La teorización moderna del estado de naturaleza, su narrativa secular, no solo ha sido crucial para el desarrollo de las teorizaciones del Estado moderno; incluso se pueden observar sus derivadas en las formulaciones liberales como la Teoría de la justicia de John Rawls y su posición original dentro de una teoría contractualista. Efectivamente, la teorización contemporánea de las posiciones contractualistas no puede sustraerse de un diálogo con las teorías modernas que van de Locke a Kant. Pero sería un error, propio de la posición deformante de cierta lectura de la modernidad, no preguntarse por la naturaleza teológica de dicha narrativa. Intentaremos rastrear sus raíces medievales, especialmente desde la antropología teológica medieval, haciendo hincapié en la formulación franciscana
Hispanic specialists in the Alphonsine work have studied the distinction between 'natura' and 'nature' of the Partidas. The conclusions of these analyzes affirm that this distinction is born from a semantic displacement that is situated in a plane of legal-social relationships, within a naturalistic model in the Alphonsine political project that shows a Christian Aristotelian reading. The present paper does not differ from these conclusions, but we believe that it is necessary to modulate this naturalistic model from broader metaphysical conceptualizations that better explain what that Christian Aristotelianism consists of. We will try to reinforce these theses from assessments that have the multidisciplinary nature present in the Alphonsine scriptorium as a backdrop. We present the possible influence of the philosophical schemes of the First Franciscan Scholasticism in this distinction of the terms 'nature' and 'nature'. ; Los hispanistas especialistas en la obra alfonsí han estudiado la distinción entre 'natura' y 'naturaleza' de las Partidas. Las conclusiones de dichos análisis afirman que este distingo nace de un desplazamiento semántico que se sitúa en un plano de relaciones jurídico-sociales, dentro de un modelo naturalista en el proyecto político alfonsí que muestra una lectura aristotélica cristiana. El presente estudio no difiere de dichas conclusiones, pero creemos que es necesario modular dicho modelo naturalista desde conceptualizaciones metafísicas, más amplias, que expliquen mejor en qué consiste ese aristotelismo cristiano. Trataremos de apuntalar dichas tesis desde apreciaciones que tienen como telón de fondo el carácter multidisciplinar presente en e scriptorium alfonsí. Presentamos de forma singular la posible influencia de los esquemas filosóficos de la primera escolástica franciscana en dicha distinción de los términos 'natura' y 'naturaleza'.
En este artículo partimos de la hermenéutica no tanto como método filosófico determinado, como la herramienta inherente a todo acto humano, especialmente en el de la toma de decisión. El derecho supone una toma de decisión tanto en el ejercicio legislativo como en la práctica judicial. Pero la interpretación humana siempre genera un estado de incertidumbre, al dar la impresión de que se trata de un acto privado de objetividad, más propio de la ciencia, lo que ha llevado a buscar un paradigma en derecho que sea científico y que se ha identificado muchas veces con el positivismo (empirismo) lógico. La perspectiva filosófica que proponemos es la del análisis de la propia naturaleza inherente del acto interpretativo, toda vez que ni el dato, ni el sujeto, ni la ciencia se pueden reducir a meros datos y hechos, sin tener en cuenta no solo el contexto de justificación, sino el de descubrimiento y la perspectiva sociológica. A ello sumamos las nuevas perspectivas de la neurociencia y la psicología cognitiva basada en la inferencia bayesiana que muestra, a su vez, cómo la percepción sensorial es leída por el cerebro desde un contexto cultural e histórico propio capaz de realizar un pensamiento proyectivo. Esto supone que el razonamiento analítico y la lógica deductiva y empírica no son suficientes a la hora de analizar unos datos que nunca son leídos de forma neutra (en bruto). En conclusión, la mejor forma de evitar la incertidumbre no consiste en cerrar los ojos a la evidencia de la interpretación, sino afrontarla con herramientas como la hermenéutica. ; In this article we start from hermeneutics, not so much as a specific philosophical method, but as the inherent tool of every human act, especially in decision-making. Law implies decision-making both in the legislative exercise and in judicial practice. But human interpretation always generates a state of uncertainty, by giving the impression that it is a private act of objectivity, more typical of science, which has led to the search for a paradigm in law that is scientific and has often been identified with logical positivism (empiricism). The philosophical perspective that we propose is that of the analysis of the very inherent nature of the interpretative act, since neither data, nor the subject, nor science can be reduced to mere data and facts, without taking into account not only the context of justification, but also that of discovery and the sociological perspective. To this we add the new perspectives of neuroscience and cognitive psychology based on Bayesian inference that shows, in turn, how sensory perception is read by the brain from a cultural and historical context of its own that is capable of projective thinking. This implies that analytical reasoning and deductive and empirical logic are not sufficient when analyzing data that are never read in a neutral (raw) way. In conclusion, the best way to avoid uncertainty is not to close our eyes to the evidence of interpretation, but to face it with tools such as hermeneutics. ; peerReviewed
Aún siguiendo un pensamiento restrictivo en cuanto a la desobediencia civil, la objeción de conciencia cabe, también, incluso en estos ordenamientos jurídicos en los que se contemplan estas reglas pues su sectorialidad las convierte en situaciones especiales. Esto significa que discutir este tema es esencial para modernizar al Estado en el que vivimos, para dotarle de legitimidad, para profundizar en el Estado de derecho y en las instituciones y convicciones democráticas, al fin, para asegurar su radical moralidad y el diálogo entre el ciudadano y sus instituciones.
