EU Competition law has recently incurred main procedural reforms. Their basis must be found in Regulation 1/2003, decentralizing the control on the application of Articles 101 and 102 TFEU, thus emphasising the role of National Competition Authorities and Courts. This system has proved to be far from complete and perfect, as the first part of this article aims at demonstrating. A new political wave has enabled to strengthen the enforcement of EU Competition Law under two strands: the private and the public enforcement. Directive 2014/104 harmonises parts of the national (civil) procedural law regarding damages actions. Powers and duties of National Courts are its focus. Its main features are recalled within this contribution. The long-awaited Directive 2019/1 aims at further reinforcing the role of NCAs, establishing a very detailed piece of legislation, whose main elements are briefly examined here. Since the two acts have been adopted in a quite short period of time, their coordination is analysed too. This exam can lead us to offer some remarks on the perspective role of EU Competition Law, both from the Member States perspective and the needs for reform, and the new Commission's approach to the consistent application of the new legislation.

Il d.lgs. n. 28 del 16 Marzo 2015 ha introdotto nel sistema penale italiano l'istituto della "Esclusione della punibilità per particolare tenuità del fatto". L'introduzione di una causa di tenuità è finalizzata a esigenze deflazionistiche del carico giudiziario, in quanto consente di operare una selezione in concreto dei casi in cui è necessario irrogare una pena, contribuendo a ridurre, nelle ipotesi in cui ne ricorrano le condizioni, il già pesante carico delle autorità di giustizia. L'istituto in realtà non è una novità nel sistema penale italiano poiché già prima del 2015 esistevano due istituti che, sebbene in rapporto di specialità con l'art. 131 bis c.p., perseguivano finalità simili. Il riferimento è all'istituto della "Irrilevanza del fatto per particolare tenuità" nel sistema penale minorile (art. 27 d. P. R. N. 448 del 1988) e all'istituto della "Esclusione della procedibilità per particolare tenuità del fatto" nel sistema dinnanzi al giudice di pace (art. 34 d.lgs. n. 274 del 2000). La clausola di non punibilità per particolare tenuità del fatto ex art. 131 bis c.p. individua "criteri fattuali" utili per l'applicazione dell'istituto stesso e regola, mediante l'introduzione di ulteriori articoli nel codice di procedura penale, l'operatività dell'istituto nelle diverse fasi procedimentali. Il legislatore ha introdotto una "nuova ipotesi di archiviazione", affiancandola a quelle già esistenti nel processo penale, che consente al p.m. e al giudice delle fasi successive alle indagini preliminari, di poter archiviare il fatto non perché il reo non l'abbia commesso o non sia imputabile, ma perché il fatto in concreto risulta "particolarmente tenue". Tuttavia la troppo spesso portata riduttiva della norma pone diverse questioni dubbie, che molte volte non consentono di inserire l'istituto in un tessuto di regole processuali già esistenti. Il giudice è chiamato a valutare caso per caso ogni condotta criminosa, valutando se in concreto ci siano i presupposti per applicare l'istituto, non potendo infatti ancorare l'operatività dello stesso ad alcune fattispecie di reato in via preliminare. Le diverse posizioni assunte dagli studiosi della materia e della giurisprudenza portano la Suprema Corte a dover spesso intervenire, dettando dei principi generali e delle interpretazioni univoche a cui i giudici dovranno attenersi. L'istituto de quo sembra però essere, almeno ideologicamente, il passo giusto a cui ancorare il cambiamento necessario di cui il nostra sistema giudiziario ha bisogno. La riforma ha infatti voluto "ripensare" i modi di risposta punitiva conseguenti alla commissione del reato, prevedendo delle misure che non si preoccupino solo di punire il colpevole, aggiungendo un altro male ad un male già commesso, ma di intervenire sulle conseguenze concrete derivanti dal reato stesso, operando di fatto una "giustizia conciliativa e riparativa" anzi che repressiva. Una tale configurazione di giustizia non solo riduce il carico giudiziario ma permette allo Stato italiano di adeguarsi al resto dell'Europa.

IntroductionHIV‐1‐associated CD4+ T‐cell depletion is a consequence of uninfected cell death. Nef is one of the viral factors that trigger apoptosis on bystander cells, though the plasma Nef levels do not correlate with Th lymphocytes counts. The aim of our study was to evaluate whether anti‐Nef antibodies were involved in paediatric AIDS development and whether they can prevent the CD4+ T‐cell depletion in vertically infected children.MethodsTwo hundred and seventy three HIV‐1 vertically infected children seen at Garrahan Paediatric Hospital were randomly included in the study, adding 13 selected cases: seven LTNP (long‐term non‐progressors) and six RP (rapid progressors) children (ntotal=286). Specific anti‐HIV‐1‐Nef antibodies were titrated by indirect ELISA and compared between groups. The plasma blocking effect on Nef‐dependent cytotoxicity was evaluated in Jurkat cells using recombinant Nef as apoptotic stimulus and patient plasmas as blockers, measuring the apoptotic levels using Annexin‐V stain and flow cytometry.ResultsOnly 63.4% of the patients had specific anti‐Nef antibodies, and the levels of anti‐Nef antibodies found in the selected LTNPs plasmas were always significantly higher (p=1.55×10−4) than those in RPs or general HIV‐1+ paediatric populations. The LTNPs' plasma had a strong inhibitory effect on Nef‐dependent cytotoxicity even at high dilutions, while RP plasmas had little or no effect on Nef‐induced apoptosis.Discussion and conclusionsHigh anti‐Nef antibody levels are associated and predict slow or non‐progression to AIDS in vertically HIV‐1‐infected children. They could be an efficient tool in preventing Nef‐associated bystander effect, preserving CD4+ T‐cells and the immune function in the context of paediatric HIV‐1 infection.

The National Cancer Research Institute (NCRI) is a partnership of charity and government research funders whose purpose is to improve health and quality of life by accelerating progress in cancer-related research through collaboration. Under this umbrella, the NCRI Brain Tumor Clinical Studies Group is focused on improving clinical outcomes for adult patients with brain and central nervous system tumors, including those with brain metastasis from other primary sites. This document discusses the current state of clinical brain tumor research in the UK and the challenges to increasing study and trial opportunities for patients. The clinical research priorities are defined along with a strategy to strengthen the existing brain tumor research network, improve access to tissue and imaging and to develop the future leadership for brain tumor research in the UK. This strategy document may serve as a framework for other organizations and countries.
