Los conflictos armados determinan a menudo la aparición del hambre como fenómeno simultáneo o posterior a los mismos. En este artículo, revisaremos los fundamentos jurídicos de la política humanitaria global por lo que atañe al hambre prestando especial atención a las situaciones conflictivas y a sus consecuencias. Examinaremos, en primer lugar, el derecho existente y, luego, recientes propuestas formuladas en proyectos y estudios de expertos, con miras a la redacción de instrumentos jurídicos o a la definition de una determinada política en materia de asistencia humanitaria internacional.

Armed conflict is often accompanied or followed by the outbreak of famine. The legal foundations of global humanitarian policy for dealing with famine are reviewed in this article, with special attention to conflict situations and their aftermath. The existing law is examined first, and then recent proposals in the form of drafts and expert studies which seek to develop legal instruments or policy relating to international humanitarian assistance are considered.

Une situation de famine survient bien souvent lors d'un conflit armé ou immédiatement à sa suite. Nous examinerons dans le présent article les bases juridiques de l'assistance humanitaire aux victimes de la famine, en accordant une attention particulière aux situations de conflit et à leurs retombées. Après avoir tout d'abord examiné le droit en vigueur, nous étudierons des propositions récentes qui, sous la forme de projets de textes ou d'études d'experts, visent à développer les instruments ou les principes juridiques relatifs à l'assistance internationale humanitaire.

La asistencia humanitaria en los conflictos armados y en caso de otros tipos de desastre pueden implicar a una gran variedad de instituciones y participantes que actúan simultáneamente, tales como organizaciones de defensa civil, unidades militares, Sociedades de la Cruz Roja y de la Media Luna Roja, organizaciones internacionales gubernamentales y organizaciones no gubernamentales (ONG). Por consiguiente, la coordinaciñn de la asistencia humanitaria es un asunto delicado y complejo, tanto más cuanto que el concepto de coordinaciñn, como el de preparatiñn para casos de desastre en general, incumbe tanto al donante como al beneficiario.

Il est des cas où l'assistance humanitaire dans les conflits armés et autres catastrophes concerne un large éventail d'institutions et d'agents opérant simultanément et comprenant les organisations de protection civile, les unités militaires, les Sociétés nationales de la Croix-Rouge et du Croissant-Rouge, les organisations internationales gouvernementales et non gouvernementales (ONG). C'est pourquoi l'assistance humanitaire constitue sans nul doute une question complexe et délicate, et ce d'autant plus que la notion de coordination, tout comme celle de la préparation à une situation de catastrophe concerne généralement à la fois les donateurs et les bénéficiaires.
