Die Möglichkeiten und Grenzen der Verfassungsreformen in Bosnien und Herzegowina
Die vorliegende Diplomarbeit beschäftigt sich mit den ?Möglichkeiten und Grenzen der Verfassungsreformen in BiH". Die notwendigen Verfassungsreformen konnten bislang nicht durchgeführt werden, wobei eines der grundlegenden Probleme der fehlende Grundkonsens zwischen den drei Volksgruppen (Bosniaken, Kroaten und Serben) über die Struktur des Staates ist. In der vorliegenden Arbeit wird zunächst auf die Entstehungsgeschichte der Nationalstaaten, darauffolgend auf die Phänomene des Nationalismus und Ethnonationalismus sowie auf den Begriff der Ethnizität eingegangen. Diese sind für ein tiefer gehendes Verständnis der bosnischen Gesellschaft und der ?Grenzen der Verfassungsreformen? unerlässlich. In weiterer Folge werden die Möglichkeiten der Konfliktregulierung dargelegt. Hier wird insbesondere im Hinblick auf das optimale Demokratiemodell in einer ethnisch gespaltenen Gesellschaft eine Abgrenzung zwischen der Mehrheits- und der Konkordanzdemokratie vorgenommen. Im Anschluss daran wird das politische System BiHs näher untersucht. Weiters werden die bisherigen Versuche, die Verfassung zu reformieren, einer eingehenderen Analyse unterzogen, wobei auch die Institution des Hohen Repräsentanten besondere Berücksichtigung erfährt. Die Institutionalisierung der Konkordanzdemokratie, welche einen ethnischen Proporz zugunsten der drei Volksgruppen vorsieht, hat zur Folge, dass ?Andere? (zB Roma oder Juden) von der Ausübung bestimmter Ämter ausgeschlossen werden. Im Jahr 2009 erklärte der EGMR deshalb auch die diesbezüglichen Bestimmungen der Verfassung für diskriminierend. Dieses Urteil des EGMR sowie die Frage nach dessen möglicher Implementierung bilden im letzten Teil der Arbeit den Schwerpunkt. Abschließend sollen die Gründe, welche immer wieder für das Scheitern der notwendigen Reformen verantwortlich sind und BiH daran hindern, ein funktionsfähiger und demokratischer Staat zu werden, analysiert werden. ; This diploma thesis deals with the ?potentialities and constraints of the constitutional reforms in BiH?. To date, the necessary constitutional reforms have not been carried out. One of the fundamental problems is the lack of basic consensus among the three ethnic groups (Bosniacs, Croats and Serbs) regarding the structure of the state. The thesis at hand first provides an overview of the history of the origins of the nation-states and subsequently discusses the phenomena of nationalism and ethno-nationalism including the concept of ethnicity. This is essential for a comprehensive understanding of the Bosnian society and the ?constraints of the constitutional reforms?. Afterwards the options of conflict regulation are presented. Particularly with regard to the optimal model of democracy in an ethnically divided society, a distinction will be made between the majority- and the consociational democracy. Following this, the political system of BiH will be examined. Furthermore, an analysis of the recent attempts to reform the constitution will be provided, taking into account the institution of the High Representative. The institutionalization of the consociational democracy, which provides for an ethnic representation of the three ethnic groups, results in the exclusion of ?Others? (e.g. Roma or Jews) from the exercise of certain offices. Hence, in 2009, the ECHR declared these ethnically exclusive constitutional provisions as discriminatory. The last part of this work focuses on this judgment of the ECHR and the question of its possible implementation.
