En el presente artículo se examina el cometido de protección y de asistencia en favor de los refugiados en caso de conflicto armado y de disturbios interiores. Es un modesto intento de elucidar el enmarañado conjunto de cometidos y mandatos de las instituciones humanitarias, en particular del Movimiento Internacional de la Cruz Roja y de la Media Luna Roja (en adelante el Movimiento) y de la Oficina del Alto Comisionado de las Naciones Unidas para los Refugiados (ACNUR). La finalidad es reevaluar la evolución del cometido respectivo y su extensión. Por un lado, es necesario definir principios concretos, basados en las prácticas pasadas y presentes, por lo que atañe a la acción humanitaria y, por el otro, se debe dejar un suficiente margen de flexibilidad y de pragmatismo con respecto a las situaciones que no pueden preverse de manera completa.Al final del artículo se demuestra la interdependencia y la complementariedad de las organizaciones humanitarias que han de prestar protección y asistencia donde ningún organismo pueda actuar.

Cet article se propose d'examiner les mandats qui sont exercés en matière de protection et d'assistance aux réfugiés dans les cas de conflits armés et de troubles intérieurs. Il essaie modestement d'établir des distinctions dans les rôles et les mandats des organes humanitaires, qui souvent se ressemblent et se recoupent, en particulier pour le Mouvement international de la Croix-Rouge et du Croissant-Rouge (le Mouvement) et le Haut Commissariat des Nations Unies pour les réfugiés (HCR). Il voudrait également redéfinir l'évolution de leur mandat et en déterminer l'extension. Les principes de l'action humanitaire, fondés sur la pratique passée et présente, ont certes besoin d'être clairement définis, mais il faut laisser jouer la souplesse et le pragmatisme là où n'existe aucun pronostic d'ensemble. La conclusion montrera l'intrdépendance et la complémentarité des organisations humanitaires qui ont à apporter protection et assistance dans les situations où aucun autre organe n'est en mesure d'agir.

This article examines the mandate to protect and assist refugees in armed conflicts and internal disturbances. It is a modest attempt to clarify the web of overlapping roles and mandates of humanitarian bodies, in particular the International Red Cross and Red Crescent Movement ("the Movement") and the Office of the United Nations High Commissioner for Refugees (UNHCR). It purports to re-assess the evolution of their mandate and its extension. On the one hand, there is a need to define concrete principles, based on past and present practice, for humanitarian action. On the other, there must be sufficient leeway for flexibility and pragmatism in situations for which there is no comprehensive prognosis. The article concludes by demonstrating the interdependence and complementarity of humanitarian organizations which have to proffer protection and assistance where no other body can act.
