Abstract
Summary
This paper deals with the Singapore Convention on Mediation from United Nations General Assembly in December 2018 and signed in Singapore on 7 August 2019. Also with the European Union situation, given by the existence of the Directive 2008/52/EC of the European Parliament and of the Council of 21 May 2008 on certain aspects of mediation in civil and commercial matters. EU States haven't signed the Singapore Convention on Mediation. This paper is trying to analyse the two instruments, the Directive as a harmonisation instrument, maybe opening the field of the possible usage of the convention and not existing Regulation unifying the legal ground in the EU. The Singapore Convention on Mediation enters into force six months after deposit of the third instrument of ratification, acceptance, approval, or accession. EU is now in the position, where a decision about new Directive, or maybe the acceptance of the convention must be decided with accordance to all the dilemmas of the Singapore Convention.

Cílem článku je odpovědět na výzkumnou otázku, jak zapsaní mediátoři reflektují obecný a specifický výkon mediace v ČR. Přestože má výkon mediace svá kodifikovaná pravidla daná zákonem o mediaci, náš výzkum se nesoustředil jen na zákonnou úpravu, ale také na zkoumání praxe mediace v rámci úpravy tohoto zákona. Data byla získána empirickým kvalitativním výzkumem pomocí hloubkových rozhovorů se zapsanými mediátory. Článek se kromě úvodu a závěru skládá ze dvou částí. V první části popisujeme metodologii kvalitativního výzkumu. Zaměřujeme se v ní na výzkumnou otázku, cíl výzkumu a použitou metodu, dále seznamujeme s konstrukcí a strukturou vzorku případů a také s metodikou sběru a analýzy kvalitativních dat. Ve druhé části prezentujeme model zakotvené teorie výkonu mediace, který byl vytvořen na základě analýzy a interpretace dat.

Examination of a person who has been a victim of a physical or sexual assault may be very important for upcoming legal proceedings. In the context of a clinical forensic examination, physical findings are recorded and biological trace material is gathered and secured. Ideally, all forensic findings are documented in a detailed report combined with photographic documentation, which employs a forensic scale to depict the size of the injuries. However, the integrity of such forensic findings depends particularly on two factors. First, the examination needs to be conducted professionally to ensure that the findings are properly admissible as court evidence. Second, the examination should take place as soon as possible because the opportunity to successfully secure biological samples declines rapidly with time. Access to low-threshold clinical forensic examinations is not evenly provided in all member states of the European Union (EU); in some states, they are not available at all. As part of the JUSTeU! (Juridical standards for clinical forensic examinations of victims of violence in Europe) project, the Ludwig Boltzmann Institute for Clinical Forensic Imaging in Graz, Austria created (in cooperation with its international partner consortium) a questionnaire: the purpose was to collect information about support for victims of physical and/or sexual assault in obtaining a low-threshold clinical forensic examination in various countries of the EU. Our paper provides a summary of the responses and an overview of the current situation concerning provided clinical forensic services.
