Мета статті полягає у проведенні науково-теоретичного дослідження виникнення, розвитку й сучасного стану української мови як соціокультурного та правового явища. Методологічною основою дослідження слугують наступні методи наукового пізнання: загальнонаукові (формально-логічний, метод аналізу та синтезу) та спеціально-правові (порівняльно-правовий, формально-юридичний). Зазначені методи надають можливість розкрити особливості української мови через призму соціокультурного феномену й розглянути правові проблеми мовної політики держави. Наукова новизна полягає у здійсненні комплексного дослідження соціокультурних та правових аспектів української мови в контексті її збереження та подолання мовної кризи. Висновки. Державна українська мова є мовою громадянства, запорукою збереження національної ідентичності українського народу, основою формування української державності. Сучасне українське суспільство характеризується багатьма різними суперечностями, серед яких – питання двомовності, надання російській мові статусу другої державної мови. На наш погляд, це призводить до спотворення національної свідомості й загострення мовної ситуації в країні. Виходячи із цього, Україні потрібна «мудра», виважена політика, яка б забезпечила функціонування і захист національної мови й водночас гарантувала підтримку мов етнічних меншин. Багато в чому успіхи консолідації українського суспільства залежать від того, наскільки державна мова підтримується й поважається різними соціумами та кожним індивідом зокрема. Більше того, від ефективного впровадження й реалізації мовного законодавства, безперечно, залежатиме програма правового розвитку мови. Тож на сьогодні вельми актуальним є питання прийняття мовного закону, який би спрямував систему відповідних державних заходів на утвердження й запровадження дієвого механізму поширення української мови як державної в усіх сферах суспільного життя. ; Цель статьи заключается в проведении научно-теоретического исследования возникновения, развития и современного состояния украинского языка как социокультурного и правового явления. Методологической основой исследования служат следующие методы научного познания: общенаучные (формально-логический, метод анализа и синтеза) и специально-правовые (сравнительно-правовой, формально-юридический). Указанные методы дают возможность раскрыть особенности украинского языка через призму социокультурного феномена и рассмотреть правовые проблемы языковой политики государства. Научная новизна заключается в осуществлении комплексного исследования социокультурных и правовых аспектов украинского языка в контексте ее сохранения и преодоления языкового кризиса. Выводы. Государственный украинский язык является языком гражданства, залогом сохранения национальной идентичности украинского народа, основой формирования украинской государственности. Современное украинское общество характеризуется многими различными противоречиями, среди которых – вопрос двуязычия, предоставления русскому языку статуса второго государственного языка. На наш взгляд это приводит к искажению национального сознания и обострения языковой ситуации в стране. Исходя из этого, Украине нужна «мудрая», взвешенная политика, которая бы обеспечила функционирование и защиту национального языка и одновременно гарантировала поддержку языков этнических меньшинств. Во многом успехи консолидации украинского общества зависят от того, насколько государственный язык поддерживается и уважается различными социумами и каждым индивидом в частности. Более того, от эффективного внедрения и реализации языкового законодательства, безусловно, будет зависеть программа правового развития языка. Поэтому на сегодня весьма актуальным является вопрос принятия языкового закона, который бы направил систему соответствующих государственных мероприятий на утверждение и введение действенного механизма распространения украинского языка как государственного во всех сферах общественной жизни. ; The purpose of article is to conduct a scientific and theoretical study of the emergence, development and current state of the Ukrainian language as sociocultural and legal phenomenon. The methodology of the study is the following methods of scientific knowledge: general scientific (formal-logical, method of analysis and synthesis) and special-legal (comparative law, formal-legal). These methods provide the opportunity to reveal the peculiarities of the Ukrainian language through the prism of sociocultural phenomenon and consider the legal problems of the language policy of the state. Scientific novelty consists in carrying out a comprehensive study of socio-cultural and legal aspects of the Ukrainian language in the context of its preservation and overcoming the language crisis. Conclusion. State Ukrainian language is the language of citizenship, a guarantee of preservation of the national identity of the Ukrainian people, the basis of the formation of Ukrainian statehood. Modern Ukrainian society is characterized by many different contradictions, among which – the issue of bilingualism, giving the Russian language the status of the second state language. In our opinion, this leads to the distortion of national consciousness and aggravation of the linguistic situation in the country. On this basis, Ukraine needs "wise", well-balanced policy that would ensure the functioning and protection of the national language and, at the same time, ensure the support of languages of ethnic minorities. In many ways, the success of consolidation of the Ukrainian society depends on the extent to which the state language is supported and respected by different societies and each individual in particular. Moreover, the effective implementation and realization of linguistic legislation, of course, will depend on the program of legal development of the language. Therefore, today it is very relevant to adopt the linguistic law that would direct the system of appropriate state measures to establish and introduce an effective mechanism for the dissemination of the Ukrainian language as a state language in all spheres of public life.

