The International Tribunal for the Law of the Sea (ITLOS) issued an advisory opinion on May 21, 2024 in response to a request submitted by the Commission of Small Island States on Climate Change and International Law (COSIS). While various aspects of the advisory opinion have already been discussed in this joint blog symposium, this post focuses on a feature of the opinion that has so far received little emphasis: the strong role of science. The scientific evidence presented by the tribunal provides a solid basis for its conclusions on State obligations to prevent, reduce, and control climate pollution.

On April 9, 2024, the European Court of Human Rights (ECtHR) ruled on three applications concerning the fight against climate change and the positive obligations of the signatory states of the European Convention on Human Rights (ECHR) in this respect. This blog post analyzes the Carême decision in which the Court declared inadmissible an application brought by a former mayor of a French town on the grounds of incompatibility ratione personae with the provisions of the Convention within the meaning of Article 35 § 3 (§ 88). In my view, this is an ill-developed decision, which could dangerously imply a regression in environmental matters.

AbstractClimate change emergency requires rapide and determined action. The procrastination of the French state is not without consequences. One of them is that the High Administrative Court (Conseil d'Etat) found that climate risk is not taken seriously enough and is insufficiently addressed. In two decisions ruled in 2020 and 2021, the Conseil d'Etat in France had the opportunity to express itself on these issues. This is the case known as "Grande Synthe", referring to the city that filed the petition before the High Court, in an appeal for "exces de pouvoir" –exces of power -, asking the administration to take further action in the fight against climate change. Civil society in France is indeed becoming impatient and taking legal action challenging the lack of ambition of the State in climate matters. The decision commented here will no doubt serve as a model for other similar decisions and for other European countries. It will lead to an increase of climate litigation in France and abroad.

The assessment of the trial as a means of amicably settling conflicts with a view to promoting "social peace" is an interesting hypothesis to be developed in the case of climate litigation, where the overall problem of climate change is met with strong resistance international, regional and often national level. The courtroom has become the locus of resolution of certain disputes related to this global phenomenon with national or local repercussions. This reflection invites us to come out of a binary conception of rights, founded on an original dichotomy between the law and the praetorium, in order better to grasp all the social complexity of the creation of the law, especially in the case of a multi-faceted problem such as climate change. At the same time, and because of the case of climate change, the scope of a fundamental right of everyone to "a healthy and safe environment for the survival of mankind" emerges strongly, expectations climate justice and new rights to the impacts of climate change on society. This need for justice in subjective rights is in keeping with the growing importance of fundamental rights, which implies increased responsibilities for the State (based on international obligations but also regional and national obligations) and for business and industry.
