Abstract
The relationship between competition law and data protection law has been a highly controversial issue following the German Competition Authority's (Bundeskartellamt, hereinafter 'Competition Authority') decision with regard to Facebook's data processing policy. The Competition Authority's theory of harm was centered around an exploitative abuse of market power through the imposition of a data processing policy which is in conflict with the data protection rules. In the interim court proceedings, the OLG Düsseldorf criticized the Competition Authority's decision. The German Federal Supreme Court (Bundesgerichtshof, hereinafter 'Federal Supreme Court') upheld the Competition Authority's decision. However, the Federal Supreme Court did not derive the exploitative abuse primarily from a mere violation of data protection law. Instead, the Court referred to the users' lack of freedom of choice. The Court developed a modified theory of harm by identifying elements of an exploitative abuse but also of an exclusionary abuse. The Court's line of argument is more competition-oriented and accounts for the particular economic features of multi-sided markets. In this line of reasoning, an actual violation of the data protection rules is not a necessary prerequisite for finding a violation of competition law.

Abstract
Price parity clauses on digital platforms, such as hotel booking platforms, have been the subject of divergent decisions under Art. 101 TFEU by courts and competition authorities in many EU Member States. These decisions have revealed significant differences between and even within single Member States with regard to the dogmatic treatment of price parity clauses, the factual assessment and the legal outcome. Some countries have even introduced special legislation with regard to price parity clauses. The Swedish Patent and Market Court of Appeals in May 2019 declared narrow price parity clauses to be consistent with Art. 101 TFEU. Only a few weeks later the German Düsseldorf Court of Appeals (Oberlandesgericht, OLG) overturned a decision by the German Competition Authority (Bundeskartellamt) and also held that narrow price parity clauses are valid. This case is on appeal to the German Supreme Court (Bundesgerichtshof). However, the judgments by the two courts of appeals are at odds with regard to their dogmatic approach to Art. 101 TFEU and to the factual findings. Against this background, the Swedish court of appeals' judgment casts light on several aspects that might be of relevance for similar cases in other jurisdictions or that require clarification by a referral to the ECJ or by the lawmakers.

Die Einführung echter Informationspflichten durch die Umsetzung der UGP-Richtlinie etabliert im UWG verbraucherschützendes Marktverhaltensrecht auf Grundlage des Informationsmodells. Neben dem traditionellen lauterkeitsrechtlichen Wahrheitsgebot wird damit als dogmatischer Paradigmenwechsel ein europäisch vereinheitlichtes Transparenzgebot geschaffen. Dieses sieht für Unternehmen eine Pflicht zur vollständigen Information der Verbraucher gemäß bestimmter Informationsvorgaben vor. Der beabsichtigten verbraucherschützenden Wirkung stehen dabei eine erhöhte Informationslast für Unternehmen sowie die Gefahr einer Überinformation der Verbraucher gegenüber. Neben der Europäisierung erfolgt jedoch zugleich eine Denationalisierung des Informationsmodells. In Bezug auf rein nationale Informationspflichten sowie in Bezug auf Informationspflichten, die eine überschießende Umsetzung europäischer Vorgaben darstellen, wird im Anwendungsbereich der UGP-Richtlinie eine lauterkeitsrechtliche Sanktionierung ausgeschlossen. / »Denationalisation and Europeanisation in the information model of unfair competition law« -- In response to the European Directive concerning unfair business-to-consumer commercial prac-tices broad duties of information have been established in German unfair competition law. The duty of enterprises to provide transparent information to customers according to certain criteria goes beyond the traditional duty to merely avoid a deception of customers. This Europeanisation of the information model is accompanied by a denationalisation. Within the scope of the Directive Member States have to abstain from applying their unfair competition laws with regard to infor-mation duties which are not rooted in European law
