The article analyzes the problem of limiting the competences of the Hungarian legislative and judiciary at the expense of the increase in the significance of the executive after 2010. Although the Fundamental Law provides the rule of the separation of power, Viktor Orbán and his party, using their position in the parliament and government, limit the autonomy of the judiciary and legislative authorities. From the methodological perspective, the analysis is embedded in the neo institutional approach and derives from the concept of the mechanism of democracy regression proposed by Gerschewski. The main question posed in the article refers to the trajectory of limiting the autonomy of the judiciary and legislative power in Hungary after 2010.
Deterioration of Hungarian democracy has weakened the rule of law since 2010. The changes that favour the executive power at the expense of the legislative one are implemented by National Assembly. The paper analyses the formal and practical outcome of the functioning of the Hungarian parliament (2010–2022), which meets the criteria of novelty by referring to only one of the parts of the political system, while many other researchers focus on global regime changes. The research aims to analyze how the Hungarian parliament introduces illiberal legalism. The main question refers to the role and position of the National Assembly in the process of deterioration of Hungarian democracy. The research methods are the legal analysis, neo-institutional approach and comparative method.

Nors šios valstybės atrodė galinčios būti geru demokratijos konsolidacijos pavyzdžiu, prieš daugiau nei dešimtmetį jose išryškėjo pirmieji demokratinių institucijų irimo požymiai. Šiame tekste atkreipiamas dėmesys į institucinę šio proceso raidą. V4 šalių valstybės institucijos yra silpnos ir linkusios pasiduoti stiprių politinių lyderių ir populistinių partijų įtakai, šitaip nebūdamos pakankamai stiprios, kad atsispirtų neliberalioms tendencijoms. Analizėje atskleidus, kad Lenkija ir Čekija yra labiau linkusios kompromituoti liberalios demokratijos pasiekimus, o Čekija ir Slovakija– mažiau, klausiama, kokios yra liberalios demokratijos irimo institucinės priežastys ir padariniai.
The article analyzes the quality of liberal democracy in 11 Central and Eastern European countries, the European Union members. The paper examines the most important fields of the process of democratization, enabling to trace the deterioration of liberal democracy like electorate's support for populist parties, neglecting the rule of the state of law, and the level of corruption. The methods of research are the analysis and synthesis of the material, comparative method, quantitative-qualitative method. Upon the analysis, the typology of three trends of the deterioration of democratization in CEE countries can be offered: massive deterioration, small decrease, stable democracy.

In 1989 Poland decided to implement a democratic regime, but its future was uncertain then. Today, after 30 years of the development of the process of democratization, one can say that the road to democracy is winding. The article analyzes the Polish example of the process of democratization between 1989–2019. It refers to existing theories of the process of democratization and the evaluation of democracy. Although Poland passed through the phases of the erosion of a non-democratic regime, transition and democratic consolidation, the situation after 2015 suggests that there are trends that can reverse the process of democratization. It will be argued that the institutional and behavioral aspects of the process of democratization in Poland cannot be perceived as a linear process.
The Constitutional Court has functioned in Hungary since 1989. Its activity shaped the frame of democratic state of law and influenced the constitutional order in Hungary. In 2011 the National Assembly passed the new Act on the Constitutional Court that replaced a previous one from 1989. The provisions of the Act and the Fundamental Law reduced the role and position of the Court as a separated body in the tripartite power division. The reduction of competences is accompanied by the diminishing of the concluded cases as well. Węgierski Sąd Konstytucyjny został ustanowiony w tym kraju w 1989 roku. Jego działalność pozwoliła na ukształtowanie podstaw demokratycznego państwa prawa i porządku konstytucyjnego Węgier. W 2011 roku węgierski parlament przyjął nową ustawę o Sądzie Konstytucyjnym, która zastąpiła pochodzącą z 1989 roku. Przepisy nowej ustawy oraz Fundamentalnego Prawa ograniczyły rolę i pozycję Sądu Konstytucyjnego jako niezależnego organu władzy mieszczącego się w węgierskim trójpodziale władzy. Ograniczeniu uległ zakres kompetencji, ale i liczba zakończonych spraw rozpatrywanych przez Sąd.

