The article reveals the issues connected with the legal characteristic of the right to social assistance in the present conditions. The peculiarities of the formation of the right to social assistance through the prism of the right to social protection are analized. The key role of social assistance among types of social security is noted. The article emphasizes the need to take into account European social standards in shaping the latest system of social benefits. The emphasis is put on certain types of state and social insurance assistance. The basic tendencies of development of the legislation on social assistance are discussed.It is noted that the right to social assistance is a complex, systematic social right which includes the possibility for a person to receive financial support in the form of a cash in the event of full, partial, or temporary loss of disability, loss of breadwinner, unemployment from circumstances independent of them, as well as in old age and in other cases, in the manner prescribed by law. The main features of the right to social assistance are as follows: complex and systematic social rights; stems from the content of the right to social protection; functions in state and non-state social protection and social insurance system; the object is social assistance and its individual types; entitled persons are mainly socially vulnerable categories of persons who can not independently provide their livelihoods on an adequate level; as a rule, guaranteed when the person is not entitled to a pension; subject mainly to legislative regulation, a special place in which belongs to the law on the State Budget for the relevant year; characterized by the existence of specific mechanisms for implementation, guarantee and legal protection; determined, as a rule, in relation to the subsistence minimum; to be monitored, supervised and controlled.It is obvious that in the current situation, an important social strategy should be further harmonization of the size of the subsistence minimum with a sufficient standard of living, which will ensure the proper level and quality of life of eligible persons, including by agreeing the subsistence minimum for able-bodied and disabled people to a higher level.In the context of the reform of social protection, the reform of social assistance should be carried out through the prism of reforms of the system of state social protection; reforms of the social insurance system; development of non-state social protection; increasing the effectiveness, efficiency and accessibility of the right to social assistance; systematization and codification of legislation on social protection.The main tendencies of legislative provision of the right to social assistance are as follows: organization of systemic economic reforms; organization and implementation of social protection reform, taking into account international and national experience; ensuring the effectiveness, accessibility and effectiveness of implementation mechanisms, guaranteeing and legal protection of the right to social assistance and its separate types; implementation of state and public support; the latest systematization and codification of legislation on social protection; introduction of effective monitoring, supervision and control. The article reveals the issues related to the legal characteristic of European social standards and their impact on the development of the latest model of sources of social security law. It is noted that the European model of social security (protection) is characterized by such features as promoting the development of an inclusive society; implying the responsibility of society and the state for effective social policy; availability of an effective and accessible system of social rights; aiming at forming a high level of social standards, guarantees, as well as the quality of life of a person; sufficiency, efficiency, accessibility of organizational forms and types of social security (protection); availability of effective and flexible legal regulation in the field of social security (protection).The emphasis is on the fact that European social standards should be considered broadly and narrowly. Broadly speaking, European social standards are a set of norms, provisions, and standards of a conceptual nature, contained in international legal acts approved by authorized European institutions and aimed at developing an effective model of social security (protection). In the narrow sense, European social standards are a set of recognized and enshrined in accordance with international legal acts adopted by authorized European institutions of social human rights. The basic features of European social standards are the following: they are the result of the normative activity of authorized European institutions (the Council of Europe, the EU); enshrined in international legal acts of the Council of Europe and the EU; include a system of rules, regulations, and standards for social security; include a system of fundamental social rights; act as a legal basis for the development of social legislation of individual member states of the Council of Europe and the EU; act as a legal basis for the formation of a new system of sources of social security law.The key role of the European Social Charter (revised) and the European Code of Social Security in shaping European social standards is noted, with emphasizing the need to take into account European social standards when formulating a system of sources of social security law, and in particular, in the process of codification of legislation in this area. This article discusses the key issues regarding the newest concept of the legal regulation of working time through the prism of trends in the development of society, the state, and the labor market. The chief attention should be paid to the issues of the priority of requests and interests of employees, the formation of effective mechanisms of social partnership, and the trends of the international labor market. Critically comprehended is the state of legal regulation of working time. It is stressed that, from the legal point of view, the current state of the legal regulation of working time appears somewhat vulnerable, taking into account the following factors: the non-compliance with the state of labor market development; inefficiency, ineffectiveness of legal regulation; the lack of proper motivation of labor productivity, taking into account the necessity of guaranteeing the life, health, and efficiency of every worker; the lack of proper mechanisms for organizing the working time, including modern, innovative jobs; insufficiency of legal mechanisms for the use of information and other technologies of working time control; lack of quality mechanisms for the implementation of international social standards; absence of an optimal combination of the working time, rest time, and occupational safety; the lack of proper mechanisms for taking into account the needs and interests of persons with disabilities and other socially vulnerable categories of persons; the lack of effective oversight and control; the lack of jurisdictional protection, etc.The paper discusses the importance of a proper assessment of the problems of the legal regulation of working time in the present, given the importance of the integration processes of labor market development, its international vector, the introduction of the newest