Nowadays environmental protection and the rational use of natural resources have become priorities of the state-building strategy in almost all developed countries of the world. Effective financing of these activities is required for the development and adoption of national targeted, local programs for environmental protection, for the sustainable development of society, for the rational use and reproduction of natural resources. Nowadays in Ukraine there is no single view on understanding of the strategy of development of energy safety, which profoundly and negatively affected the general state of national safety of the country. The purpose of the article is to analyze the current state of legal security of energy safety in Ukraine, check it for compliance with its obligations under the Association Agreement with the EU and other EU acts that proclaim the standards in the field of energy safety. This paper refers to the experience of the EU energy safety legislation. Furthemore, this study provides analysis of Ukrainian legislation in this field, draws attention to the existing conflicts and gaps, emphasizing the need to optimize legislation of Ukraine's energy safety according to the EU standards. Land parcels fragmentation problem in different agriclimatic zones of Ukraine is reviewed; general pattern, as well as regional specific is outlined. Land management of fragmented parcels in agricultural use is discussed, including land ownership and jurisprudence issues of land consolidation. Three key plots were chosen to analyze issues of land fragmentation, geospatial data shown demonstrate need for land consolidation to optimize agricultural land-use of such territories. Specificity fragmentation of land for agricultural companies, located in the mountainous regions of Ukraine, is noted. Gaps in the legal regulation of relation connected with land fragmentation were disclosed. Problems of land inheritance in the context of fragmentation, exchange of land resources as a tool for effective functioning of land market, the small and medium producers, economic development and agriculture in general; the creation of a land bank is regarded as a factor in reducing fragmentation of land were examined.

Urgency of the research. Agricultural development objectively leads to increasing investments in production. The growth of equity capital of agrarian enterprises is an important factor in increasing economic efficiency of production. Target setting. Important is the study of the investment component of the state taxation policy to agrarian industry performance as well as the impact of state administrative and financial methods of tax pressure on the formation of own funds of enterprises through the use of tax privileges, simplified taxation system, application of special regimes of payment of VAT mode, etc. Actual scientific researches and issues analysis. To study the current state of legal regulation of the impact of tax burden on agrarian producers and to formulate proposals for improving domestic tax legislation. The statement of basic materials. It is necessary to preserve the application of the VAT regime in the field of agriculture in the wording that existed until January 1, 2016. Let us define the peculiarities of the taxation strategy and the reduction of tax pressure to agricultural payers. Conclusions. The positive impact of the economic investments in the agricultural production sector, though the described benefits in the tax system would be especially noticeable in conditions of limited budgetary subsidies, economic inefficiency of bank credits, rising prices for inputs and other forms of financial crisis. ; Актуальність теми дослідження. Забезпечення сталого розвитку сільського господарства потребує радикального перетворення економічних відносин. Збільшення власного капіталу аграрних підприємств є важливим фактором підвищення економічної ефективності виробництва. Постановка проблеми. Важливим є дослідження інвестиційної складової державної податкової політики для діяльності аграрної галузі у частині використання податкових пільг, спрощеної системи оподаткування , застосування спеціальних режимів сплати ПДВ, а також впливу державних адміністративних та фінансових методів податкового тиску на формування власних коштів підприємств. Аналіз останніх досліджень і публікацій. Визначення спеціальних механізмів оподаткування для аграріїв на тлі розробки нормативно-правової бази регулювання економічних відносин проаналізовані в роботах В. Збарського, В. Мацибори, М. Кучерявенка, В. Курила, В. Мушенка та ін. Виділення недосліджених частин загальної проблеми. У той же час недостатньо наукових праць висвітлюють тенденції та особливості впливу податкових важелів системи оподаткування на аграріїв в Україні. Постановка завдання. Розгляд сучасного стану правового регулювання впливу податкового тягаря на аграрних виробників та сформульовані пропозиції щодо вдосконалення національного податкового законодавства. Виклад основного матеріалу. Визначено, що для припинення економічного спаду в аграрній галузі в даний час необхідно зберегти застосування режиму ПДВ у сфері сільського господарства в редакції, яка існувала до 1 січня 2016 року. Визначено перспективи стратегії оподаткування та зменшення податкового тиску на аграрних платників податків. Висновки. Вплив економічних інвестицій на аграрну галузь через пільги у системі оподаткування стане відчутним в умовах обмеженості бюджетних дотацій, економічної неефективності банківських кредитів, зростанні цін на матеріально-технічні ресурси та при інших проявах фінансової кризи.

In order to build effective democratic governance under the Council of Europe Action Plan for Ukraine, local governments and elected representatives must have the knowledge and tools to manage modern and efficient resources, and local governments in general must increase their transparency, activities to strengthen citizens' trust in local political institutions. In its ambitious plans to implement effective governance, the Government of Ukraine is working to create a modern system of local self-government that promotes the dynamic development of regions and transfers as much power as possible to the level closest to citizens - communities. The article is devoted to the issue of ensuring the sustainable development of local self-government in Ukraine on the basis of the experience of building the system of local self-government in the European countries. Foreign experience with the existing system of local governments of Ukraine is compared. Local governments are classified into representative and executive. The practice of organizing their activities is studied. Both regional and local representative bodies and municipalities were studied. Different types of individual and collegial executive bodies of local self-government of foreign countries, methods of their formation, management models are given. The real state of the results of the reform of local self-government and decentralization, as well as the administrative-territorial system in Ukraine has been established. The main positive features of the system of local self-government bodies of foreign countries are identified and options for implementing sustainable development methods for self-government of Ukraine are proposed, including through effective state control, election of key local government officials, codification of local self-government legislation and balancing the status and powers of representatives and executive bodies of local self-government.
