The article analyzes the current state of legal support of quarantine requirements and sanitary rules and regulations for the prevention of infectious diseases in foreign countries and Ukraine. To achieve this goal, an analysis of the current legislation of some foreign countries and Ukraine on the grounds for establishing liability for violation of quarantine and sanitary norms and rules.It has been established that the COVID-19 pandemic has forced the governments of different states to introduce administrative and criminal liability in case of violation of quarantine and sanitary norms and rules. To ensure these measures, penalties for non-compliance with the quarantine regime have been introduced, with penalties ranging from warning to imprisonment and even the death penalty.It is established that in Ukraine the issues of administrative and criminal liability for violation of quarantine and sanitary rules and regulations for the prevention of infectious diseases are regulated by Articles 42, 44-3 of the Code of Administrative Offenses and Article 325 of the Criminal Code of Ukraine.It is determined that one of the problems of ineffective application of Articles 44-3, 42 3 of the Code of Administrative Offenses and Article 325 of the Criminal Code of Ukraine is an array of new rules for the prevention of COVID-19, which is constantly changing and introduced by various law enforcement agencies.The study found that despite the adoption of regulations that established liability for violations of statutory rules and regulations introduced by both foreign countries and Ukraine to prevent COVID-19, they have a number of legal conflicts, inconsistencies and gaps.Keywords: quarantine, administrative responsibility, criminal responsibility, infectious diseases, coronavirus, prevention ; У статті аналізується сучасний стан правового забезпечення вимог дотримання карантину та санітарних правил і норм щодо запобігання інфекційним хворобам у зарубіжних державах та Україні. Для досягнення поставленої мети проведено аналіз діючого законодавства окремих зарубіжних держав та України щодо підстав встановлення відповідальності за порушення карантину та санітарних норм і правил.Встановлено, що пандемія COVID-19 змусила уряди різних держав запровадити адміністративну та кримінальну відповідальності в разі порушення карантину та санітарних норм і правил. Для забезпечення цих заходів були введені покарання за недотримання карантинного режиму, покарання варіюють, починаючи від попередження до позбавлення волі і навіть смертної кари.Встановлено, що в Україні питання адміністративної та кримінальної відповідальності за порушення карантину та санітарних правил і норм щодо запобігання інфекційним хворобам регулюються ст.ст. 42, 44-3 КУпАП та ст.325КК України. Визначено, що однією з проблем неефективного застосування ст.ст.44-3, 42 3 КУпАП та ст.325 КК України є масив нових правил щодо запобігання COVID-19, що постійно змінювався та запроваджувався різними суб'єктами правотворення.За результатами дослідження встановлено, що незважаючи на прийняття нормативно-правових актів, які встановили відповідальності за порушення визначених законом правил і норм, запроваджених, як зарубіжними державами так і Україною, для запобігання COVID-19, вони мають ряд правових колізій, суперечностей та прогалин.Ключові слова: карантин, адміністративна відповідальність, кримінальна відповідальність, інфекційні хвороби, коронавірус, запобігання

The article analyzes the new Criminal Code of Ukraine proposed for discussion. The focus is on reforming the criminal justice system. It was found that the proposed CCU aimed at protecting the interests of victims also provides that it should be easy to use for investigators, prosecutors, judges. The draft stipulates that the new Criminal Code and its application must comply with the rulings of the European Court of Human Rights on Ukraine. Зосереджено увагу на напрямках реформування системи кримінальної юстиції.З'ясовано, що запропонований до розгляду ККУ спрямований на захист інтересів потерпілих, передбачено, що він має бути зручним у користуванні.У проекті зафіксовано, що новий Кримінальний кодекс та його застосування мають відповідати рішенням Європейського суду з прав людини щодо України. Встановлено, що в проекті ККУ передбачена відповідальність для посадовців за невиконання рішень ЄСПЛ. The article analyzes the current state of application of effective mechanisms of legal support of quarantine requirements and sanitary rules and regulations for the prevention of infectious diseases.To achieve this goal, an analysis of current legislation on the grounds for establishing liability for quarantine, examined the results of court proceedings initiated for non-compliance with norms and rules for the prevention of infectious diseases, identified factors of low efficiency of Art. 44-3 of the Code of Administrative Offenses in establishing administrative liability for violations of quarantine and sanitary norms and rules.It is established that the issues of administrative and criminal liability for violation of quarantine and sanitary rules and