The current article offers a constitutional analysis of the main patterns of the regulation of unprotected immigrant children in Catalonia, where recent legislation has been enacted to adapt the general system of protection to this new phenomena. Starting from the minors main characteristics and from the mechanins of protection there in force, the article deals with four important subjects: first, the potentially ineffective linkage of the institutions designed to protect these minors; second, the measure of (re)educative detention in centres; third, the constitutional problems which arise by way of the measure on minors' repatriation; fourth, the lack of cooperation among the different administrative agencies in charge of the childrens' protection. ; En este artículo se expone el análisis, desde el punto de vista constitucional, de algunas de las novedades en el tratamiento de los menores inmigrantes desamparados en Cataluña, donde recientemente se ha legislado para adaptar el sistema de protección de menores a este nuevo fenómeno. A partir de la descripción de los rasgos característicos de estos menores y del sistema de intervención que en Cataluña se ha articulado para intervenir sobre ellos, se estudian fundamentalmente cuatro aspectos de la regulación actual: en primer lugar, las posibles ineficiencias en la articulación de los mecanismos protectores de estos menores; en segundo lugar, la ausencia de garantías de la nueva medida de internamiento reeducativo de menores; en tercer lugar, los aspectos más problemáticos de la regulación de la repatriación de los menores; en cuarto y último lugar, la ausencia de mecanismos de colaboración suficientes para asegurar una intervención administrativa coordinada en este ámbito. El artículo concluye valorando la insuficiencia de las garantías actuales en la protección de los menores y de sus derechos.

As a mean to ensure social cohesion and immigrants' integration, Spanish Society and its Public Administration should grant immigrant children full access to education and vocational and professional training, at least on an equal footing with Spanish nationals. Furthermore, there are strong reasons to consider the creation and deployment of a pull of services aimed at granting children quick access to education and vocational training in certain situations, independently of their legal status. At present, apart from a Constitutional Court decision allowing minors in administrative irregularity to accede to these services, Spanish legislation is not clear about their rights. Without a solid legal basis, Regional and Local Administrations are reluctant to adapt their educative systems to integrate immigrant young people and to promote the acquisition of the necessary professional skills to accede to the labour market and, eventually, regularize their administrative status ; En aras de una mayor cohesión social así como para lograr una adecuada integración de la inmigración, la sociedad española y sus poderes públicos deberían asegurar el acceso de los jóvenes inmigrantes a la educación y formación profesional en igualdad de condiciones que los nacionales. Son estas, junto con otras, importantes razones para estimular la creación y prestación de un conjunto de servicios dirigidos a garantizar el acceso a la educación y la formación profesional de los jóvenes extranjeros, independientemente de su situación administrativa regular o irregular. Actualmente, y a pesar de las sentencias del Tribunal Constitucional abriendo el acceso a menores en situación irregular al sistema educativo y al conjunto de servicios educativo-formativos vinculados al mismo, la legislación española sigue moviéndose en una cierta indefinición. Sin una base jurídica sólida, no es extraño que las administraciones autonómicas y locales se resistan a adaptar sus sistemas educativos para integrar plenamente a los jóvenes inmigrantes, de manera que éstos puedan adquirir lo más rápidamente posible las competencias y habilidades profesionales necesarias para acceder al mercado de trabajo en condiciones adecuadas, y en su caso, incluso regularizar su situación administrativa

La reforma propuesta de la Ley de Extranjería tiene un alcance limitado lo que pone en duda su oportunidad en un momento de crisis económica.

