This work has its origin in a paradox: although the gestational surrogacy constitutes in our country a null contract and that can originate criminal responsibilities, today more Spanish children come to this world following this technique than that of adoption. Hence, it still makes sense to ask if it is appropriate to give legal treatment to the gestational surrogacy. The study recalls the positions handled by the political parties, and the evolution of the issue in France and Spain, also in what concerns the registration in the Spanish civil registry of minors born outside our borders and in the rights linked to the take care of them. Particular importance is given to the decisions of the Strasbourg Court (in addition to the classic Labasse and Manesson judgments, the recent advisory opinion issued last April) and the Court of Justice of the European Union. After a thorough legal, jurisprudential and doctrinal analysis, the convenience of carrying out a guarantee regulation of the gestational surrogacy in our country is defended.Summary:1. Bibliography quoted. ; Este trabajo tiene su origen en una paradoja: aunque la gestación subrogada constituye en nuestro país un contrato nulo y que puede originar responsabilidades penales, hoy vienen más niños españoles a este mundo siguiendo esta técnica que la de la adopción. Dea ahí que siga teniendo sentido preguntarse si resulta oportuno dar un tratamiento jurídico a la gestación subrogada. En el estudio se recuerdan las posiciones manejadas por los partidos políticos, y la evolución de la cuestión en Francia y España, también en lo que afecta a la inscripción en el registro civil español de menores nacidos fuera de nuestras fronteras y en los derechos vinculados a su cuidado. Se da especial relevancia a las resoluciones del Tribunal de Estrasburgo (además de las clásicas Labasse y Manesson, la reciente opinión consultiva emitida el pasado mes de abril) y del Tribunal de Justicia de la Unión Europea. Tras un profundo analisis legal, jurisprudencial y doctrinal se defiende la conveniencia de realizar una regulación garantista de la gestación subrogada en nuestro país.

Frequently, Magistrates of the Constitutional Court are criticized because of being highly politized. That tension has even been moved into the Court, through an abusive use of disqualification, which has reached its zenith with the recent disqualification of the President of the Constitutional Court because of his political affiliation. In order to determine whether this affiliation is surprising, it is worth examining what is the procedure used to select the Judges that perform this type of functions in other countries and in Spanish case, to wonder afterwards whether that ideological proximity of Magistrates to political parties compromises their impartiality. In view of the answer to this question, and in view of the abusive use of disqualification in order to alter the composition of the Court, we make some specific suggestions about the principles that could be articulated in relation to disqualifications that are made in constitutionality trials. ; Son constantes las críticas que reciben los Magistrados del Tribunal Constitucional por su alto grado de politización. Esa tensión se ha trasladado al seno del propio Tribunal, a través de un uso abusivo del instituto procesal de la recusación, que ha alcanzado su máximo cénit con la reciente recusación del Presidente del Tribunal por su afiliación a un partido político. Para determinar si esta vinculación ideológica es sorprendente merece la pena examinar cuál es el procedimiento de selección de los Jueces que desempeñan este tipo de funciones en otros países y en el caso español, para preguntarse después si esa proximidad ideológica de los Magistrados con los partidos políticos compromete, o no, su imparcialidad. A la vista de la respuesta que se dé a este interrogante, y a la vista del uso abusivo de las recusaciones cursadas para alterar la composición del Tribunal, se realizan algunas sugerencias concretas sobre los principios que podrían articularse respecto de las recusaciones que se realicen en los procesos de constitucionalidad.Frequently, Magistrates ...

The legislative decision that opened in our legal system the marriage institution to same-sex couples, allowing child adoption, provoked, at some point, an intense doctrinal debate. If the intention of the Spanish Constitutional Court, through the Judgment 198/2012, that settled the constitutional demand promoted against the cited decision, was to finish those debates, it doesn´t seem that the purpose was achieved. The majoritarian option dealing with an evolutive interpretation of the Constitution, or the reasons given in the dissent opinions, brought new considerations, like the ones given in this paper. ; La decisión legislativa de abrir la institución del matrimonio a las parejas formadas por personas del mismo sexo y de permitirles la adopción de menores, a través de la Ley 13/2005, generó en nuestro país un, en ocasiones, enconado debate doctrinal. Si la pretensión del Tribunal Constitucional en su Sentencia 198/2012, que resuelve el recurso de inconstitucionalidad promovido contra la citada Ley, era superar dicho debate, no parece que lo haya conseguido.