regulations for the prevention of infectious diseases are regulated by Articles 42, 44-3 of the Code of Administrative Offenses and Article 325 of the Criminal Code of Ukraine.It is determined that one of the problems of ineffective application of Articles 44-3, 42 of the Administrative Code and Article 325 of the Criminal Code of Ukraine is an array of new rules for the prevention of COVID-19, which is constantly changing and introduced by various actors. Another reason was the professional unpreparedness of officials of the internal affairs bodies (National Police) of Ukraine to apply sanitary and epidemiological norms when drawing up protocols on violations of quarantine norms.The study found that despite the timeliness and necessity of the regulations to establish liability for violations of statutory rules and regulations introduced to prevent COVID-19, they have a number of legal conflicts, contradictions and gaps.Proposals to eliminate these shortcomings these shortcomings were substantiated.Keywords: quarantine, administrative liability, criminal liability, infectious diseases, coronavirus, prevention, informed agreement ; У статті аналізується сучасний стан застосування дієвих механізмів правового забезпечення вимог дотримання карантину та санітарних правил і норм щодо запобігання інфекційним хворобам.Для досягнення поставленої у роботі мети проведено аналіз діючого законодавства щодо підстав встановлення відповідальності за порушення карантину, досліджено результати розгляду судових справ, порушених за недотримання норм і правил щодо запобігання інфекційним хворобам, визначено чинники низької ефективності застосування ст. 44-3 КУпАП при встановленні адміністративної відповідальності за вчинення порушень карантину та санітарних норм і правил.Встановлено, що питання адміністративної та кримінальної відповідальності за порушення карантину та санітарних правил і норм щодо запобігання інфекційним хворобам регулюються ст.ст. 42, 44-3 КУпАП та ст.325КК України.Визначено, що однією з проблем неефективного застосування ст.ст.44-3, 42 КупАП та ст.325 КК України є масив нових правил щодо запобігання COVID-19, що постійно змінювався та запроваджувався різними суб'єктами правотворення. Ще однією причиною стала фахова непідготовленість посадових осіб органів внутрішніх справ (Національної поліції) України до застосування санітарно-епідеміологічних норм при складанні протоколів про порушення карантинних норм.За результатами дослідження встановлено, що зважаючи на необхідність оперативного прийняття нормативно-правових актів щодо встановлення відповідальності за порушення визначених законом правил і норм, запроваджених для запобігання COVID-19, вони мають ряд правових колізій, суперечностей та прогалин.Обґрунтовані пропозиції щодо усунення цих недоліків.Ключові слова: карантин, адміністративна відповідальність, кримінальна відповідальність, інфекційні хвороби, коронавірус, запобігання, інформована угода

The article is dedicated to research on criminal liability for a brutal and premeditated murder under the criminal legislation of some foreign countries. It determines the principal trends in inflicting punishment for this type of an aggravated premeditated murder. It explains that the states of continental Europe and the countries of the Anglo-Saxon legal system have no common approach to incorporating a characteristic of a premeditated murder such as "extreme brutality" in their criminal legislations. It shows that the relevant characteristic is represented by a full scope of extreme brutality in the criminal laws of some states; other countries define just some aspects of extreme brutality; yet in a number of countries, extreme brutality is not defined as an aggravating circumstance of a murder at all. In other countries, although extreme brutality is not defined as a qualification, the elements of a crime are defined as a premeditated murder committed in a brutal way.Keywords: a premeditated murder, an aggravating circumstance, extreme brutality, criminal liability, foreign legislation, legal systems, punishment ; Стаття присвячена дослідженню кримінальної відповідальності за умисне вбивство з особливою жорстокістю за кримінальним правом окремих зарубіжних держав. Визначено основні тенденції призначення покарання за цей різновид умисного вбивства за обтяжуючих обстави.Обґрунтовано, що в державах континентальної Європи та в країнах англосаксонської системи права немає єдиного підходу щодо відображення в кримінальному законодавстві такої ознаки умисного вбивства, як «особлива жорстокість». Встановлено, що у кримінальних законах окремих держав відповідна ознака представлена повним проявом особливої жорстокості; в деяких країнах виділяються лише окремі прояви особливої жорстокості; в ряді країн особлива жорстокість взагалі не визначається як обтяжуюча обставина вбивства. The article analyzes the feasibility of introducing the institution of criminal offense. The focus is on reforming the criminal justice system.It was found out that one of the directions of reforming the criminal justice of Ukraine is the introduction of the institute of