Los acontecimientos de que se mencionan tienen en común tres cosas, la naturaleza geo-lingüística, la relativa a la temática y la referente a su significación. Con la naturaleza geo-lingüística se refiere al hecho de que estos congresos nacen en el ámbito lusófono, aunque con vocación ibérica e iberoamericana y relevancia internacional en los tres casos. El segundo aspecto tiene que ver con la naturaleza histórica del estudio, así como con su significación en la construcción del pensamiento moderno, especialmente filosófico, pero de gran trascendencia en el teológico y con proyección en los ámbitos científico, social y político. En este sentido los tres congresos o coloquios han sabido conjugar el estudio propiamente medieval con la profundización, desde este apasionante y crítico periodo del pensamiento, en la construcción del pensamiento moderno occidental. ; The events mentioned have three things in common, nature Geo-linguistics, on the subject and also in relation to its significance. The Geo-linguistic nature refers to the fact that these conferences are born in the Lusophone area, although they have Iberian, Latin American and international vocation. The second aspect refers to the historic nature of the study and its significance in building, especially modern philosophical thought, but of great importance in theological and projection in the scientific, social and political spheres. Este artículo analiza cómo las democracias europeas están tolerando –cuando no promoviendo– la proliferación de mensajes denigrantes hacia aquellos ciudadanos que viven su religión, especialmente la católica, y reclaman la presencia de esta experiencia en el ámbito público; sufriendo por todo ello una discriminación que es amparada sistemáticamente por las instituciones políticas, alcanzando niveles de delitos de odio que en ningún caso serían admisibles en relación al género, la raza, la discapacidad o la orientación sexual. Los delitos de odio por motivos religiosos hacia el catolicismo se han convertido en norma, legitimando las afrentas hacia una religión que se caricaturiza como colonialista y a unos seguidores a los que se etiqueta como privilegiados explotadores, siendo todo ello producto de una confusión interesada entre el fenómeno de la secularización y el del laicismo. Así, desde la premisa jurídico-político de la laicidad del Estado, se demoniza como fundamentalista cualquier manifestación de un creyente católico que, desde el respeto absoluto a los valores democráticos, proponga sus principios como valores propositivos para la sociedad y la vida pública; aptitud que, en aras de la paz social y como manifestación de un laicismo que se ha convertido en una ideología que busca erradicar del ámbito púbico cualquier vinculación de Dios en las vidas humanas y en sus estructuras, es tole-rada paradójicamente en relación a religiones objetivamente fundamentalistas o respecto a posiciones visceralmente hostiles hacia la religión. Consideramos que este trato es aplicado al catolicismo con el fin de acallar su influencia moral, ya que, además de agente fundamental en el proceso histórico de institucionalización del poder temporal, constituye un baluarte frente a cualquier abuso de intromisión política en la vida de las personas. En definitiva, en aras de instaurar el pensamiento único del Estado, se trataría de deslegitimar el mensaje evangélico de la Iglesia en su denuncia a todo tipo intervencionismo, dependencia y control estatal que vulnere el pleno desarrollo de la libertad y la dignidad humana. ; This article analyses how European democracies are tolerating - if not promoting -the proliferation of denigrating messages towards those citizens who live their religion, especially Catholicism, and demand the presence of this experience in the public sphere; suffering discrimination that is systematically protected by political institutions, reaching levels of hate crimes that would never be admissible in relation to gender, race, disability or sexual orientation. Religiously motivated hate crimes against Catholicism have become the norm, legitimising affronts towards a religion that is caricatured as colonialist and followers who are labelled as privileged exploiters, all of this being the product of a self-interested confusion between the phenomenon of secularisation and that of secularism. Thus, from the legal-political premise of the secularity of the State, any manifestation of a Catholic believer who, with absolute respect for democratic values, proposes his or her principles as propositional values for society and public life, is demonised as fundamentalist; An attitude that, for the sake of social peace and as a manifestation of a secularism that has become an ideology that seeks to eradicate from