Abstract
Arguments have been made both for and against military use of autonomous weapon systems (AWSs) on the basis of how they will help or hinder a state in meeting its international humanitarian law (IHL) obligations. Often, these arguments are made in isolation, or they fail to address all of the potential compliance concerns related to autonomous weapons. This is not ideal. It means the bearers of legal obligations must locate, assess and piece together the disparate arguments into a coherent structure if they are to know whether they can legitimately utilise a particular autonomous capability and, if so, in what circumstances. This article offers a high-level description of a conceptual framework which can be used to organise and assess legal arguments about autonomous weapons. It proposes that the task of integrating autonomous capabilities into an armed force may be viewed as a constrained optimisation problem wherein the task is to find the optimal balance between the fundamental principles of IHL while also satisfying all normative, technological and strategic/operational constraints.

Abstract
This article discusses an important limitation on the degree of autonomy that may permissibly be afforded to autonomous weapon systems (AWS) in the context of an armed conflict: the extent to which international humanitarian law (IHL) requires that human beings be able to intervene directly in the operation of weapon systems in the course of an attack. As there is currently no conventional or customary law directed specifically at AWS, limits on use of autonomous capabilities in weapons, if any exist, must be inferred from the principles, rules and goals of general IHL. The process adopted herein is to look for two broad types of limitations: those which take the form of maximum permissible degrees of machine involvement in regulated activities, and those which take the form of minimum permissible degrees of human involvement. The article's main finding is that while existing law does not impose limits of the first type, it does impose some of the second type. Specifically, legal obligations borne by individuals (commanders in charge of AWS operations, weapon system operators and others) determine the required minimum capacity for direct human intervention. The article further suggests means by which the required degree of human intervention may be determined in specific circumstances.

AbstractThis article identifies five factors that will shape the legal implications of the use of autonomous military systems. It contends that the systems which present legal challenges are those programmed to "make decisions" that are regulated by law. In so doing, they transfer control of, and responsibility for, those decisions away from those who have been traditionally seen as decision-makers to persons responsible for developing and deploying the system. The article also suggests that there may be limits to the extent to which the rules of international humanitarian law can appropriately regulate the altered relationship between soldiers and their increasingly autonomous weapon systems.