Krytycznie odnoszę się do poglądów Fareeda Zakarii wyrażonych w książce Przyszłość wolności…, postulującego ograniczenie demokratycznych elementów w ramach demokracji liberalnej na rzecz liberalnego konstytucjonalizmu. Koncepcja ta w istocie stanowi bardzo ograniczone rozumienie obu elementów składowych tego ostatniego pojęcia i prowadzić może do poparcia dla dyktatur. Cenna jest w pracy Zakarii dbałość terminologiczna i zwrócenie osobno uwagi na element demokratyczny i liberalny w ramach demokracji liberalnej. Jak jednak wynika z wykorzystywanych trzech kolejnych prac, można twierdzić, że w przypadku pojęcia demokracji liberalnej doszło do transmutacji zespalającej oba człony w czytelną koncepcję, która nie bez racji utożsamiana jest w skrócie z demokracją we współczesnym rozumieniu. Następnie omawiam pozycję Stevena Levitsky'ego i Daniela Ziblatta Jak umierają demokracje…, której autorzy szczegółowo dokumentują, jak skrytobójcy demokracji używają podstępnie instytucji demokratycznych do obalenia tej formy ustrojowej. Wartościowe w tej pracy są szczególnie dwa wątki. Pierwszy to uderzająco podobne strategie stosowane na świecie przez legitymowanych wyborczo autokratów. Ujawnienie takiego wzorca pozwala na łatwiejsze przeciwstawianie się mu. Drugim jest proponowany przez autorów zestaw czterech behawioralnych symptomów pozwalający na rozpoznanie polityków o skłonnościach autorytarnych. Podobną problematykę przedstawia Yascha Mounk w błyskotliwej książce Lud kontra demokracja…, analizujący głębiej źródła współczesnego rozczarowania demokracją liberalną. Akcentuję zwłaszcza, że Mounk przenikliwie odsłania mit założycielski współczesnej demokracji liberalnej w postaci fikcji, że rządy przedstawicielskie umożliwiają władzę ludu. Bardzo szeroką panoramę poglądów amerykańskich autorów na temat prawdopodobieństwa upadku demokracji w Stanach Zjednoczonych zawarto w obszernej pracy zbiorowej Czy to może się u nas zdarzyć? Autorytaryzm w Ameryce pod redakcją Cassa R. Sunsteina. Wybiórczo przedstawiam oryginalne tezy kilkunastu autorów pozwalające na pogłębione przemyślenie kryzysu demokracji liberalnej, m.in. konstytucyjne zepsucie, rozbudowany aparat władzy jako czynnik minimalizujący ryzyko faszyzmu, rolę tzw. ukrytego państwa, udział prawników w zawłaszczaniu władzy, permanentną niezgodę znacznej części społeczeństwa na życie według zasad demokracji liberalnej. W ramach tych uwag akcentuję m.in. rolę kultury jako spoiwa społecznego oraz ewolucyjne niedostosowanie człowieka do różnorodności społecznej. W uwagach końcowych podkreślam iluzoryczność konstytucyjnych gwarancji mających zapobiegać załamaniu demokratycznemu, zwłaszcza zwodnicze poleganie na sędziach. Zwracam również uwagę na podwójny walor negacji płynący z przedstawianych refleksji. Po pierwsze odwołuję się do koncepcji awersyjnego konstytucjonalizmu autorstwa Kim Lane Scheppele, aby wskazać na pouczający wymiar negatywnej strony komparatystyki ustrojowej. Po drugie sugeruję, że kryzys demokracji zachęcać winien do uświadomienia sobie ograniczeń ortodoksyjnej refleksji ustrojowej opartej na wątpliwych założeniach. Tylko w ten sposób można podejmować próby przeciwdziałania narastającemu globalnemu nieładowi demokratycznemu, który z jednej strony nie jest wywołany zewnętrznymi czynnikami naturalnymi, ale z drugiej strony rozwijany będzie zapewne przez znacznie sprawniejszych i bardziej charyzmatycznych autokratów, wspomaganych nowoczesnymi technologiami.
