This article presents the analysis of implementation and interpretation of antitrust legislation in Russian courts, in the field of anti-competitive agreements cases. This article proceeds from the previous research which provided the analysis of the court decision database of litigations with the Russian competition authority (the FAS) initiated in 2008-2010. In this research (which covers court cases of 2011-2015) we provide the database of 646 court decisions and examine the tendencies of applying antitrust prohibitions and legislation in courts. We show how the database structure varies from the point of view of main markets and types of agreements, taking into account the standards of proof. The analysis reveals that the Rule of reason (ROR) approach was not actually applied in courts, despite legislative possibilities. Type 1 errors risks tends to decrease, especially in public procurement cases, cases of banks and insurance companies cooperation. Requirements in the field of market analysis in decisionmaking are also increasing.

This article analyzes the antitrust enforcement practice in Russia (2008–2010) in the area of competition restricting agreements (horizontal and vertical). The analysis is based on courts decisions database (litigations with the Russian competition authority - FAS). Database contains 242 cases, including 139 horizontal agreements, 103 vertical and mixed agreements. On the basis of this database we have analyzed important features of the interpretation and implementation of the competition law in Russian practice, priority areas of the enforcement. We considered the antitrust policy taking into account the risks of errors of 1 and 2 types, including the problem of the flexibility of prohibitions (PER SE vs RULE OF REASON), standards of proof, consistency of enforcement, etc.

В рамках антимонопольной политики могут применяться структурные или поведенческие меры для защиты конкуренции и общественного благосостояния. Вместе с тем эффективность таких мер зависит от характера влияния рыночной концентрации на конкуренцию. В экономической теории можно выделить как минимум два базовых подхода. Первый рассматривает высокую рыночную концентрацию как причину снижения конкуренции и общественного благосостояния (например, таких взглядов придерживались представители Гарвардской школы), второй подход допускает высокую концентрацию и как свидетельство интенсивной конкуренции, соответственно в таком случае не требуется государственного вмешательства. В статье для эмпирической проверки данных подходов был выбран рынок цемента России, проанализирован рост концентрации на рынках СФО и ДФО. Показано, что для таких рынков (с учетом их характеристик) более справедлив оказался Гарвардский подход, рост концентрации приводил к снижению интенсивности конкуренции. Вместе с тем антимонопольная политика регулятора (ФАС) активно использовала поведенческие меры, достаточно сложные для применения, но которые не препятствовали росту концентрации. Для такого рода рынков можно рекомендовать применение не поведенческих, но структурных мер для повышения эффективности антимонопольной политики.

By the end of the millennium the primary accumulation of capital had become more restrained. Easy money still was in the air, but its amount had decreased. The circle of industrial magnates had been formed and strengthened. A large-scale redistribution of assets that resembled the civil war horrors became more civilized. The decade at the turn of the millennium was a watershed. It brought big changes into economy, politics and people's way of life. We remember that decade as a period of subsiding fire, of pacific and relatively untroubled times. Лихие деньги носились в воздухе по-прежнему, но их количество убывало. Круг олигархов сложился и укрепил свои позиции. Переделы крупной собственности, мало отличимые от ужасов гражданской войны, приняли более цивилизованные формы. Десятилетие на стыке тысячелетий – во многом переломное. В экономике, в политике, в образе жизни это десятилетие принесло огромные перемены. И теперь оно, это десятилетие, вспоминается как период стихающего пожара, наступления мирных и относительно благополучных времен. Но и как время потерянных возможностей, возможно, потерянных уже навсегда.
