У статті акцентується увага на необхідності переосмислення сутності явища, позначуваного терміном «система права». Проблематика системи права постійно перебуває в центрі уваги вітчизняних науковців, переважно через з'ясування співвідношення цього поняття з поняттям «правова система». Наголошується, що у вітчизняному правознавстві використовується ціла низка термів, які мають схожий зміст: право, система права, правова система, система законодавства. Саме право інтерпретується як система норм, тож ідеться про чотири системи. За умови сприйняття права як прескриптивного тексту усі вони є тотожними, оскільки і право є результатом діяльності органів публічної влади, що формалізується у тексті нормативно-правового акту. Стверджується, що термін «система права» використовувався у межах радянської юриспруденції, яка ґрунтувалася на постулатах нормативістської школи права. У основі радянської юриспруденції лежав принцип законності й саме закон сприймався як право. Права не існувало поза межами закону. Зазначається, що європейська фахова правнича література не використовує терміни «Legal System» і «System of Law» як відповідники понять «правова система» і «система права», усталеним є термін «Legal System», однак у значенні права, системи права. ; noted by the term "system of law". It is emphasized that a number of terms that have a similar meaning are used in domestic jurisprudence: law, system of law, legal system, and system of legislation. Herewith, law itself is interpreted as a system of rules. So the point is that there are four systems. Under the condition that law is perceived as a prescriptive text, they are all identical, since the law is the result of the activity of public authorities, which is formalized in the text of a legal act. It is argued that the term "system of law" was used within the limits of soviet jurisprudence, which was based on the principles of the normative school of law. At the heart of soviet jurisprudence was the principle of legality, and it was the law that was regarded as law. Law did not exist outside the law. It is noted that the European professional legal literature does not use the terms "Legal System" and "System of Law" as terms corresponding to the concepts of "legal system" and "system of law"; the term "Legal System" is fixed, but in the sense of law, the system of law.
Adoption of the Guiding Principles on Business and Human Rights and the OECD Guidelines for Multinational Enterprises indicates gradual change in human rights theory. However the Convention for the Protection of Human Rights and Fundamental Freedoms is the most universal international treaty and the European Court of Human Rights was created to ensure its implementation The Convention lays down vertical dimension of human rights and the practice of the Court allows to speak about the necessity to adjust the theory of human rights in the context of extending the duty to respect human rights to business. The classical theory of human rights, according to which the addressee of human rights is the state (which has responsibilities for human rights recognition, provision and protection) does not meet modern challenges with the spread of influence of business upon the field of human rights and the activities of transnational corporations, in particular, because of the necessity to extend the duty to respect and provide human rights to businesses. Business is an important subject in the field of human rights implementation, but until recently, it was not obliged to respect human rights. An important factor in changing the theory of human rights was the activities of transnational corporations. The main provisions implemented in international law are the following: the state has both positive and negative obligations in the field of human rights, an obligation to protect them from breaches by third parties, in particular, by business. To do this, the state should adopt quality legislation providing for the liability of persons breaching human rights; the state is obliged to create effective remedies for human rights violations, both judicial and extrajudicial; the state is also obliged to create conditions for functioning of non-state remedies; business must respect human rights by exercising human rights due diligence. Aspects of the mutual influence of human rights and business at the international level are determined by the practice of the European Court of Human Rights (the Court), the analysis of which allows to conclude on both the impact of business on human rights and the impact of rights on business. The impact of business on human rights can be both positive (when business promotes further human rights development or directly implements human rights) and negative. However, the most common in practice of the Court are cases in the field of media, legal business and financial and property cases. Human rights might constrain the development of a particular business (Convention for the Protection of Human Rights and the Dignity of the Human Being with regard to the Application of Biology and Medicine: Convention on Human Rights and Biomedicine stipulates that development of biology and medicine should be used for the benefit of society, but without prejudice to human dignity). One of the aspects of interaction between human rights and business is that businesses can apply for human rights protection to the European Court of Human Rights. ; Прийняття Керівних принципів щодо бізнесу та прав людини та Керівних принципів ОЕСР для транснаціональних підприємств свідчить про поступові зміни в теорії прав людини. Однак Конвенція про захист прав людини та основоположних свобод