Im europäischen Einigungsprozeß wird seit der Inangriffnahme des Projekts der Errichtung und Vollendung des Binnenmarktes auch der sozialen Dimension des Binnenmarktes - und damit der Gemeinschaftstätigkeit im sozialen Bereich - verstärkte Aufmerksamkeit zuteil. Die Rede ist gleichermaßen vom "sozialen Europa", dem "europäischen Sozialraum", der "Europäischen Sozialunion" wie vom "sozialen Defizit" Europas. -- Mit der Annahme der "Gemeinschaftscharta der sozialen Grundrechte der Arbeitnehmer" im Jahre 1989 durch die Staats- und Regierungschefs von elf Mitgliedstaaten ist das Bestreben der Gemeinschaft, neben der Vertiefung der Integration im wirtschaftlichen Bereich auch eine verstärkte Integration im sozialen Bereich zu erreichen, eindrucksvoll dokumentiert worden. Dieser Zielsetzung tragen die entsprechenden Regelungen des Vertrages über die Europäische Union und das dem Vertrag beigefügte Protokoll über die Sozialpolitik Rechnung. -- Daß nicht alle Mitgliedstaaten der Europäischen Union bereit sind, eine vertiefte Integration im sozialen Bereich mitzutragen, zeigt sich an der Sonderstellung des Vereinigten Königreichs Großbritannien und Nordirlands im sozialen Bereich. Zu erwarten ist, daß die "Europäische Sozialunion". in ähnlicher Weise wie die geplante Wirtschafts- und Währungsunion wohl nur auf dem Wege einer abgestuften Integration zu erreichen sein wird. -- Ziel der Arbeit ist es, das gemeinschaftliche Tätigwerden im sozialen Bereich zu erfassen und rechtlich zu würdigen. Nach einer Darstellung der gemeinschaftlichen Praxis im sozialen Bereich (1. Teil) werden Gebiete untersucht, die in jüngster Zeit auf gemeinschaftlicher und mitgliedstaatlicher Ebene wie auch im Schrifttum besonders intensiv diskutiert worden sind (Arbeitsrecht, Transfer von Leistungen der sozialen Sicherheit und Sozialer Dialog, 2. Teil). Einen weiteren Schwerpunkt bilden grundsätzliche Fragen von Kompetenzzuweisungen an die Gemeinschaft im sozialen Bereich (3. Teil).

This open access book analyses the interplay of sustainable development and human rights from different perspectives including fight against poverty, health, gender equality, working conditions, climate change and the role of private actors. Each aspect is addressed from a more human rights-focused angle and a development-policy angle. This allows comparisons between the different approaches but also seeks to close gaps which would remain if only one perspective would be at the center of the discussions. Specifically, the book shows the strong connections between human rights and the objectives of the 2030 Agenda for Sustainable Development and the Sustainable Development Goals adopted by the United Nations in 2015. Already the preamble of this document explicitly states that "the 17 Sustainable Development Goals ... seek to realise the human rights of all". Moreover, several goals and targets of the 2030 Agenda correspond to already existing individual human rights obligations. The contributions of this volume therefore also address how the implementation of human rights and SDGs can reinforce each other, but also point to critical shortcomings of the different approaches.