criminal misdemeanor in the criminal legislation.According to the results of the study, different approaches to the expediency of establishing liability for misconduct in the criminal legislation of Ukraine have been identified.It is reasonable that changing the understanding of the concept of crime and the criteria for its evaluation is not an easy path, but in today's conditions the introduction of criminal offenses is a progressive, timely and unalterable step, as no scientific developments can solve law enforcement problems.Keywords: criminal proceedings, institute of criminal offense, crime, reforming, criminal legislation, Concept of reforms, criminal justice ; У статті проаналізовано доцільність впровадження інституту кримінального проступку. The article analyzes the current state of ensuring the right to sexual orientation and gender identity, analyzes regulations, examines the statistics of criminal offenses on this issue.To achieve this goal, an analysis of current legislation on the grounds for criminal liability for violation of the rights to sexual orientation and gender identity, examined the results of court proceedings, identified motives for bias.It is established that there is no aggravating circumstance for violation of the right to sexual orientation and gender identity in the Criminal Code of Ukraine.The study showed that the current legislation of Ukraine on criminal liability for violation of the rights to sexual orientation and gender identity does not provide a proper solution to this problem. However, given the need for timely decision-making on this issue, there are reasonable proposals: to expand the list of «protected features» that are subject to protection, in particular criminal law; clearly define sexual orientation and gender identity as «protected traits»; to supplement the list of circumstances that aggravate the punishment provided for in paragraph 3 of Part 1 of Art. 67 of the Criminal Code of Ukraine, the grounds for committing criminal offenses based on hatred of sexual orientation and gender identity; for the correct functioning of the provisions of the Criminal Code of Ukraine, it is necessary to give a clear definition of such phenomena as: «intolerance», «sexual orientation», «gender identity» at the legislative level, which will prevent the abuse of these concepts.Keywords: intolerance, sexual orientation, gender identity, criminal offenses of hatred, protected traits, violations of rights, motives for prejudice ; У статті аналізується сучасний стан забезпечення права на сексуальну орієнтацію та гендерну ідентичність, проаналізовано нормативно-правові акти, досліджена статистика кримінальних правопорушень із зазначеної проблеми.Для досягнення поставленої у роботі мети проведено аналіз діючого законодавства щодо підстав встановлення кримінальної відповідальності за порушення прав на сексуальну орієнтацію та гендерну ідентичність, досліджено результати розгляду судових справ, визначено мотиви упередженості .Встановлено, що обтяжуюча обставина за порушення права на сексуальну орієнтацію та гендерну ідентичність в КК України відсутня.Проведене дослідження засвідчило, що чинне законодавство України щодо визначення кримінальної відповідальності за порушення прав на сексуальну орієнтацію та ґендерну ідентичність не забезпечує належне вирішення цієї проблеми. Проте, зважаючи на необхідність здійснення своєчасного прийняття рішень з цього питання обґрунтовані пропозиції: розширити перелік «захищених ознак», які підлягають охороні, зокрема кримінальним законодавством; чітко визначити сексуальну орієнтацію та ґендерну ідентичність як «захищених ознак»; доповнити перелік обставин, які обтяжують покарання, передбачених п. 3 ч.1ст. 67 КК України, підставами скоєння кримінальних правопорушень на ґрунті ненависті до сексуальної орієнтації та ґендерної ідентичності; для коректного функціонування положень КК України необхідно дати чітке визначення таким явищам, як: «нетерпимість», «сексуальна орієнтація», «гендерна ідентичність» на законодавчому рівні, що унеможливить зловживання даними поняттями.Ключові слова: нетерпимість, сексуальна орієнтація, гендерна ідентичність, кримінальні правопорушення ненависті, захищені ознаки, порушення прав, мотиви упередження

The article is devoted to the analysis of the institute of criminal liability and punishment for minors under the Ukrainian legislation. Theoretical and practical features of sentencing for criminal offenses are examined and the main tendencies of sentencing at the present stage are determined. It is stated, that certain provisions of the Criminal Code of Ukraine on the sentencing of minors do not correspond to the worldwide practice of humanizing the punishment for juveniles. It is determined that the purpose of criminal punishment for minors is the process of education. Also, it is proved, that this goal should be confirmed in the current Penal Code. Attention is focused on the fact that the backbone of the state strategy on criminal law counteraction to juvenile delinquency should be a child-friendly system of juvenile justice.The necessity of adding new types of punishment into Penal Code of Ukraine which would be applied only for young offenders is defined. Moreover, the expediency of forming a new system of punishment for juveniles, which would take into account more sophisticated and new educational measures is proved.The peculiarities of imposing criminal punishment on minors according to the legislation of other foreign countries are clarified. Досліджено теоретичні та практичні особливості призначення покарання неповнолітнім за вчинення кримінальних правопорушень та визначено основні тенденції призначення покарання.