є найбільш універсальним міжнародним договором, і Європейський суд з прав людини був створений для забезпечення її реалізації. Конвенція встановлює вертикальний вимір прав людини, а практика Суду дозволяє говорити про необхідність коригування теорії прав людини в контексті розширення обов'язку поважати права людини на бізнес. Класична теорія прав людини, згідно з якою адресатом прав людини є держава (яка несе відповідальність за визнання, забезпечення та захист прав людини), не відповідає сучасним викликам із поширенням впливу бізнесу на сферу прав людини та діяльність транснаціональних корпорацій, зокрема, через необхідність розширити обов'язок поважати та забезпечувати права людини для бізнесу. Бізнес є важливою темою в галузі реалізації прав людини, але до недавнього часу він не був зобов'язаний поважати права людини. Важливим фактором зміни теорії прав людини стала діяльність транснаціональних корпорацій. Основні положення, реалізовані в міжнародному праві, такі: держава має як позитивні, так і негативні зобов'язання у галузі прав людини, зобов'язання захищати їх від порушень третіми особами, зокрема, бізнесом. Для цього держава повинна прийняти якісне законодавство, що передбачає відповідальність осіб, які порушують права людини; держава зобов'язана створити ефективні засоби захисту від порушень прав людини, як судові, так і позасудові; держава також зобов'язана створити умови для функціонування недержавних засобів правового захисту; бізнес повинен поважати права людини, здійснюючи належну перевірку прав людини. Аспекти взаємного впливу прав людини та бізнесу на міжнародному рівні визначаються практикою Європейського суду з прав людини (Суду), аналіз якої дозволяє зробити висновок як про вплив бізнесу на права людини, так і про вплив прав на бізнес. Вплив бізнесу на права людини може бути як позитивним (коли бізнес сприяє подальшому розвитку прав людини або безпосередньо реалізує права людини), так і негативним. Однак найпоширенішими на практиці Суду є справи у сфері засобів масової інформації, юридичного бізнесу та фінансово-майнових справ. Права людини можуть стримувати розвиток певного бізнесу (Конвенція про захист прав людини та гідності людини щодо застосування біології та медицини: Конвенція про права людини та біомедицину передбачає, що розвиток біології та медицини повинен використовується на благо суспільства, але без шкоди для людської гідності). Одним із аспектів взаємодії між правами людини та бізнесом є те, що підприємства можуть звертатися за захистом прав людини до Європейського суду з прав людини.
The article is devoted to explaining the differences between legal educational systems in states with a positivist understanding of law and states where the system of law is based on the natural understanding of law. Law education has a value orientation. The educational process at higher law schools aims not only to transfer information about law but also to involve the student into the legal values. The purpose of law education under the positivist understanding of law is to provide the student with encyclopaedic knowledge of current legislation. The purpose of legal education under the natural understanding of law is the preparation of a critically minded lawyer, who is characterized by devotion to the idea of law and who meets advanced ethical requirements. An important direction for improving law education is the introduction of legal clinical education. ; Стаття присвячена висвітленню відмінностей між правовими освітніми системами в державах із позитивістським розумінням права та державами, де система права базується на природному розумінні права. Юридична освіта має ціннісну спрямованість. Навчальний процес у вищих правничих школах спрямований не лише на передачу інформації про право, а й на залучення студента до правових цінностей. Метою юридичної освіти за позитивістського розуміння права є надання студенту енциклопедичних знань чинного законодавства. Метою юридичної освіти за природного розуміння права є підготовка критично налаштованого юриста, якому властива відданість ідеї права і який відповідає сучасним етичним вимогам. Важливим напрямком вдосконалення юридичної освіти є запровадження юридичної клінічної освіти.
The monograph analyzes the main aspects of the impact of globalization on the state and legal sphere in Ukraine. The factors that contribute to the loss or strengthening of the identity of the national legal system, lead to the transformation, change and modernization of state legal institutions, norms and relations within the national and supranational law are highlighted. Emphasis is placed on the fact that Ukrainian legal practice is gradually moving away from the normative perception of law and implementing the provisions of the natural law school, which is based on the recognition of human dignity and human rights and provides for the obligation of the state to assert these rights. . A philosophical and legal analysis of the "phenomenon" of Ukrainian reforms has been made. Practical recommendations for improving domestic legislation are given. ; У монографії проаналізовано основні аспекти впливу глобалізації на державно-правову сферу в Україні. The attention is focused on the fact that epistemological developments of a conceptual nature regarding the understanding of the essence of the rule of law, its main characteristics, and the possibilities of adapting the provisions that constitute the basis for the formation and functioning of the rule of law to national character-istics are important for Ukrainian legal science. The philosophical and legal analysis of problems of forming a state gov-erned by the rule of law outlined.
