Introduction. Legislative acts of Ukraine stipulate that the monetary unit of Ukraine is the hryvnia, while cash (money) exists in the form of cash (banknotes and coins bearing the nominal value indicated thereon) and in the non-cash form (records on accounts with banks: funds On accounts in and deposits on demand). With the advent of electronic money to scientists, the question arose about the theoretical foundations of the functioning of this payment instrument, since it has signs of both cash and cashless funds and needs theoretical substantiation of its place in the theory of modern money.Purpose. The purpose and objectives of the study are to determine the place of electronic money in the theory of modern money, refine their functions and evaluate their value in the monetary circulation of the country.Methods. Methods used in the article: theoretical analysis and synthesis of the test material, social and qualitative research methods, analytical- statistical method.Results. The legal conflict, which is ambiguous, whether the state is currently guaranteed to provide electronic money in banks or not. Therefore, this inaccuracy in the legislation should be resolved within the legal framework and economic basis. In our turn, we believe it is expedient to introduce a norm on the unequivocal guarantee of the provision of electronic money, as they are cash in national currency of the country where they are in circulation and have the corresponding status of the total equivalent in both cash and non-cash forms money.Originality. In this article, for the first time, the place of electronic money was determined in the theory of modern money and outlined the basic features of electronic money that have properties for both cash and non-cash forms of money.Conclusion. Like other forms of modern money, electronic money is by its nature credit – the obligations of the bank that issued them, to settle at maturity with their user (owner) of traditional forms of money. They perform the same functions as other forms, and the question of the quantity, origin and content of their functions is also controversial and depends on the views of scholars or the views of various scientific schools.
The purpose of this work is to analyse the current state of regulation of the supervisory boards of joint stock companies in Ukraine, in particular the features of their work on state-owned enterprises. A review of the practical aspects of regulating the activities of supervisory boards of joint stock companies in Ukraine is made. By applying analytical methods the provisions of regulations in the field of corporate law the latest changes in the legal status of supervisory boards of joint-stock companies are studied, and their applicability to state joint-stock companies is assessed. In addition, these changes are compared with the provisions of international standards in the field of corporate governance of state-owned enterprises, in particular the standards of the Organization for Economic Cooperation and Development (OECD). The article deals, inter alia, with the concepts of "supervisory board", "state-owned enterprise", "fiduciary duties", as well as issues of transparency and integrity of the work of supervisory boards. In addition, the issues of the latest practice in the work of supervisory boards of state-owned joint stock companies and how the powers of the supervisory boards were exercised are considered. According to the results of the study, the current regulations are quite complex, inconsistent and contain internal contradictions, which, on the one hand, create risks for the effective exercise of powers by supervisory boards, and on the other hand, the risks of abuse by supervisory boards. The authors concluded that it is necessary to improve the legal framework governing the work of supervisory boards of state-owned joint-stock companies, generalize and unify practices on various issues of competence of supervisory boards, as well as provide certain criteria for compliance of supervisory board members with professional experience requirements in a particular field and with requirements of transparency about the absence of conflict of interest.
Based on the analysis of the impact of quantitative easing policies on the global economy, there was concluded that the world's largest central banks and widespread debt stimulation have created the model of economic growth. This model was based on the productivity growth. The lack of productivity growth in the developed world, the active integration of developing countries (first of all China and India) in the global economy have completely changed the directions of global financial flows and caused fundamental geopolitical changes.Striving to confront the cyclical nature of the economy, government regulators transform the global economy into a «zombie economy». There are unprofitable companies and banks, which operate on cheap money from central banks and government bailouts. The monetization of fiscal policy transforms the risks from governments to central banks and destroys their independence.We concluded that the strategy of tackling the global economy through cheap credit is doomed to failure because governments do not solve the problems of real economy, productivity increase, management of public and corporate debt, stagflation, unemployment, and increase in income differentiation.Nowadays, in the context of COVID-19 pandemic, central banks use the new and forgotten old tools to expand economic activity (so-called QE and «Not QE»). These tools provide the necessary stimulus only in the short-term period, but in the long term period it will inevitably lead to serious disparities, undermine the market mechanism, increase the administrative influence and lead the global economy to a choice between depression, unemployment, hyperinflation or systemic collapse.We believe