Der Beitrag versucht zu zeigen, daß wesentliche Züge der innergewerkschaftlichen Demokratie in Polen sich durch die demokratische Tradition und das invidualistische Freiheitsethos der Polen erklären lassen. Die sich entwickelnde Demokratie lebt nach wie vor von dieser unterschwelligen demokratischen Strömung und sie erklärt auch den Zusammenbruch der kommunistischen Diktatur. Die Erfahrungen mit der im großen Maße partizipatorischen Demokratie innerhalb der Solidarnosc hatte segensreiche, aber auch weniger glückliche Folgen. Es kam zu keinen radikalen Bruch mit dem früheren System, die Umwandlungen hatten eher reformistischen Charakter. Andererseits konnte und kann die polnische Demokratie nicht wieder von ganz vorne beginnen und von den Schöpfern der neuen Verfassung als tabula rasa betrachtet werden. Es ist daher heute insgesamt schwer, eine Gewinn-Verlust-Rechnung des gesellschaftlichen Befreiungsprozesses durchzuführen. (pre)

In Befragungen, die der Autor seit 1988 im Abstand von zwei Jahren durchgeführt hat, ist der Prozentsatz derjenigen Polen, die sich selbst der Mittelklasse zurechnen, annähernd konstant geblieben. Diese neue Mittelklasse ist eine äußerst heterogene soziale Gruppe, die sich nicht zuletzt aus Repräsentanten der neuen Wirtschaftselite zusammensetzt, deren Zahl sich im Rahmen der Privatisierung der Wirtschaft bedeutend vergrößert hat. Entgegen den Befürchtungen eines zunehmenden Statusverlusts hat sich die Position der Intelligenzija mit Universitätsausbildung parallel zum Entstehen der Marktwirtschaft verbessert. (BIOst-Mrk)

Examines how social conflict is changing in Poland's postcommunist transformation. Causes, frequency, & settlement of legal disputes in 3 Polish cities (Warsaw, Olesno, & Lesko) during the late 1970s & 1989-1993 are analyzed, & several recent cases are described in greater detail. It is concluded that: patterns of interpersonal conflicts show some change; private accusation cases have decreased in frequency, largely due to higher filing fees; civil disputes have generally increased since 1990, particularly corporate suits against individuals; & other types of conflict have also changed. Citizens are now more likely to challenge the decisions of local authorities. Such conflicts are also more likely to be collectivized (eg, a city's unemployed population confronts their mayor). Such transformation-related conflicts can function to increase political awareness. 5 Tables, 13 References. E. Blackwell

In this paper, the task is to check why we do question the validity of a certain explanation of behaviour even if at the same time this explanation serves us as a frame of reference in our everyday professional research and action. We mean here the most trivial and, simultaneously, the most problematic explanation of behaviour in terms of legal rules. In general, the paper addresses the most important of theoretical problems in sociology of law, that is, does sociology of law have at its disposal a theory at all. In particular, as law of laws (LL) this explanation was selected as it seems to be of fundamental role for sociology of law in the whole.
