpretation of Article 9 (2) (2) (e) of Directive 2011/95/EU in the context of non-formalized refusal to perform military service by a young Syrian who escaped from his country of origin. The paper analyses the impact of the CJEU judgment on the functioning of the guarantee of the right to conscientious objection to military service within the EU asylum law. It also asks two key questions. First, in the light of the analysed judgment, should any potential Syrian conscript who in reality does not support the government (non-opportunist) and who evades military service be granted protection? Secondly, do all Syrian conscripts who join the army make themselves subject in the future to automatic exclusion from protection? ; W glosowanym orzeczeniu Trybunał Sprawiedliwości Unii Europejskiej (TSUE) po raz pierwszy dokonał tak szerokiej wykładni art. 9 ust. 2 lit. e dyrektywy 2011/95/EU w kontekście niesformalizowanej odmowy służby wojskowej dokonanej przez młodego Syryjczyka, który uciekł z kraju pochodzenia. Autorka analizuje wpływ wyroku TSUE na funkcjonowanie gwarancji prawa do podyktowanej sumieniem odmowy odbycia służby wojskowej w ramach unijnego prawa azylowego. Stawia również dwa kluczowe pytania. Po pierwsze, czy w świetle analizowanego wyroku każdy potencjalny syryjski poborowy, realnie niepopierający rządu (nieoportunista), uchylający się od służby wojskowej, powinien uzyskać ochronę? The paper presents a critical discussion of the CJEU judgment in the JZ case (C 806/18), in which the Court interpreted Article 11 of Directive 2008/115 that regulates entry ban issuance. The author asks a question of whether an entry ban as a measure limiting the right to free movement has a moral and legal ground in international law and EU law. The analyzed ruling is the first judgement which the Court of Justice passed in order to provide interpretation for the new Student Directive (2016/801 of 11 May 2016 on the conditions of entry and residence of third-country nationals for the purposes of research, studies, training, voluntary service, pupil exchange schemes or educational projects and au pairing). Due to its judiciary activism, the Court was able to find a connection between the case pending before a national court and EU law in the case of M.A. In the end, the Court finally decided that in the case at issue, regarding the rights of a foreign national to apply for a residence permit for the purpose of enrolling in second-cycle studies programme in Poland, the procedure of applying for a long-stay visa on the grounds of national law must be safeguarded by the guarantees under Article 47 of the Charter of Fundamental Rights. The guarantees apply to the actual states in which EU law is applicable – in this case the "Student Directive." The aim of the article is to analyze the changes introduced recently (2018-2019) in the national migration law of the selected Member States: Italy, Poland and Germany and to examine whether there exist guarantees of the right to migration security and guarantees for the realization of the principle of migration security priority at the level of national legislation. The second problem under investigation concerns the fact whether the changes introduced in the legislation recently ensure a higher level of migration security in comparison with the previous regulations. Finally, the analysis carried out in the current article is intended to demonstrate whether national law protects the rights of migrants and the receiving society in equal measure or whether certain fundamental rights which migrants are entitled to are at risk of being derogated due to the necessity of providing security to migration processes and the protection of the receiving society. The paper analyzes in detail the legislative initiatives and amendments introduced in migration and refugee law in Germany, Italy and Poland. What is more, the author gathers and analyzes the most representative national case law concerning the asylum and return migration.

Due to the escalation of the migration crisis in 2015, the European Union has been facing new challenges in migration management. The case-law of the CJEU, especially issued in the procedure of the so-called questions referred for a preliminary ruling, constitutes a certain benchmark for the problems, which the Member States need to deal with in the area of guaranteeing safety. In accordance with the research method adopted for the purpose of the current study, the Court of Justice has a real possibility of shaping the standards of migration security in the area of asylum and return policies through its case-law. What is more, within the field of EU migration law and migration policies, there exists a migration security priority, in accordance with which it is necessary to provide the highest level of security to all the actors of migration processes, i.e. both the very migrants, as well as the receiving society. This principle should be applied at the level of legislative processes and also in the area of the implementation of legal norms. As a result of the conducted analysis of the case-law of the CJEU, the four basic areas with regard to the migration security of the Member States have been identified.
The article analyses the current, post-crisis case-law of the Court of Justice of the European Union (CJEU) in cases concerning the so-called Dublin Regulation, i.e. Regulation 604/2013, which establishes the criteria and mechanisms for determining the Member State responsible for examining an application for international protection lodged in one of the Member States by a third-country national. The aim of the article is to analyze the standard of migration security in the area of Dublin cases. The key problem for the discussed issue was the judgment in the Jawo case, in which the Court of Justice examined the admissibility of Dublin transfers to the Italian Republic on the grounds that there was a risk of extreme material deprivation of the migrant. The Jawo case is a continuation of high-profile international court rulings in cases such as M.S.S., Tarakhel (ECtHR) and N.S. (CJEU), which decided to suspend transfers to Italy and Greece. Apart from the issues of protection against inhuman treatment, the jurisprudence of the CJEU also draws attention to the issues of legal security, effectiveness and accessibility of administrative procedures for third-country nationals seeking international protection in the EU. Finally, the standard of migration security in the Dublin area also includes the obligation to act in solidarity and mutual trust between the Member States, as set out in the judgments of the CJEU.

