Abstract
This contribution analyses the current situation of the implementation of the Rule of Law in the EU focusing on three essential aspects: the role of Article 2 of the TEU as a legal paradigm, the issue of effectiveness of secondary law to strengthen Supranational mechanisms for the defense of the Rule of Law; and the thorny issue of the primacy of EU Law in the current Era of European Integration.

L'identification appropriée des concepts et des valeurs devant être reconnus et protégés par le droit de l'UE constitue la base pour établir les obligations des pouvoirs publics, tant en ce qui concerne la dimension individuelle relative aux bénéfices légitimes revenant aux créateurs des oeuvres audiovisuelles que pour ce qui est de la dimension collective relative à la protection et à la diffusion du patrimoine audiovisuel. ; This paper analyzes the progressive configuration of the regulatory framework of the European Union on copyright, particularly the complementary focus on intellectual property rights in the information society and the knowledge economy. The correct identification of the concepts and values that ought to be recognized and established by European Union law is the basis for establishing the obligations of public bodies, both at an individual level – related to the legitimate profits owed to the creators of audiovisual work – and a collective level – related to the protection and dissemination of audiovisual heritage.
