Este trabajo trata de caracterizar en qué consiste el correcto desempeño de la actividad administrativa; dicho de otro modo: cuáles son las exigencias del principio de responsabilidad en el ámbito de la Administración Pública. Para ello, se presenta una caracterización de las peculiaridades de los deberes vinculados al desempeño de responsabilidades. A continuación, se analizan algunos de los «vicios» más comunes de la Administración, conectándolos con los diversos tipos de incumplimientos de las responsabilidades: la corrupción, el formalismo, la desidia y la incompetencia. Dado que las causas de estos incumplimientos son distintas, el trabajo remarca que también deberán serlo las estrategias adecuadas para luchar contra ellos.
Should the prohibition on the imperative mandate be removed from our current constitutional legal systems (which would not only imply repealing the constitutional provisions in which it is contemplated, but change the own understanding of representative democracy)? The arguments that are argued today in favor of establishing the institution of the imperative mandate have to do, fundamentally, with the safeguarding of the intermediation role that political parties play in the current representative democracies and the challenges that phenomena such as floor crossing or populism represent for this role. Despite this, this article firmly defends the need to continue excluding the imperative mandate from our representative political practices. To successfully tackle any of the problems that affect our democracies, it is necessary to start from a correct understanding of what constitutes the good performance of representative activity in general, and of political representation in particular. This contribution, therefore, addresses this question in some detail. In the author's opinion, the activity of representation consists of acting in defense of the interests of those who are represented. This activity cannot be reduced, in any field, to mere obedience to the will of those represented, and much less in the sphere of political representation, one of whose presuppositions is precisely the idea that the national will is not something that pre-exists representative activity itself. It is the representatives themselves who must shape this «national will», for which it seems necessary that they can deliberate and negotiate freely among themselves to be able to reach agreements. Este trabajo pretende defender una concepción constructivista o dependiente de valores de la interpretación jurídica y mostrar su superioridad frente a concepciones rivales. La interpretación jurídica es una actividad que implica la participación en la práctica del Derecho y se encuentra por tanto comprometida con los fines y valores que dotan de sentido a la práctica o, dicho de otro modo, con la mejora de la misma. En este sentido, el trabajo sostiene que para contestar a la pregunta sobre cómo debe interpretarse el Derecho debemos plantearnos previamente qué es lo que hace que el Derecho sea valioso; la evaluación de una determinada interpretación como mejor o peor que otras interpretaciones posibles dependerá precisamente de cómo aquélla contribuya a maximizar esos principios que hacen que consideremos valioso el Derecho. De este modo, la argumentación jurídica en el ámbito interpretativo tiene un componente moral y político, aunque ello no tiene por qué implicar desconocer sus peculiaridades, en especial, la relevancia de los elementos autoritativos. ; This work aims at articulating a constructivist or value-dependent conception of legal interpretation and at arguing in defence of its superiority against rival conceptions. Legal interpretation is an activity that implies participating in legal praxis. Thus, it is committed to those ends and values which give meaning to it, or in other words, it is committed to improve such praxis. Accordingly, to answer the question of how to interpret law, we must first answer the question of what makes law valuable. To assess whether certain interpretation is better or worse than other alternative ones depends precisely on how it contributes to maximizing those principles making us consider law valuable. Legal argumentation for the purposes of legal interpretation has necessarily a moral and a political component; nonetheless, this does not imply disregarding the peculiarities of legal argumentation, particularly the relevance of authoritative elements. ; Este trabajo ha contado con el apoyo del Ministerio de Economía y Competitividad a través del proyecto de investigación DER2017-86643-P.
Este artículo reflexiona sobre el papel desempeñado por el Tribunal Constitucional español en los 40 años de democracia de este país. Para ello se presenta el diseño institucional que de este órgano hizo la Constitución de 1978 y las distintas funciones que le fueron encomendadas, tanto por la Constitución como por la legislación posterior. El artículo analiza críticamente cómo se han desempeñado en la práctica estas funciones, señalando los distintos desafíos que se le han planteado a este órgano, así como las respuestas del ordenamiento jurídico ante los mismos. El artículo finaliza con una evaluación de la situación del Tribunal Constitucional en la actualidad. ; This paper deals with the role played by the Spanish Constitutional Court in the 40 years of democracy in this country. Thus, the article presents the institutional design drawn by the Spanish Constitution of 1978 and the different functions that were entrusted to it, both by the Constitution and by subsequent legislation. The article intends to analyze how these functions have been carried out in practice, pointing out the different challenges that have been presented to this Court, as well as the answers given by the legal system to them. La relatora sintetiza las veinte ponencias presentadas respecto del tema, agrupándolas en cinco ejes temáticos: delimitación conceptual del activismo judicial, explicación del fenómeno, valoración de la judicialización política, análisis de nuevos fenómenos vinculados, y ejemplos propuestos; finalmente, se proponen problemas para el debate en la asamblea. ; The rapporteur synthetizes the twenty presented papers on the topic, grouping them in five main themes: conceptual delimitation of judicial activism, explanation of the phenomenon, politic judicialization assessment, analysis about new related phenomena, and some proposed examples; finally, presents some problems for the debate in the assembly.

Tras distinguir entre la representatividad, la representación simbólica y la representación práctica, el trabajo se centra en este último supuesto (que englobaría los casos en los que el representante «actúa por» el representado). Atendiendo al tipo de sujeto que puede ser representado, se presentan tres tipos distintos de representación práctica que pueden encontrarse en el Derecho: la representación individual, la institucional y la colectiva. El modo de generar la relación representativa puede ser muy distinto, pero la existencia de dicha relación implicará siempre tanto un aspecto constitutivo (la atribución de los actos del representante a la esfera jurídica del representado) como un aspecto regulativo (la obligación del representante de actuar en interés del representado). ; This paper works on the representation in Law.
