RESUMEN. Los países del derecho europeo continental que han adoptado regulaciones inspiradas en el instituto angloamericano del trust han centrado sus esfuerzos en las aplicaciones comerciales de la figura, sin querer introducirla como una técnica de derecho común a disposición de todo ciudadano. Este artículo plantea la conveniencia de que el legislador español adopte, en su caso, un enfoque más general que englobe las utilidades de la figura como instrumento de transmisión y protección de la riqueza en el ámbito familiar. La autora explica las múltiples utilidades que ofrecen los family trusts en Estados Unidos, donde es cada vez más difícil pensar en el instituto como instrumento exclusivo de las elites sociales o de los ricos. ; ABSTRACT. European civil law jurisdictions that adopted statutes inspired by the Anglo-American trust institution focussed their efforts on the commercial applications, with no intend of adopting the trust as a general instrument available to all citizens. This paper suggests that the Spanish legislator should adopt a broader approach, including the trusts' applications to transfer and protect wealth within the family. The author explains the many applications offered by family trusts in the United States, where it is harder and harder to think of the trust as the tool of social elites or of the rich, only.

"How should a landowner respond when a squatter occupies their land? This book discusses the issues focussing on vindicatio, possessory remedies and trespass, but also explores administrative procedures for their removal. In many cases, these actions derive from Roman laws, which are expertly explored in an introductory chapter. Also included is a chapter exploring human rights interventions in such actions.
