AbstractThis article analyzes the impact competition agencies have on the orchestrating role of states in domestic private regulation. I argue that these agencies can significantly affect interactions in the governance triangle through the way they apply a "logic of the market" to evaluate agreements between firms. The regulatory framework of European Union competition law has increasingly constrained the ability of firms to take into account broader interests when making agreements to foster social objectives. This logic of the market clashes with the ever‐increasing emphasis governments place on enabling firms to enter into such agreements. I analyze this tension through a case study of a pact of Dutch retailers to collectively introduce higher animal welfare standards for poultry. Using regulatory network analysis I trace the governance interactions between the governance triangle on the one hand (government, non‐governmental organizations, and firms), and the Dutch competition authority, Autoriteit Consument en Markt (ACM) and the European Commission on the other hand. Attempts by the Dutch government to instruct the ACM to be more lenient toward private regulation were blocked twice by the European Commission. As a result, the Dutch government abandoned private regulation as the preferred mode and proposed a bottom‐up process that would generate public regulation as a way to avoid conflict with competition policy. I argue that paradoxically enough the intervention of these non‐majoritarian competition agencies against the "will" of the governance triangle has potentially increased the effectiveness and legitimacy of orchestration processes.

This article analyzes the relationship between social capital and neighborhood-oriented forms of participation within the context of an innovative Dutch neighborhood improvement program. On the basis of a survey among 307 residents, the author studies the link between three dimensions of social capital (neighborliness, trust in neighbors, and sense of duty) and three neighborhood oriented forms of participation: informal governance, the conversion of specific neighborhood problems into action, and participation in the program. Neighborliness and a sense of duty are positively related to the various forms of participation, whereas the impact of trust is somewhat more ambiguous. A subsequent analysis of the residents' proposals shows that although some of them explicitly refer to the importance of social capital, the bulk of their plans simply demand resources (money, personnel, or policies) to address concrete issues. The author concludes that social capital is an important facilitator of people's capacity to prevent and solve such problems themselves but that at the same time a whole range of problems still needs to be addressed through direct governmental action.

This article is concerned with the description and explanation of political activities of local non-profit organisations on the basis of an empirical study in the city of Zwolle, the Netherlands. Attention is devoted to (1) the political participation of these organisations (2) the access of these organisations to the political system (3) the relation between participation and access. Two factors turn out to have a significant positive effect on the participation of organisations: centrality in the local organisational network and being involved in executing local policies. Furthermore, results show the local political system to be reasonably accessible: there is a strong correlation between political participation and access; in addition participation is the most important determinant of access.

This textbook introduces undergraduate and graduate students to the politics of the European Union using a comparative politics approach. This enables students to utilize their knowledge of domestic politics in understanding the EU and better grasp the specific character of its politics.

This report evaluates the current regulatory regime for health claims in the EU on the basis of a case study of the marketing of Optimel Control, a yoghurt drink which was marketed in several EU member states as a functional food aimed at suppressing appetite and maintaining weight control. Our case study of the marketing of Optimel Control in the Netherlands reveals that the use of non-textual marketing claims was much more important than the use of textual health claims. Because the current EU regulatory regime emphasizes the evaluation of the wording of health claims, but lacks an evaluation of non-textual claims we conclude that there is a regulatory void that producers can use to market their products in ways that suggest more health effects than scientifi cally warranted. As a result the protective effect of the current EU regulatory regime on health claims is less strong than what legislators may have intended. While it might seem most logical to simply expand EFSA's remit by also letting it look at non-textual claims, we argue that a better solution to close this gap is through a stricter monitoring of unfair commercial practices at national level.
