Este trabajo analiza una de las instancias del clásico agón entre sofística y filosofía, tal como aparece planteado en el Fedón de Platón. El eje de mi abordaje está constituido por las diversas relaciones de esclavitud que se pueden establecer entre el alma y el cuerpo. La hipótesis que aspiro a demostrar es que mientras la esclavitud del cuerpo al alma es postulada como la condición filosófica por excelencia, la esclavitud inversa (del alma al cuerpo) admite ser calificada de "sofística". Esto no significa que el sofista sea el creador de tal esclavitud anti-filosófica; la misma no es más que la forma de vida cotidiana del pueblo ateniense, regulada por deseos corporales que persiguen constantemente la consecución del placer. El rol del sofista en este contexto consistiría específicamente en la justificación y profundización de esa disposición preexistente, tanto a través de sus enseñanzas teóricas como de su práctica política ; This paper examines one instance of the classic agón between sophistry and philosophy, as it appears raised in Plato's Phaedo. Reformas como la Ley Orgánica de Protección de la Seguridad Ciudadana, el nuevo Código Penal o la próxima Ley de Seguridad Nacional despiertan en España, al calor del desmantelamiento del Estado constitucional, la infausta tradición del punitivismo, empleado con preferencia contra la disidencia política.
En el presente escrito buscaremos desplegar la complejidad y riqueza que el trabajo, en tanto concepto y realidad reviste para Marx en su doble y opuesta determinación: como trabajo enajenado o como libre actividad, creativa, voluntaria y racional. Para ello, pondremos de manifiesto que discurrir en torno al trabajo no es en definitiva otra cosa que discurrir en torno al hombre mismo. Pues, el trabajo consiste en el ejercicio de hermenéutica, de comprehensión, que el hombre ensaya sobre el mundo, sobre sí mismo y los demás. Por lo tanto, la lucha contra toda posible enajenación u opresión no es sino la apuesta por la construcción de aquel futuro otro y diverso que es el comunismo.La complejidad de este concepto y esta realidad, que es el trabajo, se enmarca por entero y da cuenta de la imposibilidad de aprehender en forma definitiva al ente antropológico. En tanto condición e instancia de la opresión, el trabajo es, al mismo tiempo, el espacio abierto, la estancia desde la que operar la transformación radical de las condiciones objetivas y subjetivas que cimientan el edificio de la economía política sobre el que se erige la enajenación.La metodología de abordaje temático consistirá en el análisis bibliográfico de la obra de Marx, centrándonos prioritariamente en dos textos, uno representativo de su juventud, a saber, los Manuscritos económico-filosóficos de 1844 (2001), el otro, consumación de su obra de madurez, o sea, El Capital (2000), buscando el papel y el lugar que en cada una de estas obras desempeña el trabajo como llave de acceso a un sistema económico opresivo.Asímismo, se indagará en una serie de intérpretes de Marx, algunos marxistas en su formación, otros críticos y la mayoría en una situación intermedia. Para ello hemos buscado ampliar en la medida de lo posible el horizonte de estudio a fin de dar cuenta de la repercusión y la recepción que esta cuestión ha tenido en los filósofos y pensadores posteriores al mismo, inquiriendo para ello en las más variadas tradiciones de pensamiento y formación. Sólo por citar algunos: Arendt, Del Barco, Derrida, Sartre, Fromm, Lukács, Marcuse, Balibar y Negri. ; In this paper we seek to expand and understand the complexity and richness of labour. This concept takes a double an opposite determination for Marx: as alienated labour and as free activity, creative, voluntary and rational.To do this, we will show that, discuss about labour is the same as arguing about the man himself. This concept is understood as hermeneutic exercise of comprehension that man makes about the world, about himself, and about others. Therefore, the fight against all possible alienation or oppression is but the commitment to build another world, a different one, and that world is no more than communism.The complexity with this concept and the reality, that is labour, reveals the inability to understand human being. Work is where oppression is generated but at the same time, is the place from where you can make the radical transformation of both, the objective and subjective conditions that underpin the building of political economy on which it stands and is where can reverse the alienation.The methodology that we used for this paper will consist on the bibliographical analysis of Marx's work, centering as a priority on two texts; one of his writings of youth, known as los Economic and Philosophic Manuscripts of 1844 (2001). The other text is the most famous one, written in his last years of life, known as Capital (2000). We are going to analyze, in these two writings, the role and the place which plays labour as access key to an oppressive economic system.Likewise, there will be a critical reading on the bibliography of some interpreters of Marx; some of them are Marxists, other ones critics and most of them in an intermediate situation. The purpose of this, is to expand thehorizon of study in other to give birth to the impact and the reception that this problem has had on philosophers and thinkers throughout history. Just to mention a few: Arendt, Del Barco, Derrida, Sartre, Fromm, Lukács, Marcuse, Balibar and Negri.
