La adopción es una institución prohibida en el Derecho islámico y regulada en este ordenamiento jurídico de forma profusa. Las comunidades andalusíes del territorio peninsular convivieron con comunidades mozárabes e hispanas y aplicaron ese mismo principio, especialmente cuando de hijos de matrimonios mixtos se trataba. La legislación conservada desde el siglo VIII, aplicada sin solución de continuidad hasta el siglo XVII aporta datos sobre situaciones en las que por piedad y compasión hubo que arbitrar soluciones de consuno, para quienes eran débiles y estaban desvalidos. La acogida o kafāla, garantizada mediante instrumentos jurídicos, es una institución cuya importancia trasciende hasta nuestros días, como se ha querido demostrar en este trabajo. ; Adoption is an institution prohibited in Islamic law and profusely regulated in the legal system. The Andalusian communities of the peninsular territory coexisted with Mozarabic and Hispanic communities and applied the same principle, especially related to children of mixed marriages. The oldest preserved legislation and fetuas dated back from the 8th century, and were applied without interruption until the 17th century. Legislation and fetuas shed light on cases in which out of mercy and compassion, solutions had to be found, for the weak and helpless. El propósito de este trabajo es analizar la terminología con la que se identificó a la población india a través de una selección de fuentes para el conocimiento del derecho indiano, entre las que cabe mencionar legislación, documentos de aplicación del derecho y memoriales e informes elevados al monarca español. Se trata de conceptos cargados de significado jurídico, en muchas ocasiones con connotaciones peyorativas y que minusvaloraban las capacidades y competencias dela población indígena. La limitación de derechos, y en concreto de privilegios y exenciones reservados a los españoles, pudiera tener su causa en este hecho. La trascendencia que tuvo la asignación de determinados adjetivos y nombres constante el tiempo en la génesis del imaginario del indio ciudadano se evidencia en el proceso de la construcción de una política americana y, especialmente, en el proceso constituyente español de principios del siglo XIX. ; The purpose of this paper is to analyze the terminology with which Indian people was identified, through a selection of sources for the knowledge of Indian law, amongst them legislation, documents relating to the implementation of law, memorials and reports submitted to the Spanish king. These are concepts loaded with legal significance, often with pejorative connotations that undervalued the capacities and competences of the Indigenous population. The limitation of rights, and in particular privileges and exemptions reserved to the Spaniards, could have its cause in this fact. The Nueva Planta decrees (1707–16) caused an important change on the institutional and legislative map, not only in the Crown of Aragon but also in the Crown of Castile. The call for only one parliament within a 'new institution' – the General Courts of the Monarchy – was one of the consequences of this process of abolition undertaken by the representative institutions of each kingdom. This process deserves special attention because of the significant changes in its functions. The functions and duties of this 'new parliament' mainly revolved around the interests of the absolute monarchy, and the calls made during the eighteenth century – in 1713 and in 1789 – were thus intended for the oath of the heir to the throne. Among the various functions given to the parliament, the voting of servicios (a subsidy or petition) – usually a donation request – certainly stood out from time immemorial. La población indiana, y concretamente la autóctona, fue objeto desde los primeros tiempos de la conquista, de sentencias cuya finalidad era limitar la libertad de movimiento en su lugar de origen. En los primeros años de la presencia hispana en Indias, perdón y pena de destierro fueron decisiones jurisdiccionales que han sido objeto de análisis poniéndose de relieve no solo su contenido sino también la evolución en el marco de la legislación indiana. ; A sorrow of exile, called al so a sorrow of oblivion is a subject matter that has got special attention for the specialists in History of the Indian Law. The Indian population, and concretely the autochthonous one, was an object from the first times of the conquest, of judgments which purpose was to limit the freedom of movement in his place of origin. La presentación de demandas de separación y divorcio entre personas que han contraído matrimonios mixtos con musulmanes, así como las demandas respecto a la filiación y otras medidas en el supuesto de matrimonios entre musulmanes obliga al conocimiento de las instituciones que en el Derecho europeo comprende el Derecho de familia. La determinación de la filiación de hijos habidos dentro y fuera de estos matrimonios plantea ante la Administración de justicia española cuestiones diversas, habida cuenta de la pluralidad legislativa que se enmarca dentro de lo que es conocido de forma general como Derecho Islámico. La presunción de paternidad, su reconocimiento (iqrar) y los derechos y deberes inherentes a los padres (hadana y nafaqa) son objeto de revisión y adecuación a las exigencias actuales, en virtud de supuestos legales. ; The legal proceedings for separation and divorce among people who have entered into mixed marriages with Muslims, as well as actions concerning affiliation and other arrangements in the case of marriages between Muslims, require knowledge of principles which in European Law are covered by Family Law. The determining of affiliation of children born inside and outside these marriages raises a number of issues for the Spanish judicial system, in view of the plurality of Islamic Law. This paper examines the presumption of paternity, its recognition (iqrar) and the rights and inherent duties of parents (hadana and nafaqa), which are subject to revision in accordance with current demands and legal requirements.