This research article is based on the political intervention that the Liberal-Conservative elites had in Barranquilla in 1905, in the conformation of the Department of Atlántico during the five-year period of Rafael Reyes 1904 - 1909. The objective of this article is to demonstrate which political interests led the local elite to create and form that Department. This work contains four sections that respond to the historical contexts from the end of the 19th century to the first decade of the 20th century. The first two include the project of territorial reform, the commercial emergence that Barranquilla had in the last nineteenth decade and finally, a brief preview of the intervention of the political elites. The antecedents were approached within a historical correlation at the national, regional and local levels. The other two sections contemplate the political influences of the Reyes government in Barranquilla, and the law that formulated the creation of the Department of Atlántico in 1905, its interruption in 1908 and finally its restoration. ; El presente artículo de investigación está basado en la intervención política que tuvieron las élites Liberales – Conservadoras en Barranquilla para 1905, en la conformación del Departamento del Atlántico durante el quinquenio de Rafael Reyes 1904 – 1909. El objetivo de este artículo es demostrar cuales fueron los intereses políticos que conllevaron a la élite local a crear y formar dicho Departamento. Este trabajo contiene cuatro apartados que responden a los contextos históricos desde finales del siglo XIX hasta la primera década del siglo XX. En los dos primeros se incluyen el proyecto de la reforma territorial, el surgimiento comercial que tuvo Barranquilla en la última década decimonónica y por último, un breve avance de la intervención de las élites políticas. Los antecedentes se abordan dentro de una correlación histórica en lo nacional, regional y local. Los otros dos apartados contemplan los influjos políticos del gobierno de Reyes en Barranquilla, y la ley que formuló la creación del Departamento del Atlántico en 1905, la interrupción de este en 1908 y finalmente su restauración.

International audience ; El papel de las organizaciones de la sociedad civil en América Latina ha sido ampliamente analizado; sobre todo en relación a su aportación en la transición a la democracia de países, como Chile, Argentina, Paraguay y Brasil, o México. La mayor parte de la atención se ha centrado en su papel como promotoras de la participación ciudadana. Sin embargo, se le ha prestado menos atención a las estrategias de movilización política que siguen las organizaciones no gubernamentales (ONG) para intentar influir en el resultado final de las políticas públicas; a estos efectos, existen diversos análisis que se centran en casos individuales y que impiden hacer generalizaciones. Entre las estrategias de movilización política se encuentra el litigio estratégico, que ha sido menos analizado aún que otras estrategias como las campañas mediáticas. Con el objetivo de contribuir al conocimiento que existe sobre este tema, en este artículo analizamos tres casos de movilización legal de ONG en Argentina, México y Colombia, que buscan el correcto despliegue y ejecución de las leyes que defiende los derechos de salud y el control del consumo del tabaco, o bien que buscan impedir un retroceso en los derechos ya ganados por la ciudadanía, en este caso el derecho a la salud. Los tres casos demuestran laimportancia del marco legal que constituye la estructura de oportunidad utilizada por las ONG para defender derechos de los ciudadanos, así como la importancia de otros factores organizativos como la existencia de una red transnacional de ONG con experiencia previa que apoyan este tipo de políticas y de otros actores políticos capaces de crear más presión para que el tema entre en la agenda política.

Hace tiempo que Europa se viene desnudando de sus valores fundacionales, muchos de ellos desde hace tiempo por los suelos donde son pisoteados según las necesidades de los Estados. El Plan de Acción conjunto acordado entre los gobierno de la UE y Turquía en la madrugada del 8 de marzo es un ejemplo más del retroceso de Europa y su hundimiento en el fango de la xenofobia, el egoísmo, la insolidaridad y el nacionalismo identitario europeo. Pero ese fango no surge de la nada.

With data from the World Bank Enterprise Survey, this paper examines how firm-level resilience capabilities interact with government support in the reduction of lay-offs among formal firms in Central America. We estimate two latent variables to approximate resilience-related capabilities before (static) and after (dynamic) the COVID-19 pandemic. We create four counterfactual groups using a Markov chain Monte Carlo simulation to assess which resilience capabilities help firms cope better, with and without government support. We find that support policies play a marginal role among most groups, except in the dynamic resilient group, where receiving government support does shrink the probability of lay-offs.

CMS collaboration: et al. ; The CMS detector at the CERN LHC features a silicon pixel detector as its innermost subdetector. The original CMS pixel detector has been replaced with an upgraded pixel system (CMS Phase-1 pixel detector) in the extended year-end technical stop of the LHC in 2016/2017. The upgraded CMS pixel detector is designed to cope with the higher instantaneous luminosities that have been achieved by the LHC after the upgrades to the accelerator during the first long shutdown in 2013–2014. Compared to the original pixel detector, the upgraded detector has a better tracking performance and lower mass with four barrel layers and three endcap disks on each side to provide hit coverage up to an absolute value of pseudorapidity of 2.5.
