Various forms of representative group litigation have existed for decades in the special Labor and Market Courts, initiated by private organizations such as trade unions and the Consumer Ombudsman. A "true" class action, brought in a general court by a member of a group, or by an organization, or an administrative agency (e.g. the Consumer Ombudsman)—allowing claims both for injunctive relief and individual damages for group members—was introduced in Sweden by the Group Proceedings Act, which entered into force on January 1, 2003. This is an opt-in procedure.

Abstract: Alternative Dispute Resolution (ADR) aims to offer alternatives to ordinary civil litigation and has been labelled the 'third wave' of the access to justice movement. ADR has garnered widespread support as an easily accessible, flexible, fast and low-cost way for parties to resolve disputes, as well as a means of reducing judicial workload. In the following article, the author takes a highly critical stance and analyses the risk and downsides of ADR. After discussing the various functions of ordinary civil litigation and comparing them to the functions of ADR, the author summarizes the pros and cons of ADR. The author concludes that ADR may be seen as a surrogate for ordinary civil litigation that could impede its functions, rather than as an alternative. On the other hand, recent Swedish proposals for two new types of court-annexed ADR may, if properly implemented, become valuable complements to ordinary litigation. Résume: Les modes alternatifs de résolution des conflits (MARC) visent à offrir des alternatives au procès civil ordinaire et ont été reconnus comme annonçant la 'troisième vague' dumouvement d'accès à la justice. LesMARCsont rec¸us comme unmoyen de résolution des conflits facilement accessibles, flexibles, rapides et de faible cout pour les parties, de même que comme un moyen de diminution de la charge de travail des juges.Dans l'article qui suit, l'auteur prend une position très critique et analyse les risques et les inconvénients des MARC. Après avoir exposé les diverses fonctions du procès civil ordinaire et avoir comparé ces fonctions aux fonctions desMARC, l'auteur dresse une liste des pours et des contres vis-à-vis des MARC. L'auteur conclut que plutôt que de constituer une alternative au procès civil ordinaire, les MARC doivent être perc¸us comme un substitut contrariant et déformant le fonctionnement du procès civil ordinaire. D'autre part, de récentes propositions suédoises concernant deux nouveaux types de MARC peuvent, si elles sont proprement appliquées, constituer un complément valable à une procédure ordinaire. Zusammenfassung: Alternative Dispute Resolution (ADR) bezweckt, Alternativen zum gewöhnlichen Zivilverfahren zu bieten, und wurde als Vorbote einer 'dritten Welle' der Zugang zum Gericht Bewegung gekennzeichnet. ADR wird weitgehend als eine leicht zugängliche, flexible, schnelle und kostengünstige Methode, um Streitigkeiten zu schlichten, sowie als ein Mittel, die Arbeitsbelastung der Richter zu verringern, begrüßt. In diesem Beitrag bezieht der Autor eine höchst kritische Stellung und analysiert die Risiken sowie Nachteile von ADR. Nach einer Erörterung der verschiedenen Funktionen des ordentlichen Zivilverfahrens und einem Vergleich mit den Funktionen von ADR, stellt der Autor eine Liste mit den Vor- und Nachteilen von ADR auf. Der Autor konkludiert, dass ADR anstelle einer Alternative eher als Surrogat zur ordentlichen Zivilgerichtsbarkeit angesehen werden kann, das wahrscheinlich der ordentlichen Gerichtsbarkeit entgegenwirkt sowie ihr Funktionieren verzerrt. Andererseits könnten zwei vor Kurzem in Schweden vorgestellte Entwürfe von ADR-Verfahren, die durch das Gericht einberufen werden, eine wertvolle Ergänzung zur ordentlichen Gerichtsbarkeit bieten, wenn sie auch ordnungsgemäß umgesetzt werden.
The Storme Commission has published a proposal for a Directive on harmonisation of certain aspects of civil procedure. This initiative is to be welcomed as promoting discussion of the need for and problems of harmonisation, but provides no definitive solutions. The European Union probably has competence to legislate in this area, provided that the harmonisation measures adopted do in fact facilitate the development of the single market. The risk is that partial harmonisation will not achieve this objective but will instead lead to greater complexity because of the need to deal with the interaction between harmonised and non-harmonised rules. An analysis of the Storme Commission proposals demonstrates that they leave considerable uncertainty as to the remaining role of national laws, and that they would not gain universal acceptance because they would conflict with the approach adopted in some jurisdictions.