By referring to the emblematic figure of Kurt Gödel, who saw contradictions in both mathematics and constitutionalism, in this paper I present and comment on a wide panorama of views on the current crisis and deconsolidation of liberal democracy, mainly expressed in four noteworthy books published in 2018. I criticize the ideas and views of Fareed Zakaria expressed in the book The Future of Freedom in which he postulates the need for restricting the democratic component of liberal democracy toward the notion of liberal constitutionalism. I argue that this idea actually displays a very limited understanding of both components of liberal democracy and may lead to support for dictatorship. Zakaria makes a case for using accurate terminology and draws attention to the democratic as well as the liberal component of liberal democracy, this alone is a valuable contribution. However, as it appears from the following three works, it could be said that a transmutation occurred within the concept of liberal democracy, resulting in merging of both components into a clear concept that can be equated to democracy in the contemporary sense of the word. Next, I discuss How Democracy Dies by Steven Levitsky and Daniel Ziblatt. Both scholars document in detail how democracy's assassins insidiously use institutions of democracy to kill it. Particularly of value are two threads in this work. The first one is the remarkable similarities of strategies used throughout the world by elected autocrats to subvert democratic institutions. Revealing these patterns makes it easier to combat them. The second one is the set of four key indicators of authoritarian behavior compiled by the authors. Similar issues are presented by Yasha Mounk in his brilliant book The People vs. Democracy in which he analyzes insightfully the roots of disenchantment with liberal democracy. I emphasize that Mounk incisively discloses the founding myth of modern liberal democracy, i.e. the improbable fiction that representative government would facilitate the rule of the people. A very wide array of positions of American scholars is offered in a volume edited by Cass R. Sunstein under the title Can It Happen Here? Authoritarianism in America. The essays collected in this book concern the likelihood of democracy's breakdown in the US. I selectively present the original theses of a score of authors, allowing for a deeper rethinking of the liberal democracy's crisis, these include issues like constitutional rot, big government role in helping to minimize the risk of a fascist takeover, deep state, the new breed of populist autocrats being lawyers by training, and the fact that many people do not wish to live by the rules of liberal democracy. In the context of these remarks, I stress the role of culture as a social binding mechanism and human's lack of evolutionary adjustment to social diversity. In the closing section, I stress the illusory nature of constitutional precautions against the democratic breakdown, especially the deceptive reliance on judges. I also draw attention to the double value of negation following from these considerations. First, I refer to the Kim Lane Scheppele's idea of aversive constitutionalism, to show the informative dimension of the negative side of comparative constitutional analysis. Second, I suggest that the crisis of democracy should encourage to acknowledge the limits of conventional wisdom on political systems that is based on dubious assumptions. Contemporary democratization process challenges the trends of regress or stagnation in the world. The Central European Countries face this problem as well, yet they differ in the depth of changes. The article addresses the problems of quality of democracy regarded as a political regime and the values of constitutional order of the Czech Republic and Hungary. As post-communist, the two countries have been regarded as democratic leaders for a long time. But the Czech Republic has the same Constitution from the beginning of democratization process, while Hungary passed the new Constitution in 2011. The Czech constitutional order reflects liberal democratic rules and values both in axiological and institutional dimension. The Hungarian one mirrors conservative and illiberal axiological values. In the institutional dimension both constitutions seem to maintain specific democratic regime, but in Hungary the executive power is dominant. The methods used in the research were: analysis, synthesis, institutional approach and comparative method. || Współczesny proces demokratyzacji na świecie napotyka od pewnego czasu na przeszkody prowadzące do jego stagnacji, czy nawet regresu. Tendencja ta widoczna jest także w państwach Europy Środkowej. Artykuł podejmuje analizę jakości demokracji rozumianej w sensie substancjalnym i proceduralnym, jaką odzwierciedlają czeska i węgierska konstytucje. Po 1989 roku przez długi okres czasu państwa te były określane mianem liderów demokratyzacji. Obecnie czeski porządek konstytucyjny opiera się na założeniach Konstytucji uchwalonej na początku procesu demokratyzacji (1992 r.), a węgierski porządek reguluje Konstytucja uchwalona po dwóch dekadach od rozpoczęcia tegoż procesu (2011 r.). W wymiarze aksjologicznym czeska Konstytucja opiera się na wartościach demokratycznych i liberalnych, natomiast węgierska na konserwatywnych, tradycyjnych, a nawet nieliberalnych. W wymiarze instytucjonalnym obydwie Konstytucje gwarantują funkcjonowanie reżimu demokratycznego, z tym, że w przypadku węgierskim mamy do czynienia z dominacją egzekutywy rządowej, a w Czechach z modelem parlamentarnym. Metodami stosowanymi w procesie badawczym były: analiza i synteza, podejście instytucjonalne i metoda porównawcza.