Orzecznictwo TSUE, zwłaszcza wydawane w procedurze tzw. pytań prejudycjalnych, stanowi swoisty barometr dla problemów, z jakimi mierzą się państwa członkowskie w zakresie zagwarantowania bezpieczeństwa. Zgodnie z przyjętymi założeniami badawczymi, Trybunał ma realną możliwość kształtowania standardów bezpieczeństwa migracyjnego w obszarze polityki azylowej i powrotowej. Co więcej, w ramach prawa migracyjnego UE i polityk migracyjnych istnieje priorytet bezpieczeństwa migracyjnego, zgodnie z którym konieczne jest zagwarantowanie jak najwyższego poziomu bezpieczeństwa wszystkim uczestnikom procesów migracyjnych, tj. zarówno migrantom, jak też społeczeństwu przyjmującemu. Zasada ta powinna być wdrażana zarówno na poziomie procesów legislacyjnych, jak też w obszarze implementacji norm prawnych. W wyniku przeprowadzonej analizy orzecznictwa Trybunału, wyodrębnione zostały cztery podstawowe obszary związane z bezpieczeństwem migracyjnym państw członkowskich: sprawy dotyczące bezpośrednio ochrony bezpieczeństwa i porządku publicznego, sprawy odnoszące się do możliwości ograniczenia cudzoziemcom niepożądanym wjazdu na terytorium państw członkowskich oraz swobody poruszania się, sprawy dotyczące zakazów wjazdu nakładanych na cudzoziemców o nieuregulowanym statusie oraz problematyki solidarnego dzielenia odpowiedzialności przez państwa członkowskie w obliczu masowego napływu migrantów, a tym samym zapewnienia bezpieczeństwa migracji na terytorium wszystkich państw członkowskich.

Co więcej, w ramach prawa migracyjnego UE i polityk migracyjnych istnieje priorytet bezpieczeństwa migracyjnego, zgodnie z którym konieczne jest zagwarantowanie jak najwyższego poziomu bezpieczeństwa wszystkim uczestnikom procesów migracyjnych, tj. zarówno migrantom, jak też społeczeństwu przyjmującemu. Zasada ta powinna być wdrażana zarówno na poziomie procesów legislacyjnych, jak też w obszarze implementacji norm prawnych. W wyniku przeprowadzonej analizy orzecznictwa Trybunału, wyodrębnione zostały cztery podstawowe obszary związane z bezpieczeństwem migracyjnym państw członkowskich: sprawy dotyczące bezpośrednio ochrony bezpieczeństwa i porządku publicznego, sprawy odnoszące się do możliwości ograniczenia cudzoziemcom niepożądanym wjazdu na terytorium państw członkowskich oraz swobody poruszania się, sprawy dotyczące zakazów wjazdu nakładanych na cudzoziemców o nieuregulowanym statusie oraz problematyki solidarnego dzielenia odpowiedzialności przez państwa członkowskie w obliczu masowego napływu migrantów, a tym samym zapewnienia bezpieczeństwa migracji na terytorium wszystkich państw członkowskich.
Dyskusja na temat problemów Grecji w zakresie warunków w ośrodkach recepcyjnych, jak również warunków detencji trwała na forum UE od dawna. Kryzys migracyjny, który rozpoczął się od tragicznych wydarzeń w okolicach Lampedusy w kwietniu 2015 r., sprawił, że problem naruszeń praw migrantów zyskał nowy wymiar etyczny i tym samym głos obrońców praw człowieka staje się bardziej słyszalny. Niniejszy artykuł przedstawia aktualne orzecznictwo ETPC przeciwko Grecji w sprawach dotyczących migrantów (przede wszystkim chodzi o naruszenia art. 3 i 5 Konwencji). Autorka analizuje orzeczenia wydane od kwietnia 2015 r. do końca czerwca 2016 r. Oczywiście ze względu na pewną opieszałość procedowania, wyroki ETPC wciąż odnoszą się do naruszeń z lat 2010 i 2011 r. Tym bardziej jednak zasługują na omówienie, bo sytuacja w Grecji wydawać się zaczyna "niekończącą się opowieścią" i mimo podjęcia działań sanacyjnych na poziomie UE w związku z wdrażaniem przez Grecję polityki migracyjnej, nie wydaje się, aby ulegała ona znaczącej poprawie.
