Prawo gospodarcze w trychotomicznym podziale prawa Wramszapu Samsonowicza Tadewosjana

In 1956, the Soviet legal science resumed discussion on the structure of the legal system, in particular — its division into branches. In the years 1938–1956, as a result of rejecting the concept of unified economic law, Soviet science did not use the category of "economic law" at all. The first scholar who in 1956 re-proposed the separation of economic law in the Soviet legal system was Vramshap Samsonovich Tadevosyan. His arguments for the separation of economic law referred to both practical (pragmatic) and theoretical reasons. On the one hand, Tadevosyan pointed out that the separation of economic law would contribute to improving the legal system of national economy management, which would be conducive to the implementation of the sixth five-year plan, adopted at the 20th Congress of the Communist Party of the Soviet Union in 1956. On the other hand, he emphasized that regulating the functioning of the national economy by the provisions of civil law — as has been the case so far — was unacceptable due to the incompatibility of relations within the national economy with the civil law paradigm. Tadevosyan saw economic law as one from among the three branches of the Soviet legal system — the other branches being state law and civil law.
Prawo gospodarczo-administracyjne w koncepcji "dwóch sektorów" Piotra Iwanowicza Stuczki

Koncepcja "dwóch sektorów" P.I. Stuczki, sformułowana na przełomie lat dwu-dziestych i trzydziestych ubiegłego stulecia, we współczesnej literaturze ujmowana jest powszechnie jako pierwsza teoretyczna koncepcja wyodrębniania prawa gospodarczego w nauce radzieckiej. W licznych opracowaniach odwołujących się do koncepcji "dwóch sektorów" prawo gospodarcze (a właściwie prawo gospodarczo-administracyjne) jest przedstawiane jako gałąź przeciwstawiana prawu cywilnemu — wskazuje się, że prawo gospodarczo-administracyjne obejmowało regulację socjalistycznego sektora gospodarki, podczas gdy prawo cywilne normowało funkcjonowanie sektora prywatnego. W rezultacie rywalizacji obu sektorów sektor socjalistyczny miał wyprzeć sektor prywatny, a w konsekwencji prawo gospodarczo-administracyjne miało zająć miejsce prawa cywil-nego. Przedstawiana w tym kształcie powierzchowna charakterystyka koncepcji "dwóch sektorów" nie daje jednak pełnego i właściwego obrazu prawa gospodarczego (gospodarczo-administracyjnego) w ujęciu P.I. Stuczki. W artykule zostało dowiedzione, że P.I. Stuczka postrzegał prawo gospodarczo-administracyjne w aspekcie dynamicznym — jako pożądany kierunek przyszłego rozwoju regulacji normujących funkcjonowanie socjalistycznego sektora gospodarki, wobec czego prawo gospodarczo-administracyjne nie było przez niego uznawane za gałąź równorzędną prawu cywilnemu. Prawo gospodarczo-administracyjne było rozumiane przez P.I. Stuczkę jako teoretyczna koncepcja modelowego obrazu pewnego zbioru unormowań, której przyszłe odzwierciedlenie w sferze prawa pozytywnego P.I. Stuczka uznawał za pożądane i celowe. Odzwierciedlenie to powinno przybrać postać kodeksu gospodarczo-administracyjnego, który zawierałby normy całościowo regulujące funkcjonowanie socjalistycznego sektora gospodarki radzieckiej. Koncepcja prawa gospodarczo-administracyjnego nie była opisem obowiązujących ówcześnie regulacji prawnych — jakkolwiek P.I. Stuczka zwracał uwagę na wyodrębnienie się w systemie prawa grupy "norm gospodarczo-administracyjnych", normy te de lege lata nie formowały samodzielnej gałęzi prawa. Koncepcji prawa gospodarczo-administracyjnego należy zatem przypisać charakter postulatywny, nie zaś deskryptywny.W artykule wskazano również, że wyróżnienie prawa gospodarczo-administracyjnego ukształ-towało się na gruncie krytycznego postrzegania przez P.I. Stuczkę szerokiego zakresu regulacji i stosowania kodeksu cywilnego Rosyjskiej Federacyjnej Socjalistycznej Republiki Radzieckiej przyjętego w 1922 roku. Zamysł kodeksu cywilnego jako aktu prawnego całościowo regulującego ogół stosunków majątkowych i gospodarczych był zdaniem P.I. Stuczki nieakceptowalny w państwie socjalistycznym i nie odpowiadał realiom funkcjonowania społeczeństwa oraz gospodarki radzieckiej. Sferą regulacji prawnej, której objęcie oddziaływaniem kodeksu cywilnego przedstawiało się dla P.I. Stuczki jako szczególnie wątpliwe, było funkcjonowanie socjalistycznego sektora gospodarki, to jest stosunków między tworzącymi ten sektor przedsiębiorstwami państwowymi. Mając na względzie zasadnicze różnice w materii stosunków kształtujących się w sektorze socjalistycznym (bazujących na planowości) i sektorze prywatnym (bazujących na anarchii), P.I. Stuczka wskazywał, że różnice te powinny znajdować odzwierciedlenie także w formie prawnej regulacji funkcjonowania obu sektorów. Dla regulacji funkcjonowania zorganizowanego (ustrukturyzowanego) sektora socjalistycznego nieadekwatne były regulacje cywilnoprawne, oparte na paradygmacie stosunków między podmiotami samodzielnymi i autonomicznymi, przybierających charakter horyzontalny. Prawo normujące sektor socjalistyczny winno mieć charakter prawa gospodarczo-administracyjnego, którego administracyjne znamię odnosiłoby się do aktywnej roli organów państwowych w dziedzinie zarządzania socjalistycznym sektorem gospodarki.