information and other technologies, the implementation of international (European) standards, the formation of mechanisms for the optimal combination of legislative, sub-legislative and the local regulation in this area. In addition, the issue of particular importance is raised in the context of the recent codification of labor legislation as a component of developing an effective concept of the legal regulation of working time. The modern system of principles of the legal regulation of working time is outlined. It is concluded that working time is a period during which an employee, as a rule, must be in the workplace, subject to the control of the employer and other established rules, must perform the labor function and other duties under the employment contract. The main features of the working time are as follow: regulated on the basis of international legal acts, acts of domestic national legislation, local normative legal acts; the worker is subject to established working time norms and rules; directed to the behavior of the employee and the employer under an employment contract (correlates with the system of rights, responsibilities, responsibilities of the employee and employer); payable; accompanied by a system of international standards on labor issues; accompanied by a system of social and labor guarantees; time, intended to perform labor function and other duties under an employment contract; the employee is subject to control by the employer (the authorized body or official); subject to accounting, control and supervision; subject to jurisdictional protection.It is emphasized that the principles of the legal regulation of working time are the basic principles and provisions that determine the peculiarities of the legal regulation of relations in the sphere of working time.The basic general principles of the legal regulation of working time are the following: the rule of law; humanism; social justice; priority of the maintenance of the working capacity, the health and life of workers; the priority of international (European) standards in the field of working time; the priority of the legislative regulation of relations in the field of working time.The main special principles of the legal regulation of working time are the following: inclusiveness, efficiency, and accessibility; the priority of needs and interests of employees; stimulation of labor productivity; ensuring the efficiency of work of persons with disabilities and other socially vulnerable categories of persons; the principle of social partnership; versatility, flexibility of types and working hours; implementation of international (European) standards in the field of working time; a combination of legislative, contractual, and the local legal regulation of working time; combination of working time and rest time, occupational safety; the principle of unity and differentiation of the legal regulation of working time. The main features of the working time are as follow: regulated on the basis of international legal acts, acts of domestic national legislation, local normative legal acts; the worker is subject to established working time norms and rules; directed to the behavior of the employee and the employer under an employment contract (correlates with the system of rights, responsibilities, responsibilities of the employee and employer); payable; accompanied by a system of international standards on labor issues; accompanied by a system of social and labor guarantees; time, intended to perform labor function and other duties under an employment contract; the employee is subject to control by the employer (the authorized body or official); subject to accounting, control and supervision; subject to jurisdictional protection.It is emphasized that the principles of the legal regulation of working time are the basic principles and provisions that determine the peculiarities of the legal regulation of relations in the sphere of working time.The basic general principles of the legal regulation of working time are the following: the rule of law; humanism; social justice; priority of the maintenance of the working capacity, the health and life of workers; the priority of international (European) standards in the field of working time; the priority of the legislative regulation of relations in the field of working time.The main special principles of the legal regulation of working time are the following: inclusiveness, efficiency, and accessibility; the priority of needs and interests of employees; stimulation of labor productivity; ensuring the efficiency of work of persons with disabilities and other socially vulnerable categories of persons; the principle of social partnership; versatility, flexibility of types and working hours; implementation of international (European) standards in the field of working time; a combination of legislative, contractual, and the local legal regulation of working time; combination of working time and rest time, occupational safety; the principle of unity and differentiation of the legal regulation of working time. This article discusses the key issues regarding the newest concept of the legal regulation of working time through the prism of trends in the development of society, the state, and the labor market. The chief attention should be paid to the issues of the priority of requests and interests of employees, the formation of effective mechanisms of social partnership, and the trends of the international labor market. Critically comprehended is the state of legal regulation of working time. It is stressed that, from the legal point of view, the current state of the legal regulation of working time appears somewhat vulnerable, taking into account the following factors: the non-compliance with the state of labor market development; inefficiency, ineffectiveness of legal regulation; the lack of proper motivation of labor productivity, taking into account the necessity of guaranteeing the life, health, and efficiency of every worker; the lack of proper mechanisms for organizing the working time, including modern, innovative jobs; insufficiency of legal mechanisms for the use of information and other technologies of working time control; lack of quality mechanisms for the implementation of international social standards; absence of an optimal combination of the working time, rest time, and occupational safety; the lack of proper mechanisms for taking into account the needs and interests of persons with disabilities and other socially vulnerable categories of persons; the lack of effective oversight and control; the lack of jurisdictional protection, etc.The paper discusses the importance of a proper assessment of the problems of the legal regulation of working time in the present, given the importance of the integration processes of labor market development, its international vector, the introduction of the newest information and other technologies, the implementation of international (European) standards, the formation of mechanisms for the optimal combination of legislative, sub-legislative and the local regulation in this area. In addition, the issue of particular importance is raised in the context of the recent codification of labor legislation as a component of developing an effective concept of the legal regulation of working time. The modern system of principles of the legal regulation of working time is outlined.
