Freie Wähler und Kommunale Wählervereinigungen sind seit Gründung der Bundesrepublik Deutschland ein erfolgreicher Konkurrent der lokalen Parteien. Flächendeckend treten sie bei Kommunalwahlen an und können mit ihrem Anspruch auf Sachorientiertheit und Bürgernähe vor allem in Süddeutschland und in den neuen Bundesländern große Wahlerfolge erringen. Diese Erfolgsbilanz wurde im Jahr 2009 durch den erstmaligen Einzug der Freien Wähler in ein Landesparlament (Bayern) noch weiter ausgebaut. Trotz der beachtlichen Erfolge hat sich die deutsche Parteienwissenschaft bisher jedoch nur vereinzelt mit diesen politischen Akteuren auseinandergesetzt. In diesem Sammelband haben sich daher Parteienrechtler und Parteienforscher zusammengefunden, um sich dem Phänomen in all seinen Facetten anzunehmen. Entsprechend der Heterogenität dieser Akteure behandeln die Beiträge Fragen zu Präsenz, Profil und Erfolg der Wählergemeinschaften. Gleichzeitig gibt der Band in einer vergleichenden Perspektive Einblick in die Entwicklungs- und Entstehungsbedingungen von Wählergemeinschaften. Darüber hinaus widmen sich mehrere Beiträge der Frage nach der Parteilosigkeit der "Parteifreien" und liefern somit eine rechts- wie politikwissenschaftliche Einordnung dieser politischen Akteure

Dienen politische Parteien dem Gemeinwohl oder vertreten sie nur Teil- oder Eigeninteressen? Dies war eine der Grundfragen, die auf der Tagung "Gemeinwohl und politische Parteien" kontrovers diskutiert wurden.Der Band stellt die Erträge dar. In Hinblick auf die politischen Parteien wird die Gemeinwohlproblematik umfassend gewürdigt. Ausgangspunkt der Diskussion ist dabei der von alten Ressentiments getragene Vorwurf, die Tätigkeit der Parteien laufe dem Gemeinwohl zuwider. Die parteiengetragene Politik wird sowohl als Mitproduzent des Gemeinwohls als auch als Hindernis der Gemeinwohlrealisierung betrachtet. Nach einem Einführungsvortrag zum Begriff des Gemeinwohls, folgen ein juristischer und ein politikwissenschaftlicher Grundlagenvortrag. Im Anschluss werden spezielle Aspekte der Gemeinwohlproblematik behandelt und diskutiert. Ein weiterer Themenblock richtet den Blick auf unterschiedliche Formen der Entscheidungsfindung. Zum Abschluss wird ein Blick in andere Rechtskulturen der Gemeinwohlfindung gewagt

Demokratie hat als ein wesentliches Element Regeln zur Herstellung bindender Entscheidungen. Das typisch Demokratische liegt dabei darin, dass diejenigen, die an die Entscheidungen gebunden sind, über diese Herstellungsregeln die Entscheidungen inhaltlich mitbestimmen können. Die etablierte Parteitagsroutine kommt unter Druck durch Bestrebungen direkter Demokratie, sprich, weg vom Repräsentationssystem zu kommen und den Parteimitgliedern unmittelbar Mitwirkungsmöglichkeiten zu geben. Digitalgestützte Entscheidungen unter Abwesenden stellen allerdings eine Verarmung gegenüber der Entscheidungsfindung unter Anwesenden dar. Sie haben zusätzliche Kosten und Gefahren in mehreren Hinsichten.

The conditioning of citizens on politics is primarily intended to materialize their interests and convictions; and this is done mainly through political parties. Parties articulate social interests, direct the political institutions and try to materialize their objectives particularly by occupying the decision-making positions. For this reason our democracy owes political parties legal recognition as special organizations, but also the legal it is necessary to analize parliamentary groups as the parliamentary arm of the parties. ; El condicionamiento de los ciudadanos sobre la política tiene como fin primordial materializar sus intereres y convicciones; y ello lo realizan, principalmente, a través de los partidos políticos. Éstos aglutinan intereses sociales, los captan y los recopilan, dirigen las instituciones de la política e intentan materializar sus fines particularmente mediante la ocupación de las posiciones decisorias. Political parties are an essential element for the correct functioning of a democratic state. Through them, citizens may express their interests and beliefs, but also participate in political decision-making. For these reasons, in order to ensure that the parties comply with theis duties, it is necessary the existence of its regulation, specifically of two of its most problematic areas: its financing and its internal democracy. This paper focuses on these two aspects starting from the idea that the democratic process is a competitive process and that in any democratic process, all citizens should have equal opportunities to express their beliefs and interests in the political field. To achieve this goal it is necessary, on the one hand regulate the financial system of political parties, which ultimately will determine the resources of the parties and their chance of success; and on the other hand, it is necessary regulate the process of decision-making within the same party, as this will be a mechanism that may reach to concrete the subjects who will occupy positions of political decision-making positions. ; Los partidos políticos constituyen un elemento indispensable para el correcto funcionamiento de un Estado democrático. A través de ellos, los ciudadanos expresan sus intereses y creencias, pero también participan en la toma de decisiones políticas. Por estos motivos, con el fin de garantizar que los partidos cumplan con sus funciones, se hace necesaria la existencia de una regulación de los mismos, concretamente de dos de sus ámbitos más problemáticos: su financiación y la democracia interna. Este trabajo se centra en estos dos aspectos partiendo de la idea de que el proceso democrático es un proceso competitivo y de que en todo proceso democrático, todos los ciudadanos deberían tener las mismas oportunidades para expresar sus creencias e intereses en el terreno político. Para conseguir este objetivo se hace necesario, por un lado regular el sistema financiero de los partidos políticos, que en último término, determinará los recursos de los partidos y su posibilidad de éxito; y, por otro lado, se hace necesario regular el proceso de toma de decisiones dentro del mismo partido, pues será este un mecanismo que podrá a llegar a concretar los sujetos que ocuparán cargos políticos de toma de decisión.Political parties are an essential element for the correct functioning of a democratic state.
