Issues related to electoral participation are extremely complex, not least because of the different approaches of researchers to the issue. The COVID-19 pandemic has contributed to specialists, lawyers, political scientists addressing the issue of electoral participation in the context of public health risks and the implementation of the principle of universality of elections.
In order to provide greater guarantee of the principle of universality, many countries are introducing additional forms of voting in elections other than voting at the polling station. Postal voting is one of the alternative voting methods that appears to be the most popular in terms of participation in elections. It exists in different forms in different countries. In Poland, in 2020, there were attempts to implement all-postal voting at first, and then – after the second elections were held – it was decided to use hybrid voting.
The aim of this article is to analyze the Polish experience with postal voting in 2020 in the context of the implementation of this tool during the pandemic.

In recent years national referenda have become popular instruments for making decisions on very problematic European issues (Grexit, Brexit, migration crisis). The Hungarian vote of 2016 on refugee quotas distribution seems to be one of them. Next to its importance in the Euopean context, the 2016 referendum was devoted to a very difficult and socially important problem. It is argued that this national referendum was a maneuver of Hungarian Prime Minister Victor Orban against the European Union, its solidarity and common interests. Having in mind that the migration crises should be treated as a joint challenge for the entire EU and all its member states should take a part of responsibility in seeking the proper solutions satisfying all MS – the main objective of this paper was to answer the question about the course and consequences of Hungarian referendum of 2016 for realization of the solidarity principle. The article aimed also at finding answers to the questions about the role of referendum on problematic/controversial issues in Hungary and about the factors impacting the voters decision.

Podejmowanie decyzji za pośrednictwem form demokracji bezpośredniej odegrało w Europie Środowej i Wschodniej istotną rolę – szczególnie w latach 89/90, bowiem wyznaczało kierunek dalszego rozwoju państw tamtej części kontynentu. Demokracji bezpośredniej – szczególnie w formie referendum – wzbudza coraz większe zainteresowanie przede wszystkim wśród polityków oraz uprawnionych do głosowania, co uzewnętrznia się m.in. w toczącej się debacie publicznej nad rolą partycypacji obywateli w procesach decyzyjnych, a także we wzroście liczby referendów ogólnokrajowych nie tylko w Europie, ale i na świecie. Stąd podjęcie badań nad instytucją referendum w państw wydaje się być przedsięwzięciem interesującym, ważnym, aktualnym, a przez to wartym naukowej eksploracji. Głównym zamierzeniem badawczym niniejszego tekstu jest odpowiedź na pytanie o rolę instytucji referendum ogólnokrajowego w praktyce politycznej państw Europy Środkowej i Wschodniej oraz o perspektywy wykorzystania tej formy sprawowania władzy w przyszłości. Największa uwaga poświęcona została referendom, które przeprowadzono po 1989 r. Na tej podstawie dokonano klasyfikacji na referenda: niepodległościowe, pogłębieniowe i akcesyjne.

Węgierskie referendum w sprawie relokacji narzuconych przez UE kwot uchodźców jest jednym z przykładów takich głosowań. Oprócz kontekstu europejskiego, węgierskie referendum poświęcone było bardzo trudnemu i społecznie ważnemu zagadnieniu. Argumentuje się także, że głosowanie to było manewrem węgierskiego premiera Victora Orbana przeciwko Unii Europejskiej, jej solidarności i wspólnym interesom. Pamiętając, że kryzysy migracyjne należy traktować jako wspólne wyzwanie dla całej UE, a wszystkie państwa członkowskie powinny wziąć na siebie odpowiedzialność za poszukiwanie właściwych rozwiązań satysfakcjonujących wszystkie państwa członkowskie – za główny cel niniejszego artykułu przyjęto udzielenie odpowiedzi na pytanie o rolę węgierskiego referendum z 2016 r. dla realizacji zasady solidarności w Europie. Rozważania prowadzone w artykule miały również na celu znalezienie odpowiedzi na pytania dotyczące roli referendum w problematycznych/kontrowersyjnych kwestiach na Węgrzech oraz czynników wpływających na decyzję wyborców.

Direct democracy – particularly referenda – is arousing increasing interest among politicians and the electorate, which is manifested in the ongoing public debate on the role of civil participation in decision-making processes, as well as in the increase in the number of national referenda held in Europe and worldwide. Hence, studies on referenda in Central and Eastern Europe seem to be a very interesting and academically important task worthy of further exploration. The main research aim of this paper is to answer the question of the role of nationwide referenda in the political practice of Central and Eastern European states, as well as the question of the future prospects for the use of referenda. More emphasis is placed on referenda conducted after 1989. On the basis of these research results, referenda are divided into three categories: independence referenda, so called "deepening" referenda and accession referenda.

An increasingly popular tendency can be observed in numerous states in Europe and globally, where modern forms of casting votes are implemented, including, first and foremost, electronic voting via the Internet or mobile telephones. In the opinion of ICT (Information and Communication Technologies) advocates modern civilization is facing an era of electronic democracy, which constitutes this new form of exercising power, based on information and communication tools. Estonia is a European leader in applying electronic voting for election procedures. The paper presents an analysis of Estonia's experience in the field of e-voting in the elections of 2005–2009.