L'oggetto di questo lavoro è il compito di legittimazione culturale della dittatura franchista sviluppato per i giuristi spagnoli tra 1937 e 1945. Il suo obiettivo é fornire un quadro complessivo utile per la comparazione con il percorso italiano. Si mettono a fuoco cinque questioni: in primo luogo, la rottura nella accumulazione e nello sviluppo del sapere giuridico causata dalla guerra civile e le ulteriori esecuzioni, esili e epurazioni dei professori universitari; poi, la legittimazione con gli argomenti del diritto del coup d'État del 18 luglio 1936. Dopo si esaminano le teorie che davano fondamento alla posizione suprema del dittatore. È anche oggetto d'indagine l'atteggiamento dei giuristi davanti alle grandi leggi del regime, segnato per l'esercizio di una esegesi acritica e senza costruzione. Infine, l'ultimo punto tratta lo studio dei sistemi giuridici del Terzo Reich e dell'Italia fascista che spesso facevano i giuristi spagnoli al fine di ricavare informazioni utili per il processo d'istituzionalizzazione della dittatura franchista. This work will examine the cultural legitimacy given by the Spanish jurists to Franco's dictatorship between 1937 and 1943. I intend to give a general outlook in order to compare the Spanish experience with the Italian jurists. I will discuss five issues: a) The discontinuity in the development and growth of legal knowledge caused by the civil war, the executions, the exile, and the purge of universities' faculty; b) the use of legal arguments to legitimate the military coup of July the 18th of 1936; c) the theories that made the basis of general Franco's caudillaje; d) the exegesis without construction as a means to interpret and expose the dictatorship's laws; e) the focus on Nazi Germany's and fascist Italy's legal systems as models for the institutionalization of the 'new State'.
El presente artículo esboza las líneas maestras del pensamiento jurídico de Hermann Heller, tratando de reconstruir a su través los pilares fundamentales del Estado social de derecho. Para ello examina tres aspectos de su aportación doctrinal: a) la concepción pluralista de la democracia, contra las tesis nacionalistas y liberales; b) su noción participativa de la ciudadanía, que conduce a una visión específica de la legislación estatal y del estatuto normativo de la Constitución; y c) su crítica del fascismo y de la dictadura en tanto que alternativas al Estado de derecho. ; This article will reconstruct the fundamentals of the social rule of law by sketching the main lines of Herman Heller's legal thought. Thus, it will discuss three relevant aspects of Heller's doctrinal contribution: a) a pluralistic conception of democracy as against nationalistic and liberalistic tenets; b) his participatory understanding of citizenship, leading to a particular perspective on state legislation and the Constitution's normative status; and c) his criticism of fascism and dictatorship as alternatives to the rule of law.
El presente artículo aborda críticamente una reciente publicación sobre la iuspublicística de la Segunda República. Analiza en primer lugar algunas carencias habituales en el estudio del Estado republicano; examina después las debilidades, también frecuentes, cometidas al estudiar las biografías de los juristas españoles contemporáneos; y concluye cuestionando la tesis política sostenida por el autor de la monografía. ; This article critically reviews a recent book on the juridical science publications made during the second Spanish Republic. It begins analyzing certain common deficiencies fallen on when studying that Spanish republican government; it then identifies other also common faults made when studying the biographies of Spanish jurists of that period; and finally questions the political thesis held by the author of that publication.
Resumen: El presente artículo examina el estudio historiográfico de la tradición del derecho político español. En su aspecto crítico, analiza varios textos que se proponen, o bien divulgar nuestro constitucionalismo histórico, o bien recuperarlo para el presente. Y en su aspecto afirmativo, pretende por un lado plantear una alternativa para su reconstrucción historiográfica, y por otro, señalar las graves carencias de que adolece el pensamiento jurídico conservador que parece querer adueñarse de dicha tradición.