the public sphere any link to God in human lives and their structures, is paradoxically tolerated in relation to objectively fundamentalist religions or in relation to positions that are viscerally hostile to religion. We consider that this treatment is applied to Catholicism in order to silence its moral influence, since, in addition to being a fundamental agent in the historical process of institutionalisation of temporal power, it constitutes a bulwark against any abuse of political meddling in people's lives. In short, in order to establish the State's single way of thinking, the aim would be to delegitimise the Church's evangelical message in its denunciation of any kind of state interventionism, dependence and control that violates the full development of freedom and human dignity. ; peerReviewed
In this paper we intend to present some medieval foundations, especially Franciscan, of the revitalized civic republicanism of the 20th century. There is an unjustified leap from Rome to the Renaissance that has its origin in the forgetfulness and simplistic view that Hanna Arendt has of medieval thought and Aristotelianism, caused by the historiographic criteria of her time. For this we will show some characteristics of the thought of this new republicanism in order to present the central ideas of four Franciscan authors: Francesc Eiximenis, Bonaventure, Duns Scotus and Alfonso de Castro. First we will try to show the continuity that exists between the Middle Ages and the Modern Age. With this historical approach we intend to analyze that the legitimate aspiration of this new republicanism is distorted and limited if it leaves aside medieval contributions that help to understand more fully the republican pretension the republican pretension that, without rejecting the autonomy of the individual or the sense of community, highlights the interactive nature of social life and instigates him to persevere in the pursuit of the common good. ; En el presente artículo pretendemos presentar algunas bases medievales, especialmente franciscanas, del revitalizado republicanismo cívico del siglo XX. Existe un salto injustificado de Roma al Renacimiento que tiene su origen en el olvido y la mirada simplista que Hanna Arendt tiene del pensamiento medieval y del aristotelismo, provocado por los criterios historiográficos de su época. Para ello mostraremos algunas características del pensamiento de este nuevo republicanismo para poder presentar así algunas ideas centrales de cuatro autores franciscanos: Francesc Eiximenis, Buenaventura, Duns Escoto y Alfonso de Castro. Antes intentaremos mostrar la continuidad existente entre Edad Media y Moderna. Con esta aproximación histórica pretendemos analizar que la legítima aspiración de este nuevo republicanismo queda desvirtuado y limitado si deja de lado aportaciones medievales que ayudan a entender más cabalmente la pretensión republicana que, sin rechazar la autonomía del individuo ni el sentido de comunidad, destaca la naturaleza interactiva de la vida social y le instiga a perseverar en la búsqueda del bien común.

Se estudian las nociones de 'uso', 'dominio' y 'propiedad' en el pensamiento franciscano por dos motivos. Por un lado, la Escuela de Salamanca, que en cierto modo actúa de síntesis y proyección de las tesis clásicas y medievales y las conecta con el pensamiento moderno, aporta una interesante respuesta en torno al dominio para responder a lo que denominaremos "cuestión franciscana", así se ve especialmente claro en Domingo de Soto y los autores de dicha Escuela que siguen principalmente su pensamiento. Por otro lado, la particular visión de los autores franciscanos sobre la libertad, el valor de la riqueza y la pobreza para la vida humana y su fin trascendente, y las polémicas políticas en que se vieron involucrados en el siglo XIV, fue significativo para el desarrollo de varias tesis políticas que prepararán las ideas modernas sobre los derechos humanos. ; The notions of 'use', 'dominion' and 'property' are studied in Franciscan thought for two reasons. First, the School of Salamanca (which, in a certain way, acts as a synthesis and projection of the classical and medieval thesis and connects them with modern thought), contributes an interesting answer regarding the dominion to answer the "Franciscan question". So it is especially clear in Domingo de Soto and the authors of that School that mainly follow his thought. Second, the Franciscan authors' particular vision of freedom, the value of wealth and poverty for human life and its transcendent end, and the political polemics in which they were involved in the fourteenth century, was significant for the Development of several political theses that will prepare modern ideas on human rights. ; peerReviewed
