AbstractThe article deals with the effect of the time factor in the application of international humanitarian law (IHL) and international human rights law (IHRL) in 'prolonged belligerent occupations'. It demonstrates that IHL applies in its entirety to such situations and that the adjustments necessary can be made through the interpretation of existing IHL norms. As for IHRL, the protracted character of an occupation reinforces the importance of respecting and applying human rights. It cannot, however, be invoked in order to influence the interpretation of the notion of a state of emergency leading to the adoption of derogations from IHRL rules.

Is international law universal? Can it be anything else than the will of the actors who are able to impose on others their values and interests? Beyond the strategic objectives that can be pursued ? by a lawyer pleading before a court, a state representative operating in an international organization or addressing the general public, an author seeking recognition, or a citizen interested in the law ? since international law cannot be interpreted objectively, can it at least be interpreted in a convincing and well-argued way? These are the questions that underlie this book, which, following a critical approach, emphasizes the profound ambivalence of international law.00International law appears to be torn between, on the one hand, the pursuit of a universalist ideal of justice and peace, and, on the other, the need to deal with power relations in a political context. From this perspective, it would be futile to claim to establish, and even less ?to discover?, one single ?correct? interpretation of legal rules such as, for example, the right to self- determination, the principle of non-intervention or the prohibition of genocide. It is however possible to provide an overview of the main debates among states, other international actors or among legal scholars relating to the interpretation of the main rules of international law. In the book, these debates will be illustrated by references borrowed from popular culture and, in particular, from music and films
Le droit international est-il universel ? Peut-il recouvrir autre chose que la volonté des acteurs qui sont en mesure d?imposer leurs valeurs et leurs intérêts ? Au-delà des objectifs stratégiques que l?on peut poursuivre ? que ce soit comme avocat devant une juridiction, comme représentant d?un Etat devant une organisation internationale ou face à une opinion publique, comme auteur en quête de reconnaissance, ou comme citoyen intéressé par le droit ?, peut-on l?interpréter de manière convaincante et argumentée, à défaut d?être objective ? Telles sont les questions à l?origine de cet ouvrage qui, dans le cadre d?une approche critique, met l?accent sur la profonde ambivalence du droit international.00Ce dernier apparaît en effet tiraillé entre la poursuite d?un idéal universaliste de justice et de paix, d?une part, et la nécessité de composer avec des rapports de force inscrits dans un contexte politique, de l?autre.
