This Paper seeks, based on the undeniable relationship between health protection and the fight against climate change, the analysis of the public health model established in our climate legal system based on the actions of the Autonomous Communities. For this, the Law 7/2021, of May 20, on Climate Change and Energy Transition, as a legal framework, must be considered, as well as the different legal situation of the Autonomous Communities, depending on whether they have legislated or not in this matter. Thus, the Paper concludes with some reflections about the effectiveness of a model based on heterogeneous actions of the mentioned Autonomous Communities regarding public health and climate change. ; Este Trabajo pretende, a partir de las innegables relaciones entre la protección de la salud y la lucha contra el cambio climático, el análisis del modelo de salud pública establecido en nuestro ordenamiento climático a partir de la actuación de las Comunidades Autónomas. Dicho análisis precisa tener en cuenta el marco que constituye la Ley 7/2021, de 20 de mayo, de Cambio Climático y Transición Energética, en tanto que norma básica, y la diferente situación normativa de las Comunidades Autónomas en función de que hayan legislado o no sobre esta materia. El Trabajo concluye con algunas consideraciones sobre la efectividad de un modelo basado en ordenaciones heterogéneas de las Comunidades Autónomas cuando salud pública y cambio climático concurren.

El presente estudio pretende el análisis de la reciente Ley 8/2018, de 8 de octubre, de Medidas frente al Cambio Climático y para la Transición hacia un nuevo modelo energético en Andalucía, con el fin de considerar el sistema jurídico que establece y su significado tanto para el derecho ambiental de la Comunidad Autónoma como respecto del derecho estatal sobre cambio climático, en línea con las exigencias de la Unión Europea y el contexto internacional. Así, el objeto del estudio incluye la implicación de sujetos públicos y privados en la lucha contra el cambio climático, las estrategias combinadas de mitigación y adaptación previstas en la norma, así como los instrumentos jurídicos creados al efecto. ; This study aims to analyze the recent Law 8/2018, of October 8, on Measures against Climate Change and for the Transition towards a new energy model in Andalusia, in order to consider the legal system it establishes and its meaning, both for the environmental law of the Autonomous Community and for the relation to law of the State on climate change, in line with the demands of the European Union and the international context. Thus, the involvement of public and private subjects in the fight against climate change, the combined mitigation and adaptation strategies provided for in the standard are considered, as well as the legal instruments created for this purpose. ; El present estudi pretén l'anàlisi de la recent Llei 8/2018, de 8 d'octubre, de mesures davant el Canvi Climàtic i per a la Transició cap a un nou model energètic a Andalusia, per tal de considerar el sistema jurídic que estableix i el seu significat tant per al dret ambiental de la Comunitat Autònoma com respecte de el dret estatal sobre canvi climàtic, en línia amb les exigències de la Unió Europea i el context internacional. Es consideren, així, la implicació de subjectes públics i privats en la lluita contra el canvi climàtic i les estratègies combinades de mitigació i adaptació que preveu la norma, així com els instruments jurídics creats a l'efecte.

En la Comunidad Autónoma de Extremadura pueden identificarse dos ámbitos normativos en los que se preve la incorporación del informe de impacto por razón de género en los procedimientos de elaboración de reglamentos y el ejercicio de la iniciativa legislativa. En este sentido con anterioridad a la Ley 8/2011 de 23 de marzo de igualdad entre mujeres y hombres y contra la violencia de género la Ley 1/2002 de 28 de febrero del Gobierno y Administración de Extremadura introducía la técnica que nos ocupa.

Así, el objeto del estudio incluye la implicación de sujetos públicos y privados en la lucha contra el cambio climático, las estrategias combinadas de mitigación y adaptación previstas en la norma, así como los instrumentos jurídicos creados al efecto.

