Upgrading low‐waged and insecure work is central to contemporary labour and development initiatives, from the UN Sustainable Development Goals to the United Kingdom 'Taylor Review'. The International Labour Organization's notion of unacceptable forms of work (UFW) is a crucial contribution. Yet the regulatory frameworks that can effectively address UFW are unclear. This article builds on a novel framework – the Multidimensional Model of UFW. Drawing on theoretical literatures at the frontline of regulation scholarship, it proposes a strategic approach to UFW regulation that supports development, acknowledges the constrained resources of low‐income countries, and targets expansive and sustainable effects. Two key concepts are identified: points of leverage and institutional dynamism. Globally‐prominent regulatory frameworks are assessed as a starting point for mapping the strategic approach: the Mathadi Act of Maharashtra, India; Uruguayan domestic work legislation; minimum wages in the global North and South; and United Kingdom regulation of 'zero‐hours contracts'.

AbstractUnacceptable forms of work (UFW) have been identified as an "area of critical importance" for the ILO as it approaches its centenary. Yet there is currently no comprehensive elaboration of the dimensions, causes or manifestations of UFW. This article reports on a research project that has proposed such a framework. The article first investigates and reconceptualizes key discourses on contemporary work to identify their contribution to an analytically rigorous conception of UFW. It then outlines a novel Multidimensional Model that has been designed for use by local policy actors in identifying and targeting UFW in countries across a range of income levels.

RésuméÀ l'approche de son centenaire, l'OIT a inclus la lutte contre les formes de travail inacceptables parmi les «domaines de première importance» devant guider son action. Cependant, pour les auteures, ces modalités particulières, leurs causes, leurs dimensions et leurs manifestations appellent encore une analyse exhaustive. Elles s'attaquent donc à ce projet, en commençant par exploiter les apports des différents courants d'analyse sur le travail contemporain, puis en proposant un modèle multidimensionnel novateur, que les acteurs sur le terrain devraient pouvoir utiliser pour repérer et traiter les formes de travail inacceptables à l'échelon national, quel que soit le niveau de revenu du pays.

ResumenLas formas inaceptables de trabajo (FIT) son una de las «esferas de importancia decisiva» que la OIT se ha fijado de cara a su centenario. Hacía falta pues un estudio exhaustivo de sus dimensiones, causas o manifestaciones, que las autoras presentan aquí. En primer lugar, se examinan varios conceptos fundamentales sobre el trabajo contemporáneo, con objeto de indagar qué pueden aportar a una concepción de las FIT basada en un análisis riguroso. Después se esboza un nuevo modelo multidimensional del que pueden valerse los actores locales para identificar y combatir las FIT en países con diversos niveles de renta.

Abstract.This note provides an update on the ongoing debate over the World Bank's Doing Business project with a particular focus on its "Employing Workers" index, which is intended to measure difficulty of hiring, rigidity of working hours and difficulty of firing. The authors review the findings of studies that have used this index or been influenced by it and of those that inspired its construction. They go on to examine criticisms of this instrument, highlighting both conceptual and empirical problems. Their paper concludes with suggestions for alternative approaches and future research.

Résumé.Cette note fait le point sur le débat suscité par le projet Doing Business de la Banque mondiale, et notamment par son indicateur «Embauche des travailleurs», censé mesurer la difficulté d'embaucher, la rigidité de la durée du travail et la difficulté de licencier. Les auteurs présentent les résultats des études qui l'ont utilisé, l'ont inspiré ou ont été influencées par cet indicateur. Ils se penchent ensuite sur les critiques de cet instrument qui pose des problèmes conceptuels et empiriques. Ils concluent par la formulation de suggestions pour les recherches à venir.

Resumen.Los autores reseñan las últimas novedades acerca del estudio Doing Business del Banco Mundial, haciendo hincapié en el indicador de las normas del trabajo: la dificultad de contratación, la rigidez de la jornada de trabajo y la dificultad y costo del despido de trabajadores. Primero pasan revista a los estudios que inspiraron la concepción del indicador y a los que lo han usado o se han visto influidos por él. Analizan después las críticas vertidas contra el mismo, y ponen de relieve los problemas conceptuales y empíricos que plantea. Por último, proponen ideas alternativas y líneas de investigación para el futuro.
