Starting from an analysis of the Italian model of church-state relationships, the present paper focuses on the status of atheistic convictions in Italy. Since the 1990s, where the Union of Atheist and Rationalist Agnostics claimed its right to start negotiations to enter into an agreement with the State, Italian courts have faced the crucial issue of the legal definition of a religious denomination. The decision of the Constitutional Court no. 52/2016 has been the final result of a lengthy and troubled process. The paper will explore the coherence of the decision with the Italian Constitutional framework, with the ECHR and with article 17 of the Treaty on the Functioning of the European Union (TFEU). Finally, the paper will investigate on the option of enforcing an updated law regulating religious freedom and its predictable impact on non-religious communities.

Jako swego rodzaju przełom wybuch COVID-19 w 2020 r. głęboko zmienił nasze zwykłe wyobrażenie o życiu społecznym. Taki bezprecedensowy stan zagrożenia zdrowia stanowi również poważne wyzwanie w zakresie podstawowych praw i wolności, będąc testem radzenia sobie w skrajnych warunkach dla nowoczesnych konstytucyjnych systemów pluralistycznych. Ożywił obawy dotyczące "wyjątkowej" roli religii w postsekularnych społeczeństwach demokratycznych, ze szczególnym uwzględnieniem wolności religijnej. Celem tego artykułu jest zbadanie, poprzez analizę porównawczą, implikacji ery pandemii jako okazji do refleksji nad potrzebą ponownego przyjrzenia się roli organizacji religijnych w ramach sieci aktorów społecznych. Artykuł pokazuje, że współpraca między aktorami politycznymi i wspólnotami wyznaniowymi może przyczynić się do wdrożenia nowych sposobów wspólnego życia, w których wszyscy aktorzy społeczni promują wspólne zaangażowanie na rzecz wspólnych celów z myślą o budowaniu bardziej zrównoważonej przyszłości.

L'intersezione fra immigrazione, cittadinanza e integrazione sta divenendo un tema cruciale per gli studiosi di diritto ecclesiastico, enfatizzando l'emersione di nuove domande di accomodamento religioso nelle società ospitanti, e l'esigenza di articolare nell'ambito di sistemi improntati ai valori della democrazia e del pluralismo nuove strategie di gestione di istanze di carattere religioso-culturale-identitario. Lo spazio transnazionale diviene luogo di produzione di nuovi significati, di fenomeni di negoziazione di identità, di interazione di attori e pratiche religiose, e va verificato l'impatto che l'integrazione/partecipazione nelle società ospitanti ha sicuramente sulla identità dei migranti, e il ruolo giocato dal fattore religioso (nella sua componente individuale e collettiva) nei processi di integrazione.In questo quadro, peculiare peso assume pure l'intersezione fra religione e genere, e la verifica se tale controverso rapporto costituisca fattore di rafforzamento o indebolimento dei soggetti vulnerabili nell'ambito delle società ospitanti. Con una pronunzia di calibro innovativo, la Corte di Cassazione ha recentemente accolto una visione ampia della protezione internazionale, disposta ad accogliere una prospettiva gender-sensitive, riconoscendo il diritto a tale tutela nei confronti di coloro che subiscono forme di violenza connesse al genere, che potranno consequenzialmente accedere allo status di rifugiato e fruire della protezione sussidiaria

Questo contributo analizza la tensione fra laccomodamento delle pratiche religiose e gli stringenti interessi statali nel contesto degli istituti di detenzione negli USA. Nel 2000 il Congresso ha emanato il Religious Land and Instituzionalized Persons Act, che è indirizzato a garantire ampia protezione alla libertà religiosa. Lo standard giuridico più appropriato da applicare alle rivendicazioni di libertà religiosa dei detenuti rimane tuttavia fonte di dibattito incessante. Partendo dalle più recenti pronunzie della Corte Suprema USA il presente contributo esplora la transizione da un approccio deferenziale a un più rigoroso scrutinio giurisprudenziale, che potrebbe condurre a significativi cambiamenti nella giurisprudenza concernente la libertà religiosa nelle istituzioni penitenziarie.

The unrestrainable evolution of medical science and technology is drastically changing health-care, enabling new medical procedures and remedies, which are increasingly intertwined with moral principles. Although a uniform European approach on assisted suicide is lacking, a common trend is developing: the boundary between euthanasia, assisted suicide and end-of-life care and the frontiers of legitimate medicine are becoming increasingly blurred. In Italy, a ruling of the Constitutional Court, no. 242/2019, declared the partial unconstitutionality of article 580 of the Italian Criminal Code, which prohibited assistance in suicide. Specifically, article 580 excluded the criminal liability for the person who, in the manner provided for in Articles 1 and 2 of the law 22 December 2017, no. 219, "facilitates the execution of intention of suicide, autonomously and freely formed, of one person kept alive by life-sustaining treatments and suffering from an irreversible pathology, source of physical or psychological suffering that he/she deems intolerable, but fully capable of making free aware decisions, provided that such conditions and methods of execution have been verified by a public structure of the national health service, following the opinion of the territorially competent ethics committee." The present paper analyzes the legal regime of assisted suicide in Italy, the role of the rule of law, and the crucial boundary between the branches of government with regard to this delicate issue, and investigates current legal challenges and potential future legal tracks.
The analysis contained in this paper focuses on the issue of the meaning of religion in Irish case law. Moving from the articles of the Irish constitution, which regard three specific issues, controversial in the contemporary Irish society - abortion, primary school education and blasphemy - the analysis of some judgments, mainly enacted by the Supreme Court of Ireland, allow to enter in the fascinating and controversial path which judges undergo when they have to decide such delicate issues. Given the importance of Catholic religion in Ireland, my research was guided by a principal question: do judges have the capacity to broadly interpret the meaning of religion, or is Catholic religion still influential and able to condition the judgements concerning the above mentioned three issues? The interpretation of the meaning of religion depends on many variables, such as judges, political scenarios, personal beliefs and nationality of the people involved. So, the meaning of religion in Irish case law has certainly undergone a dynamic process moving from a strictly Catholic perspective to a more open and respectful one of different religious (and non-religious) values. What is religion? Is it moral? Is it philosophy? Is it politics?
