En términos de justicia global y para superar las dificultades del sistema penal internacional, hay que entender los diferentes instrumentos, que componen este sistema, como complementarios y necesarios en la lucha contra la impunidad. Entre ellos, un papel muy importante ha sido desempeñado por el principio de jurisdicción universal que, creando foros alternativos, en determinados casos forum necessitatis, hace valer los derechos de las víctimas de crímenes internacionales como tortura, crímenes de guerra y contra la humanidad a la justicia y la reparación. Among them, an important role has been played by the principle of universal jurisdiction, creating alternative forums, in some cases forum necessitatis, to assert the rights of victims of torture, war crimes and crimes against humanity. However, due to the contradiction between the universality of its mission and the particularity of the political interests of sovereign states, which provide the legal framework for its implementation, this principle has passed by and passes through significant ups and downs showing that this type of jurisdiction is still characterized by its complexity and the existence of several problems concerning its application.

El derecho de acceso a la justicia, derecho humano y principio básico del Estado de derecho es esencial para garantizar un desarrollo sostenible y sociedades más justas y pacíficas. Para asegurar su efectividad, los Estados deben implementar medidas para salvaguardar, entre otros, derechos, garantías y protección judicial. Por esta razón, debemos referirnos a la agenda de Naciones Unidas sobre los objetivos de desarrollo sostenible, particularmente el objetivo 16, acceso a la justicia, para hacer una crítica respecto de la creación de estrategias y acciones en un tema que se ha omitido por el legislador mexicano, la indemnización por error judicial, ya que el marco legal y de interpretación no contribuye a exigirle al Estado una responsabilidad directa y objetiva por los daños causados a una persona que ha sido privada de su libertad injustamente. ; The right of access to justice, human right and basic principle of the rule of Law, is essential to guarantee a sustainable development and more just and peace-ful societies. To ensure its effectiveness, States must implement measures to safeguard, among others, rights, guarantees and judicial protection. This is why we must refer to the UN Agenda on the Sustainable Development Goals, particularly objective 16, ac-cess to justice, to make a criticism regarding the creation of strategies and actions on a topic that has been omitted by the Mexican legislator: compensation for miscarriage of justice. This is because the legal and interpretative framework does not contribute to demanding from the State a direct and objective responsibility for the damages caused to those who have been deprived of their freedom unjustly.

The causes of the Rohingya conflict are multiple and far from the extended version according to which the problem lies in a purely religious matter; in fact, the humanitarian crisis also reveals geopolitical and strategic issues and of land and resources grabbing. Since August 2018, this crisis has captured the attention of international media after the increase in violence by the army, which resulted in a massive exodus towards the border between Myanmar and Bangladesh. The United Nations has not hesitated to describe the crimes perpetrated in this conflict as acts of genocide, recognizing that the Rohingya have become the largest stateless population in the world. In this work, we aim at showing the multiple international legal projections of this conflict, focusing our attention, in particular, on the mechanisms of accountability, such as the possible internal and international judicial proceedings and the use of international sanctions against the government of Myanmar, companies and other responsible agents. We finish our study with some brief conclusions.

Interesados desde hace ya largo tiempo en el binomio empresas-derechos humanos, los autores ponen de relieve aquí diversos aspectos de la incidencia de la actuación de aquéllas sobre el sistema democrático. En primer lugar, analizan el impacto sobre el ámbito electoral, tomando como referencia especial el Caso Citizens United. Se presentan luego sendos ataques contra libertades fundamentales, constituidos por la SLAPP Litigation y el uso de técnicas de desinformación, tras de lo que se completa el estudio con unos apuntes sobre interferencias en los procesos de regulación, centrados en los lobbies y las llamadas puertas giratorias, y el punto central constituido por los arbitrajes de inversión. Unas breves reflexiones conclusivas, llamando al análisis y vigilancia estrecha de estos fenómenos, dan término a la aportación. ; Long interested in the business-human rights binomial, the authors highlight a number of aspects of the impact of business' actions on the democratic system. First of all, they analyze the impact on the electoral sphere, taking the Citizens United case as a special reference. Two attacks against fundamental freedoms, constituted by the SLAPP Litigation and the use of disinformation techniques, are then addressed, after which the study is completed with notes on interferences in the regulatory processes, focused on lobbies and so-called revolving doors and the central point constituted by investment arbitrations. Brief concluding reflections, calling for the analysis and close monitoring of these phenomena, put an end to the contribution.

HURI-AGE Red Tiempo de los Derechos ; En estas páginas, que reflejan en lo fundamental nuestra Ponencia conjunta al IV Seminario Internacional UJI/URV Sobre Empresas y DDHH, (Castellón, Octubre de 2018), proponemos nuestras reflexiones críticas, desde la perspectiva del Derecho internacional privado, en torno a la sentencia del Tribunal Supremo de los Estados Unidos en el caso Jesner v. Arab Bank, que ha sentado un precedente importante en el proceso de restricción del acceso a los tribunales de los Estados Unidos en litigios sobre violaciones de los Derechos Humanos, haciéndolos imposibles respecto de las empresas extranjeras y, probablemente, preparando el terreno para que suceda lo propio con las domésticas. Gracias a una lectura historicista del Alien Tort Claims Act (ATS o ATCA), el Alto Tribunal afirma que ni el tenor literal del texto ni los precedentes apoyan una excepción a los principios generales, deduciendo que debe ser el Poder Legislativo el que considere si el interés público podría servirse en caso de imponer nuevas responsabilidades sustantivas y, entre ellas, una norma que impusiese responsabilidad sobre entidades artificiales como las empresas. De todo lo cual deduce que ".…sería inapropiado que los tribunales extendiesen la responsabilidad bajo el ATS a las empresas extranjeras, a salvo de una acción en tal sentido a cargo del Congreso". ; All along these pages that basically are a reflection of our joint presentation carried out within the framework of the IV International Seminar UJI/URV on Corporations and Human Rights (Castellon, October, 2018), we propose our critical insights, from the International private law perspective, of the ruling of the Supreme Court of the United States in the case Jesner v. Arab Bank. This judgment has set an important precedent in relation with the process of access restriction to courts in the United States as far as international disputes involving serious infringements on Human Rights are concerned, making them impossible with regard to foreign corporations, and probably setting the land for this to happen with domestic ones as well. Due to a historical reading of the Alien Tort Claims act (ATS or ATCA), the High Court states that neither the literal wording of the text nor the precedents support an exception to the general principles, reaching the conclusion that it falls within the scope of the Legislative Power to consider whether the public interest could be a resource in the event that new substantive responsibilities were imposed and, among them, a rule requiring liability over artificial entities as it happens with companies. It therefore follows that "…it would be inappropriate that courts might enlarge the field of action of responsibility following the application of ATS to foreign corporations, except by action arising out of Congress in the same direction".
