W artykule podejmuje się problem zakresu władzy prezydenta na dwu płaszczyznach. Z jednej – wstępnie – na płaszczyźnie tradycyjnych koncepcji prezydentury w polskich demokratycznych konstytucjach (Konstytucji z 1921, tzw. Malej Konstytucji z 1992 oraz Konstytucji RP z 1997). Analiza pokazuje, jak na gruncie generalnie przyjętego parlamentarnego systemu rządów kształtowano pozycję głowy państwa, uwzględniając decyzję z 1990 r. o powszechnych bezpośrednich wyborach prezydenta. Z drugiej strony – i na tym problemie analiza się głównie koncentruje – poddano oglądowi wszystkie konstytucyjne kanały, którymi prezydent może wpływać na decyzje ustawodawcze i wykonawcze państwa. Wbrew pewnemu przekonaniu, że te możliwości prezydenta są niewielkie, ich podsumowanie nie prowadzi do takiego wniosku. Przeciwnie, aktywność prezydenta może się przejawiać w zakresie równoważenia władz, arbitrażu, konsultacji, współdziałaniu, przestrzeganiu prawa (to nawet obowiązkowo), inicjatywy itd. Ale Konstytucja jest elastyczna i nie wymaga wszystkiego: prezydent może też godzić się na bardziej bierną postawę, tylko obserwującą, jeśli uzna, że jego interwencja nie jest niezbędna. To będzie też swoisty rodzaj czuwania nad sprawami państwa.

The article presents the reflection on current propositions regarding new ideas of the European integrity in the social and political literature of the last years. Having assumed that the present economic crisis concerning especially the common currency – euro, therefore the crisis touching the European Union member states directly, has provoked the serious identity problem of the European Union itself, many authors are looking for other visions and there is a whole range of them: from the Union breaking-up ("Good-bye Europe"), through the social contract (as with Rousseau), and the neo-empire (revival of the medieval empire), the post-national democracy (without national states, without Westphalian states) to close federation. As they do not have the character of realistic projects ready to be applied, one cannot omit them, because they are building the excellent doctrinal background to the European integration. ; Artykuł nie zawiera abstraktu w języku polskim

Résumé Cette étude présente le processus de construction de l'État de droit en Pologne, à travers les limites et les risques qui entravent sa réussite. En 1989, en Pologne comme dans d'autres États de l'Europe centrale et orientale, la chute du communisme a permis d'intégrer une clause de l'État de droit dans l'ordre constitutionnel. Dès sa constitutionnalisation, si le principe est d'emblée entré en vigueur, la formation de son arrière-base doctrinale et juridique n'en est qu'à ses balbutiements. L'État de droit est sans cesse menacé par les conditions spécifiques de la transformation : les règlements de comptes du passé, la faiblesse du système des partis politiques, les difficultés des transformations économiques, la fragilité de la société citoyenne, l'insuffisance législative ou le populisme. La dernière période où – d'après certains – le risque s'accroît vérifiera la solidité de l'État en Pologne.

This essay analyzes the process of the establishment of the rule of law in Poland, highlighting the limits & risks that restrain its achievements. In 1989, in Poland as in other Central & Eastern European countries, the fall of communism led to the inclusion of the rule of law in the constitutional order. While this principle was implemented immediately after its inclusion in the Constitution, the formation of its doctrinal & judicial basis is still in its initial stage. The rule of law is constantly threatened by the specific conditions of the transformation process: the settling of scores about the past, the weakness of the party system, the difficult economic transformations, the fragility of civil society, legislative weakness & populism. The more recent period, during which the risks have increased according to certain observers, represents a clear test for the strength of the state in Poland. Adapted from the source document.
