El bienestar social y el buen vivir: los olvidados en la toma de decisiones en materia económica ; Le bien-etre social et le bien-vivre: les impenses de la prise de decision en matiere economique

The "buen vivir" designates a paradigm inherent to the social field which seeks to focus on human values such as solidarity and the model of sustainable development. In this sense, it differs from "living better" — an individualistic interpretation of life—, far from respecting the natural environment and which deifies the economic activity. Thus, this contribution aims to introduce a conceptual framework regarding «good living» to understand that the operational function of social welfare cannot be addressed in a unidimensional way, just considering the economy, but also environmental variables, such as public health, quality of life, social integration, access to social rights, among others. All this has an impact on the identification of indicators that also measure these variables, intending to allow all the people to be drivers in social, political, and economic development in a sustainable manner. ; El «buen vivir» designa un paradigma inherente al campo social que busca centrarse en valores humanos como la solidaridad y el modelo de desarrollo sustentable; en este sentido, se diferencia del «vivir mejor», que es una interpretación individualista de la vida, una vida alejada del respeto por el entorno natural y que diviniza la actividad económica. Por ello, esta contribución busca introducir un marco conceptual sobre el «buen vivir», para entender que la función operativa del bienestar social no puede abordarse unidimensionalmente considerando solo la economía, sino también variables medioambientales, como la salud pública, la calidad de vida, la integración social, el acceso a los derechos sociales, etc.; lo cual impacta en la identificación de indicadores que midan también estas variables, con el objetivo de permitir sosteniblemente que todas las personas puedan ser actores del desarrollo social, político y económico.

Résumé L'administration électronique ou numérique engage autant les administrés que les administrations. Or, pour certaines de ses réalisations, le choix du terme de téléservice conduit à mettre en exergue les mesures prises pour la simplification des relations entre administrations et administrés. La distinction entre services en ligne, services à distance et téléservices permettrait de distinguer d'une part la confirmation de la réduction du service public à la prestation et, d'autre part, la consolidation de la rhétorique d'un usager non plus acteur mais assujetti.

Les incitations à l'utilisation des services en ligne se multiplient. La gestion des dossiers personnels des usagers par les services compétents en dépend. Cependant, outre que les usages d'internet ne sont pas garantis pour tous, l'e-administration électronique modifie la nature des rapports entre l'administration et l'usager. Elle constitue une invite à détecter les effets de la distanciation entre l'une et l'autre, quelles que soient la réactivité ou l'interactivité fonctionnelle des serveurs dédiés. Les développements de l'e-administration risquent ainsi de générer des attitudes spécifiques de la part de certaines catégories de personnes confinant à la non-demande sociale, au renoncement aux droits ou au non-recours aux droits.

Poverty as a human rights violation

Difficult as it is to admit, poverty cannot be defined in law. In the tension between dealing with poverty and focusing on extreme poverty, there is an indeterminacy that makes democracies inattentive to the economic and social dynamics of poverty as inequality. As a result, responses to extreme poverty, especially when they are explicitly targeted or preferential, violate the fundamental equality of rights and dignity that they are supposed, formally, to express. Measures for the underprivileged thus do not offer them a way out from their status, but rather, paradoxically, lead them to qualify their suffering, and to find in favours received the strength to think of themselves as poor without being exposed to the terrors of extreme poverty. In a sense, such people, who depend on minimal welfare granted to them, have no "rights". Should we thus learn to think of poverty as an inevitable and unavoidable phenomenon in a world that claims to work to guarantee human rights, civil and political rights, economic, social, and cultural rights?

The asociation between education and democracy cannot be separated from democratic thought. The school is a fundamental institution which, in most modern states, is the responsibility of the public authorities. Established on the principle of equality, public instruction envisages the learning in depth of political and social citizenship. It permits both the enjoyment of the rights of man and the exercise of fundamental liberties as well as the understanding of the duties and restrictions inherent in the preservation of the common wealth. However, in France it has undergone alterations: "civic instruction" has become "education for citizenship". This has caused a slide from learning in a critical spirit to obedience to authority. "Public-spiritedness", with its essential political role in democracy, has been hidden under "civility", which has an undeniably moral connotation. However, "civility" excludes the understanding of the solidarity inherent in the social nexus and does not seek the ways of political socialization of (future) citizens. ; La asociación entre educación y democracia es inseparable del pensamiento democrático. La escuela es una institución fundamental que resultan tener a su cargo, en la mayoría de los Estados modernos, los poderes públicos. Establecida sobre el principio de igualdad, la instrucción pública prevé el aprendizaje y la profundización en la ciudadanía política y social. Permite tanto disfrutar de los derechos del hombre y ejercer las libertades fundamentales, como comprender los deberes y las restricciones inherentes a la preservación de la "cosa pública". Sin embargo, en Francia ha sufrido remodelaciones: la "instrucción cívica" se ha convertido en la "educación para la ciudadanía". Se ha operado un deslizamiento desde la formación en el espíritu crítico hacia la obediencia a la autoridad. El "civismo", con una función política esencial en la democracia, se ha ocultado bajo la "civilidad", que tiene una connotación innegablemente moral. Ahora bien, la civilidad excluye la aprehensión de las solidaridades inherentes al nexo social y no investiga las vías de la socialización política de los (futuros) ciudadanos.

Dans les sociétés démocratiques contemporaines, le discours du droit ne traite pas du regard. Lois et règlements esquivent la puissance des échanges de regards. Or, quand agressions verbales et attaques physiques, tourments psychiques et infortunes matérielles, conflits sociaux et litiges interpersonnels se forment à partir d'un regard décoché par l'un et capté par l'autre, comment se méprendre sur la force et l'intensité du regard ? La qualité et la signification du regard sont indéfinissables en droit. Le droit retient l'acte et oublie le regard.
