In the establishment of the so-called 'citizenship income', the Italian legislator decided to limit the personal scope of application only to families where the applicant member is an Italian national, or an EU national (or family member) who is a beneficiary of the right of residence or permanent residence, or a third-country national who has obtained the long- term resident status; every applicant must reside in Italy for at least ten years (the last two of which must be consecutive); moreover, several third-country nationals have the obligation to submit appropriate certification issued by their country of origin in order to demonstrate that the economic requirements are fulfilled. This paper seeks to demonstrate that such higher criteria not only have direct or indirect (or both) discriminatory effects vis-à-vis International and EU law, especially in view of the relevant ECJ, ECtHR and Italian Constitutional Court case-law, but are also disproportionate in order to get an income as basic as the one at issue.

Secondo l'art. 80 TFUE, la politica di asilo dell'UE è governata dal principio di solidarietà e di equa ripartizione della responsabilità tra gli Stati membri, anche sul piano finanziario. Tuttavia, le Istituzioni europee e gli Stati membri non hanno sinora fatto granché per dare attuazione a quel principio in modo da andare incontro alle richieste degli Stati più esposti ai flussi migratori. Partendo dalla struttura dell'art. 80 TFUE e della persistente "tirchia" solidarietà europea, in questo lavoro ci si ripropone di dimostrare che le iniziative passate e presenti (come le quote di ricollocazione o la recente bozza di dichiarazione comune di intenti, fatta a Malta nel settembre 2019) sono destinate al fallimento, e che il processo di modifica del sistema Dublino difficilmente può condurre a maggiore solidarietà. Allora, forse sarebbe opportuno "ripensare" l'applicazione dell'art. 80 TFUE nel senso di creare un sistema di visti umanitari e/o di introdurre un sistema di "responsabilità comuni ma differenziate" che ponga l'onere della prima accoglienza sui Paesi di frontiera esterna (come oggi) ma che, al contempo, porti a una modifica della direttiva del 2003 sullo status dei cittadini di Paesi terzi che siano soggiornanti di lungo periodo nel senso di una riduzione sostanziale (o una completa rimozione) del periodo di tempo nel quale rifugiati e beneficiari di protezione sussidiaria non possono spostarsi verso altri Stati membri per più di tre mesi. ; According to Article 80 of the TFEU, EU asylum policy shall be governed by the principle of solidarity and fair sharing of responsibility, including its financial implications, between the Member States. Nevertheless, EU Institutions and Member States have so far done very little to give substance to this principle to the benefit of those MS more exposed to migratory flows. Starting from the legal structure of Article 80 and the persistent European "scrooge-like" solidarity proofs, this paper aims at demonstrating that past and present initiatives (i.e. relocation quotas and the recent Draft Malta Joint Declaration of Intent of September 2019) are intended not to be successful and the amendment process of the so-called "Dublin System" hardly could lead to more structural solidarity. Thus, maybe it is time to rethink the implementation of Article 80, either by setting-up of a EU humanitarian visa system and/or shifting into a "Common But Differentiated Responsibilities" system, placing the burden of the first reception on the frontline MS (as it is today) but amending the 2003 Long Term Resident Directive in order to substantially reduce (or completely remove) the period of time during which refugees and beneficiaries of subsidiarity protection are not allowed to move to other MS for more than three months.

The chapter aims at exploring the European Court of Justice (ECJ) case-law concerning the relationship between the Dublin system and the solidarity principle enshrined in Article 80 of the TFEU. Starting from a legal analysis of Article 80, attention is paid to some decisions (e.g. N.S., X. and X., A.S. and Jafari, the "relocation" case), in which the ECJ has followed a cautious approach. Notably, it held, on the one hand, that responsibility criteria of the Dublin system cannot be derogated for solidarity reasons (even by way of interpretation or in the case of massive inflows of asylum seekers); on the other hand, that solidarity has to be implemented in legislative acts in order to fully reach its goals, being understood that a breach of such acts by some "reluctant" Member States is, first of all, a violation of the principle of loyalty provided for in Article 4(3) TEU.

L'articolo esamina la comunicazione della Commissione europea del 27 settembre 2017 che, da un lato, tira le somme delle misure già introdotte e delle iniziative avviate ma non ancora portate a termine, e dall'altro traccia la rotta degli sviluppi futuri in materia di migrazione.

L'articolo esamina brevemente alcuni documenti pubblicati tra luglio e settembre 2018 dalla Commissione europea in materia di politica migratoria, concernenti in specie gli accordi regionali di sbarco, i centri controllati, la riforma dell'agenzia Frontex (Guardia di frontiera e costiera europea) e dell'agenzia EASO, nonché la proposta di modifica della direttiva sui rimpatri.

This contribution discusses some legal options aimed at protecting environmental migrants (EMs) within the EU, none of which however proves to be fully satisfactory mainly due to the lack of (at least) a European common legal definition. On the one hand, the legal framework for international protection according to the Qualification Directive has shown to be inadequate, insofar as neither refugee status nor subsidiary protection status are fit for purposes of EMs; also the Temporary Directive and the possibility of adopting temporary non-legislative measures according to Article 78(3) TFUE look like unsatisfactory. On the other hand, humanitarian provisions in the Visa Code, the Schengen Borders Code and the Return Directive are not viable legal instruments because they are non-mandatory for Member States. Furthermore, protection against removal orders according to relevant human rights law applicable in the EU is not a valid solution for all cases. Finally, it should be noted that reset- tlement programmes, humanitarian admission schemes, private sponsorships and protection within Regional Development and Protection Programmes might be use- ful only in specific cases. As a conclusion, we stress the need for a European ad hoc legal instrument dealing with every aspect of the protection of EMs.

L'articolo esamina i programmi di (sviluppo e) protezione regionale (PPR/PSPR) che l'UE ha avviato, dal 2005, con l'obiettivo di incrementare la capacità delle regioni d'origine e/o di transito dei rifugiati ai fini della loro migliore protezione. Premessi cenni alla dimensione esterna della politica europea di asilo, si analizzano i caratteri principali dei PPR per poi passare a quelli predisposti nel continente africano: il PPR "pilota" in Tanzania nella zona dei Grandi laghi e i due PPR nel Corno d'Africa e nel Nord Africa. A seguire si esaminano i nuovi PSPR, recentemente avviati, che tengono conto della necessità di migliorare anche lo sviluppo socioeconomico dei territori in cui vanno a operare. Infine, si svolgono alcune considerazioni sull'efficacia di tali programmi per rifugiati e richiedenti protezione africani.

Il contributo ha a oggetto la disciplina della strategia dell'Unione europea per la regione adriatica e ionica (EU Strategy for the Adriatic and Ionian Region o EUSAIR), una delle quattro strategie macroregionali sinora adottate dall'Unione europea quale espressione della più ampia politica di coesione economica, sociale e territoriale. Premessi cenni alla cooperazione territoriale europea e alle altre strategie macroregionali sinora adottate, il contributo esamina l'evoluzione storica e i caratteri generali dell'EUSAIR, i suoi pilastri e le risorse utilizzabili nonché il sistema di governance adottato.