Встановлено, що окремі положення Кримінального кодексу України, з питань призначення покарання неповнолітнім, не відповідають світовій практиці гуманізації покарання неповнолітніх. Визначено, що метою кримінального покарання неповнолітніх є процес виховання, доведено. що ця мета має дістати своє законодавче закріплення в чинному ККУ. Зосереджено увагу, що основою державної стратегії кримінально-правової протидії правопорушенням неповнолітніх повинна стати дружня дітям система ювенальної юстиції. Встановлена необхідність доповнення КК України новими видами покараннями, які були б розраховані тільки на неповнолітніх злочинців, доведена доцільність формування нової системи покарань для неповнолітніх, яка врахувала б більш модернізовані та новітні заходи виховного характеру.З'ясовано особливості призначення кримінального покарання неповнолітнім за законодавством окремих зарубіжних країн.Обгрунтовано, що спеціальні покарання для неповнолітніх, які не пов'язані з ізоляцією, передбачаються кримінальним законодавством більшості європейських держав.Ключові слова: неповнолітній, призначення покарання, кримінальна відповідальність, осудність, покарання, злочинність, кримінально-правова політика, гуманізм, осуд, психологічні властивості

Globalization and rapid information processes that are inherent in today's post-pandemic society, contributing to the reorganization of the authorities of many countries and their contacts with regions, local territorial units or civil society. Such changes, first of all, provide for delegation of authority at the level of regional and local authorities. However, many developing and today position their own society as post-modern, continue to be in a state of disunity of the branches of government, with a high level of corruption and abuse of official position, improper distribution of resources, inappropriate tax system and incompetent provision of services by relevant authorities. This affects the relevance of studying foreign experience in building a rational, effective, balanced public administration system, the leading place in which in almost all developed countries is the decentralization of the state and, above all, the executive branch. The foreign experience of the successful implementation of decentralization reforms is investigated. The main characteristics inherent in the decentralization of power in European countries are given, including in the context of the existence of a pandemic. The features of decentralization of power in France, the UK, Germany and other countries are highlighted. It is substantiated that the experience of decentralization reforms in each country is unique and reflects the specifics of the development of a particular country, and therefore it is impractical to introduce foreign experience without taking into account the particular economic and political development of a particular country.

The main purpose of the study is a comprehensive economic and legal analysis of the loan agreement in agriculture in the conditions of formation and development of elements of post-industrial economy in Ukraine. The research methodology is based on a systematic approach using the method of cognition from abstract to concrete and special methods of economic and statistical research (comparison, grouping, detailing of final indicators, generalization), which helped to ensure the reliability of research results and validity of conclusions. It was found that the loan agreement in agriculture is an economic and legal category that ensures the further development of agriculture in Ukraine in conditions of further integration of our economy to world market on competitive terms. It was determined that expanding the use of the loan agreement in agriculture is a necessary lever to increase production efficiency, formation and constant restoration of a competitive technological base in modern conditions and further development of the whole agro-industrial complex considering the formation of post-industrial economy. It is proved that the application of the mechanism of crediting of agriculture in Ukraine has a positive effect on the development of the agro-industrial sector in Ukraine. It is determined that the current level and availability of lending to the agro-industrial complex in Ukraine are insufficient for quality modernization and achieving a high level of efficiency of agricultural production. The main value of this study is that it analyzes the concept through the prism of two categories, namely: legal and economic.
