From the perspective of the so-called 'political constitutionalism' serious objections have been raised regarding the activity (and the very existence) of a constitutional jurisdiction, that might exercise an undue influence on the functions assignedto other State powers. The present article examines some of the challenges of facing the Spanish Constitutional Court, due to the initiatives on the part of other political actors. ; Desde lo que se ha llamado «constitucionalismo político» se han formulado serias objeciones a la actuación (y la misma existencia) de una jurisdicción constitucional, por cuanto pudiera suponer una indebida influencia judicial en el ejercicio de funciones correspondientes a otros poderes del Estado. El presente artículo trata de exponer algunos de los retos de este tipo con que ha debido enfrentarse el Tribunal Constitucional español debido a la iniciativa de otros actores políticos.

Los repetidos y frecuentes retrasos en la designación parlamentaria de los miembros de órganos constitucionales representan un serio problema para el sistema político español, particularmente respecto de aquellos órganos relevantes en el ámbito de la Justicia, como son el Tribunal Constitucional, el Tribunal de Cuentas y el Consejo General del Poder Judicial. Tales dilaciones pueden provocar no sólo disfunciones en la labor de esos órganos, sino también graves peligros para la imparcialidad e independencia judicial. En el presente artículo, tras una breve descripción del alcance de esas dilaciones, se analizan algunas propuestas de reforma efectuadas, incluyendo la supresión de prórrogas del mandato de los designados, la propuesta de candidatos por entidades fuera del Parlamento y la alteración del cómputo del mandato de los elegidos. Analizando varios ejemplos de dilaciones, se efectúan algunas propuestas de reforma del proceso parlamentario de designación, mediante el establecimiento formal de plazos rígidos para la presentación de candidaturas y su votación por las Cámaras.
El progresivo desarrollo de dos sistemas de protección internacional de derechos humanos en Europa, a partir del Convenio Europeo de Derechos Humanos de y de la Carta de Derechos Fundamentales de la Unión Europea, hace necesaria una coordinación entre ellos, y particularmente entre los órganos jurisdiccionales en la cima de cada sistema, es decir, los Tribunales de Estrasburgo y Luxemburgo. En el presente artículo se mantiene que, pese a la ausencia de mecanismos formales de coordinación, debido a la no adhesión, hasta el momento, de la Unión Europea al Convenio, esa coordinación se está produciendo mediante una concordancia práctica entre la jurisprudencia de ambos tribunales, que, en un proceso de diálogo formal e informal, van delimitando sus respectivos ámbitos de jurisdicción.The progressive development of two systems of international protection of Human Rights in Europe, one derived from the European Convention on Human Rights and the other from the Charter of Fundamental Rights of the European Union, requires coordination, particularly between the two main jurisdictional bodies of those systems, the Strasbourg and Luxembourg Courts. This article asserts that in spite of the lack of formal mechanisms of coordination due to the EU's non-accession (for the time being) to the Convention, coordination is nevertheless achieved through a practical concordance between the case law of both courts, which in a process of both formal and informal dialogue is defining the scope of the two Courts' respective jurisdictions.

Una de las peculiaridades de la Constitución española es que se pronuncia explícitamente en favor de un modelo económico determinado, el de la economía de mercado. Sin embargo, estas afirmaciones hay que entenderlas como una garantía institucional, ya que en la misma Constitución no se ha querido traducir esa garantía global (es decir del sistema como un todo), en una garantía de situaciones particulares hacia los intereses individuales. Parece que la polémica sobre el «modelo económico» y su campo real de acción en el marco constitucional generó polémica que se agudizó a raíz de la transición política española, y que está volviendo ya a cauces más sosegados. ; One of the peculiarities of the Spanish Constitution is that it is pronounced explicitly in favor of a particular economic model, the market economy. However, these claims must be understood as an institutional guarantee, since the Constitution itself has not wanted to translate this global guarantee (the system as a whole), as a guarantee of particular situations, to individual interests. It seems that the controversy over the "economic model" and its real scope was interesting. This was exacerbated following the Spanish political transition, and is already returning to calmer channels.

Se presenta un análisis de la participación electoral en diferentes provincias españolas (basado en el voto registrado y los datos censales) en varios referendos y elecciones en los años 1947, 1966, 1967, 1971 y 1976, destacando las diferencias porcentuales en abstención electoral entre diversas áreas. Diferentes mapas resaltan el abstencionismo por provincia en las elecciones 1976 y 1977. Destacan los siguientes patrones: (1) los disidentes expresaron su abstencionismo en 1976, concentrándose en Madrid, Barcelona y País Vasco. (2) Se distingue un abstencionismo por apatía en el noroeste de la península - Galicia, León, Oviedo e Islas Canarias (siendo Tenerife donde se acusa en mayor medida esta tendencia). (3) Destaca la manipulación del voto y la abstención en la España predemocrática en Extremadura y en la costa andaluza. Se concluye que los patrones mencionados de comportamiento electoral confirman la existencia de subsistemas políticos regionales. El estudio de la estructura socioeconómica de estos subsistemas merece ser profundizado
The mandate of Luis López Guerra as a judge at the European Court of Human Rights is coming to an end. On the occasion of his departure, his colleagues and friends wish to pay tribute to the exceptional work he has accomplished during his ten-year tenure at the Court. In his duties, he distinguished himself in the dissemination of the fundamental rights and freedoms protected by the Convention and he was acknowledged for his humanist approach to European litigation.