PRIVATE ADMINISTRATIVE LAW. THE PROPOSAL OF A NEWDistinction of the set of norms called ,,private administrative law" is conditioned by the recognition that the theorem on the public-law affiliation of administrative law is of typological relevance, not of classification relevance — in every branch of law also in administrative law it is possible to distinguish, in various proportions, norms of public and private law. The norms of private administrative law set the legal framework for public administration to use forms of activity that traditionally belong to private law in a way that prevents "escape to private law", fusing private-law forms of activity and public-law protective measures. Public procurement law is presented as a model area of legal regulation within the scope of private administrative law.

CONTEMPORARY REMINISCENCES OF THE ABSOLUTIST MODEL OF ADMINISTRATIVE POLICE The absolutist model of administrative police, perceived as a sphere of the activity of public authority, is based on two pillars. The material pillar concerns the purpose of police activity, which is to achieve overall prosperity including the prosperity individuals, in the shape specified by the monarch. The formal pillar concentrates on ius politiae — the general authorization of the monarch to perform each forcible interference in the sphere of the rights of the subject, intended to achieve overall and individual prosperity. Contemporary institution of forced evacuation corresponds to the material pillar of the absolutist model of administrative police, as it allows public authority to evacuate an individual in case of threat for their life, even despite the opposition of the individual. The institution of order regulations seems to be a contemporary reminiscence of ius politiae. In the form of order regulations the organs of public administration, using a general competence, are entitled to establish legal norms, the content of which is not specified in the statute.
Implications of the monetary union convergence for the rate of economic growth in Poland
1) The negotiated terms of Poland's accession to the EU oblige us to accede to the EMU too. However, they do not predetermine the date of our EMU entry. In this paper, four most probable, in the author' opinion, scenarios of our accession to the EMU were presented. Scenario A assumes accession at the earliest possible date, i.e. in 2009-2010. Scenario B1 anticipates a somewhat later EMU membership, i.e. in 2012-2014 because of the inability to fulfil the Maastricht criteria before the end of the current decade. Under scenario B2, like under scenario B1, a more remote accession is assumed, this time however as a result of a deliberate decision of the Polish authorities on postponement of our EMU membership. Finally, scenario C defers our EMU accession into a not precisely defined future in consideration of a permanent inability of the Polish economy to meet the nominal convergence criteria. 2) The main objective of this paper was the attempt at identifying the impact of the above different EMU convergence scenarios on the long-term pace of economic growth in Poland. The main conclusions were formulated basing on two fundamental propositions. The first proposition says that the EMU membership will be advantageous to the long-term economic growth in Poland. Sharpening of the competition resulting from further intensification of the trade and capital flows will create conditions favourable to innovativeness and entrepreneurship. At the same time, the access to the resources of productive factors, especially to capital, will improve. However, the scale of advantages to be achieved and the probability of avoiding serious threats associated with the EMU membership will depend in the first place on the degree of real convergence of the Polish economy with the euro-zone, as well as on the direction of the future evolution of the whole EMU. With a favourable course of events, these long-term advantages to the economic growth can be in the order of 0.5 percentage points a year. The second proposition says that the period preceding the EMU entry (pre-accession period) will generate conditions not very advantageous to the economic growth. Along with the growth-oriented stimuli resulting from the improving economic climate and growing foreign capital inflow, there will also be some marked depressive effects. The latter will stem from the relatively restrictive fiscal and monetary policy imposed by the need of meeting the Maastricht criteria, as well as from the real (and, intermittently, also nominal) appreciation of the zloty. It is to be stressed that both the above propositions were formulated mainly basing on theoretical considerations, since the available empirical material remains very meagre and not always congruent with the Polish economic situation. 3) Our analysis has led to the conclusion that positively best conditions of the economic growth are assured by scenarios A and B2, with a slight preference for the former. However, implementation of these scenarios requires great resoluteness in carrying out the "second wave" of structural reforms as well as discipline in the macroeconomic policy (this, in particular, regards scenario A). In Poland's present political and social situation, this will undoubtedly be difficult. Therefore, unfortunately, it is the B1 scenario that is to be recognized as the most probable from among the scenarios under review, and even scenario C, being a scenario of economic disaster, can not be excluded. 4) On the assumption, however, of a favourable course of events, choice will remain between the scenarios A and B2: to accede to the EMU at the earliest possible date, or deliberately defer the accession by a few years. One of crucial decisions in this respect will have to be made already in 2.5-3.5 years, namely at the time when decision will be necessary whether to enter (or not) the ERM-2. Till that time, the optimum strategy should consist in positively declaring the intention of the possibly earliest EMU entry (and, above all, acting in accordance with such declarations), but without committing oneself by naming any firm dates. Whereas final decisions on the accession to the ERM-2, and later to the EMU, should be made in taking into consideration in the first line the following factors: * the already attained progress not only in the nominal but also in the real convergence, as well assessment of further progress in this respect; * assessment of the utility of maintaining the autonomous monetary and exchange rate policy; * evolution of the EMU itself; * strategy adopted by the remaining new EU members with respect to the question of their EMU accession.