Praktyka wykorzystania form demokracji bezpośredniej w państwach europejskich dowodzi, iż prócz licznych głosowań referendalnych w sprawach ogólnonarodowych, coraz bardziej popularnym przedmiotem debaty publicznej, a następnie głosowania stają się również kwestie o tematyce "unijnej". Wykorzystanie referendum ogólnonarodowego do decydowania w sprawach procesu integracji europejskiej nie jest zjawiskiem nowym, bowiem pierwsze głosowanie o tej tematyce miało miejsce już w 1972 r. Od tego czasu integracja europejska stała się przedmiotem 60 ogólnonarodowych referendów – zarówno w państwach członkowskich, w państwach kandydujących, jak i w państwach "trzecich", które związane są dziś z Unią Europejską różnego rodzaju umowami bilateralnymi. Większość doświadczeń związanych z wykorzystaniem referendów w sprawach "europejskich" jest – można rzec – pozytywnych, jednak część z nich przysporzyło państwom członkowskim i samej Unii wielu problemów. Jednym z ostatnich przykładów głosowań referendalnych, którego konsekwencje będą miały swój wyraz w przyszłym kształcie Unii Europejskiej, jest głosowanie z 23 czerwca 2016 r. sprawie członkostwa Wielkiej Brytanii w UE. Głównym celem niniejszego tekstu jest odpowiedź na pytanie o konsekwencje referendów w sprawie integracji (ze szczególnym uwzględnieniem głosowania brytyjskiego) dla przyszłego kształtu Unii Europejskiej.

Technologie komunikacyjne i informacyjne w znacznym stopniu wpływają na instytucje i procedury demokratyczne. Jednym z przykładów takiego wpływu ICT jest cisza wyborcza, która ma na celu umożliwić wyborcom spokojne i wolne agitacji politycznej warunki do podjęcia ostatecznej decyzji co do sposobu głosowania. Pomimo zakazu agitowania w czasie ciszy wyborczej wielu użytkowników Internetu prowadzi kampanię na rzecz konkretnych polityków czy ugrupowań politycznych, naruszając obowiązujące prawo. Głównym celem niniejszego tekstu jest odpowiedź na pytanie o sposoby naruszania ciszy wyborczej w Internecie oraz o zasadność funkcjonowania tego mechanizmu w dobie Internetu. Motywacjądo skoncentrowania się na tym problemie było m.in. pojawienie się dużej liczby raportów na temat łamania ciszy wyborczej w Internecie, a w konsekwencji pojawienie się wielu wątpliwości co do utrzymania tego mechanizmu w demokracji.

Głównym celem niniejszego tekstu jest odpowiedź na pytanie o sposoby naruszania ciszy wyborczej w Internecie oraz o zasadność funkcjonowania tego mechanizmu w dobie Internetu. Motywacjądo skoncentrowania się na tym problemie było m.in. pojawienie się dużej liczby raportów na temat łamania ciszy wyborczej w Internecie, a w konsekwencji pojawienie się wielu wątpliwości co do utrzymania tego mechanizmu w demokracji. ; Information and Communication Technologies impact the democratic institutions and procedures to a great extent. One of examples of mechanisms affected by the use of ICT is so called election silence. The idea of election silence to provide voters with a peaceful, free from political agitation, conditions to consider and make final decision on elections. Despite the ban on campaigning during the election silence, many Internet users campaign for politicians or political parties, violating the existing law. The main aim of this article is to answer the questions about the ways of breaking the pre-election silence and about sense of this mechanism in the Internet age. The motivation to focus on this topic was the appearance of both: a large number of media reports on political agitation in the Internet and doubts about the continuing sense of functioning of the election silence.

The practice of using direct democracy in the European Union's countries shows that 'European' issues have become an increasingly popular subject of public debate and then of referendum votes. The use of national referenda in deciding on European integration process is not a new phenomenon – the first referendum on this subject was held in 1972. Since then European integration has been the subject of sixty popular votes – in EU member states, candidate states and in third countries. It can be said that the majority of experience related to direct democracy in the EU is rather positive, but there have been some votes that have brought serious problems to the European Union. One such example is the British referendum of 2016 on further membership of the EU. This referendum provoked a huge debate on the future shape of the Community and the further directions of integration in Europe. Given the dynamic development of the new media, in particular the Internet, the social, economic and cultural fields of modern life are undergoing changes as well as many others. New technologies have also had an impact on political and civil activities. Direct democracy and its tools are subjects of changes resulting from development of new technologies. The consequence of ICT impact on direct democracy is appearing a notion "electronic (or digital) direct democracy". The electronic form of direct governance has ICT-based tools of exercising power that are or can be used by citizens as an instrument for co-participating in shaping political life and decisions. These considerations aim to answer the question of how the use of the Internet can influence modern democracy, in particular the direct form of governance. The author intends to answer the following research questions: how are the instruments of direct democracy, such as referenda, popular initiative and popular assembly (and, by this token, direct democracy) changing (or how they might change) following the application of the Internet or other ICTs? What opportunities and threats might ICTs employed in direct democracy bring for democracy, authorities and society?