Artykuł poświęcony jest zagadnieniu wprowadzania zasad reżimu demokratycznego do życia politycznego Japonii po zakończeniu II wojny światowej. Zamierzeniem autora była próba określenia sposobu i poziomu zakorzeniania się wartości demokratycznych w świadomości społeczeństwa japońskiego. Dlatego też autor stara się określić wpływ wartości demokratycznych na postawy społeczne Japończyków w omawianym okresie czasu. W tym celu zostaje dokonana analiza kilku kluczowych dla zrozumienia problemu płaszczyzn: aksjologicznej, normatywnej i instytucjonalnej. Autor ukazuje także wpływ wewnętrznych postaw społecznych w Japonii manifestowanych w zakresie kultury politycznej na konwersję zasad i wartości demokracji i proces demokratyzacji.
Today democracy means that almost all adult citizens participate in the exercising of power. In substantive terms, democracy relies on freedom, equality, and majority rule. At the same time, it is also a regime that rests on specific principles and procedures (the procedural perspective). The process of consolidating democratic values and procedures goes through various stages. First, the erosion of a non-democratic regime involves the transfer of power from former elites to new political actors. Next, during the transition stage, the democratic institutional design is introduced into the political system. Finally, during the consolidation stage, the democratic principles of political life become well-established and democratic values accepted and internalised by the society. The most important determinants of the stage of erosion include: the heritage of the past and the influence of the surroundings. The transition is determined by: the structure of the state, national identity, political elites' work on the constitution, the relationship between the organs of government, the party system, the electoral system, lustration, decentralisation of power to a system of local authorities, and external factors. The consolidation stage depends on institutional factors on the one hand. such as the final design of the constitution, a stable model of relations between the organs of government, the development of a pluralistic party system, and solidification of the electoral system, and on behavioural factors on the other, such as acceptance and internalisation of democratic values by the society. The process of democratisation can be analysed and evaluated with the use of quantitative and qualitative indicators. Zamierzeniem autora była próba określenia sposobu i poziomu zakorzeniania się wartości demokratycznych w świadomości społeczeństwa japońskiego. Dlatego też autor stara się określić wpływ wartości demokratycznych na postawy społeczne Japończyków w omawianym okresie czasu. W tym celu zostaje dokonana analiza kilku kluczowych dla zrozumienia problemu płaszczyzn: aksjologicznej, normatywnej i instytucjonalnej. Autor ukazuje także wpływ wewnętrznych postaw społecznych w Japonii manifestowanych w zakresie kultury politycznej na konwersję zasad i wartości demokracji i proces demokratyzacji. ; The article describes the problem of democracy in Japan as an external political system introduced after the end of World War II. The author tries to explore how deeply democratic values were rooted in Japanese society in the first decade after the war. The key objective of this article is to analyse how Japanese democratic values functioned at that time, how they influenced political attitudes and if they were coherent. There are three basic dimensions of the author's considerations: axiological, normative and institutional. To achieve this, the author describes democratic values, internal elements of Japanese political culture and the democratisation process as a single complex process.