This paper examines the concept of the Smart City as a new system of territorial organization that aims to build a more cohesive society and a sustainable model of economic growth. Smart Cities play a fundamental role in the organization of physical space and land use, and attempt to balance the needs of economic growth, energy management and transport, at the same time as complying with environmental legislation. To do so, Smart Cities need to develop new administrative competences under a new conception of the relationship between citizens and public authorities, but within the framework of territorial intelligence. This paper explores key aspects of the Smart City, taking into consideration the European framewor for Smart Cities, and Spanish legislation governing the competences and functions of the local authorities. It is suggested that Smart Cities can be considered a starting point for designing a new kind of urban living experience which provides different mechanisms for collective interest to be expressed and recognized.

La simplificación administrativa constituye un principio clave en
los procesos de reforma y/o modernización del Derecho Administrativo que se están
planteando en la actualidad. Los instrumentos de simplificación administrativa
se están impulsando desde organizaciones internacionales, y están siendo acogidos
de manera diversa en los países de nuestro entorno, proyectándose directamente
sobre el procedimiento administrativo. Este Trabajo pretende un estudio
de Derecho Comparado en torno a la incorporación de la simplificación administrativa
en Portugal. Desde esta perspectiva, el Ordenamiento administrativo portugués
puede considerarse un referente tanto en el diseño de una auténtica política
de simplificación administrativa, como en la positivación de sus técnicas a través
del procedimiento administrativo, poniendo de manifiesto la idoneidad de esta
Institución para reflejar cambios fundamentales del Derecho Administrativo.

bidez teknikak positibatzeagatik, agerian jarriz erakunde hori oso egokia
dela Administrazio Zuzenbidearen funtsezko aldaketak islatzeko.
Administrative simplification is one of the keys of the process of
modernization of Administrative Law nowadays. The simplification techniques
and instruments are taking place in administrative procedure because of the International
Organizations¿ interest and the resultant implementation process is
different from one country to another. Therefore, this Paper aims to present a
comparative study of the Portuguese Administrative Law regarding the bases and
instruments of administrative simplification, so that Portugal can be considered as
a reference in order to design a public policy of simplification and to incorporate
its techniques in administrative procedure. From this point of view, we should remark
how administrative procedure is a basic institution to reflect the changes of
Administrative Law with regard to the principle of administrative simplification.

Las energías renovables y el ahorro y eficiencia energética constituyen dos aspectos fundamentales en la lucha contra el cambio climático. En este contexto, las Administraciones Públicas asumen distintas funciones que tienen proyección directa en instrumentos jurídicos específicos en la ordenación de este sector. En este sentido, las Entidades Locales parecen tener una posición limitada en el impulso de las energías renovables y la eficiencia energética, que contrasta con el espacio y competencias asumibles por las mismas al amparo del concepto de sostenibilidad urbana. Concretar este aspecto constituye el objeto fundamental de este Trabajo. Se exponen, así, los elementos generales de ordenación de las energías renovables y la capacidad de las entidades locales para poder desarrollar la función pública de tutela ambiental en un sector tan complejo como el energético, en el que la producción de estas energías, junto a las políticas de ahorro y eficiencia energética, no solo se articulan a partir de las exigencias de protección del medio ambiente, sino también teniendo en cuenta las especialidades de un sector estratégico. ; Renewable energies and efficiency are the means to fight against the Climate Change. From this point of view, the Administration has new functions and, therefore, new instruments to implement in this area. In this context, Local Governments seem to play a limited role concerning these energies and the efficiency, but their real position is quite different because of the concept of urban sostenibility. This Paper aims to show which legal instruments can be used at the local level of government to promote the renewable energies and efficiency. In doing so, this Paper shows the legal regulation of this field, in order to make evident that is a very difficult question, because of the relationship between the environmental remarks of the renewable energies and efficiency an the energies, as a regulated field of the Administrative Law.

Nos encontramos con un auténtico manual de Derecho del Medio Ambiente, que satisface, a la par, aspiraciones docentes y de investigación, puesto que son constantes las referencias a temas de actualidad del Derecho (piénsese en el fenómeno de la autorregulación) junto a una brillante exposición del régimen jurídico de las técnicas esenciales de protección de los bienes naturales.