that the global coronavirus pandemic stimulates the scientific debate on rethinking monetary policy goals and instruments, as the use of various «non-standard tools» has repeatedly proven ineffective in combating crises and it has helped only to create new global imbalances and crises. ; Деятельность крупнейших мировых центральных банков последних десятилетий нарушила модель экономического роста, основанную на росте производительности труда. Стремясь бороться с цикличностью экономики, государственные органы превратили глобальную экономику в «зомбиэкономику», где убыточные банки и компании функционируют на дешевых деньгах от центральных банков и спасательных программах правительств. Intensive anthropogenic transformations of European territories during the last century caused a significant depletion of the indigenous fauna and led to the formation of its new agglomerations by a modern type. Actually in our country the transition to high-tech processing methods and practice of monoculture agricultural production almost completely eliminated indigenous finely mosaic landscape, which significantly worsened the living conditions for the most wild life species.The analysis findings of environmental and legal instruments of effective game management ensuring on the cultivated lands of Ukraine confirmed their imperfection. In particular, the research has established that now it makes impossible the sustainable development of domestic hunting in the market economy conditions and requires the relevant government bodies to provide timely and appropriate normative response to current challenges in basic laws and regulations, providing branch functioning.It has been found out that current arable lands of Ukrainian lowlands through much of the year become destructive with a total dominance of winter fallows (on average more than 69.8 % of the areas), mixed with rare inclusions of winter crops and low-value, in the trophic sense, stubbles of late harvested tall-stalked crops (98%), mainly corn for grain and public initiatives aimed at environmental sustainability restoration. Therefore, in our opinion, the legally regulated allocation of a part of private shares lands (up to 3-5 %) for semi-natural buffer zones (protective and feeding areas) of multifunctional purpose remains almost the only one theoretically possible legal instrument of agricultural lands ecological capacity improvement. Due to the threatening plowing of Ukraine's territory this proposal is rather harmoniously combined with a number of legislative and recreational attractiveness of domestic cultivated lands.Despite a significant number of mainly ineffective regulations of various levels on the legal support of game exploitation protection and economic, the Law of Ukraine «On game management and hunting» remains the main regulatory document in this area. This Law regulates the social, legal and economic foundations of game management, determines the process of relations between central and local governments, users of hunting lands, hunters and landowners, as well as liability for violation of the current legislation is determined. Modern agricultural lands of Ukraine are unsuitable for the successful existence of field game, considering the four main reasons: monoculture production declaration of crop growing on critically plowed large-contour territories; lack of a sufficient number of field boundaries, biograssplots with natural grass cover, which creates a feed shortage in the non-growing season, as well as from cereals maturity stage to winter sprouting of these crops; excessive predatory pressure of not properly regulated harmful species; low zoo-sozological, not regulated legislatively farming standards generally. In turn national legislation on public relations regulations in the areas of protection and special use of cultivated lands fauna, having been at the embryonic developmental stage for a long time, remains ineffective in solving a number of socio-environmental challenges of our time, therefore requires urgent improvement and adaptation to European Union standards. Future approaches to the development and application of environmental policy instruments, namely legislation, national-level programs, developmental plans of individual economy sectors etc. should provide for maximum complementarity and synergism of effective practical legal instruments of intersectorial level to achieve environmental and agricultural goals of the state. ; Результати аналізу еколого-правових інструментів із забезпечення ефективного ведення мисливського господарства в агроландшафтах України засвідчили їхню недосконалість. Дослідженнями зокрема встановлено, нині це унеможливлює сталий розвиток вітчизняного мисливства в умовах ринкової економіки та вимагає від профільних органів державної влади своєчасного і належного нормотворчого реагування на виклики сучасності у базових законах та підзаконних регуляторних актах, що забезпечують функціонування галузі.З'ясовано, сьогоденні орні землі рівнинних регіонів України упродовж більшої частини року набувають спустошливого вигляду з тотальним домінуванням зябів (у середньому понад 69, 8% площ), розбавлених поодинокими вкрапленнями озимих та малоцінних, у трофічному сенсі, стерень пізно зібраних високостеблових культур (98 %), в основному кукурудзи на зерно. і суспільних ініціатив спрямованих на відновлення екологічної стійкості Відтак, чи не єдиним з теоретично можливих правових інструментів поліпшення екологічної ємності сільськогосподарських угідь, на нашу думку, залишається законодавчо врегульоване відведення частини площ (до 3-5%) приватних паїв під напівприродні буферні зони (захисно-кормові ділянки) поліфункціонального призначення. У зв'язку з загрозливою розораністю території України, дана пропозиція досить гармонійно поєднується з цілою низкою законодавчих та рекреаційної привабливості вітчизняних агроландшафтів.
