It is generally accepted that, in actions in personam, the foundation of the court's jurisdiction at common law is the service of process.1 To this extent the rules as to service define the limits of the court's jurisdiction. So, for a claimant to establish the jurisdiction of the English court over an overseas company2 he must be able to serve process on the company in accordance with the rules of service. The general rule is that an overseas company, like an individual, may be served with process in England if present within the jurisdiction.3 However, since a company is only a legal (not natural) person, it cannot be present in the same way as an individual. It has therefore been necessary for special rules to be laid down by which it can be determined whether or not an overseas company is present in England and therefore may be served with process here. Before 1992 those rules were contained in sections 691 and 695 of the Companies Act 19854 (the pre-1992 regime). However, in 1992 the law was amended and a separate provision was laid down in section 694A of the Companies Act 1985 to regulate the service of process on any overseas company with a branch in Great Britain (the 1992 regime).

El presente artículo reconstruye la historia del Partido Comunista Peruano-Bandera Roja en la ciudad de Ayacucho, a partir de los recuerdos personales de sus militantes, que confluyen en una memoria emblemática del grupo político. A través de dichos recuerdos, penetra en la historia del colectivo e identifica su principal característica. Así, Bandera Roja fue en Ayacucho un grupo de amigos, parientes y vecinos agrupados en torno a una ideología, pero sobre todo alrededor de un caudillo o líder carismático que actuaba como padre de una familia con hijos políticos. Dicho colectivo contó con una efímera base campesina y barrial, que se esfumó cuando el partido realizó un viraje ideológico al finalizar la década de 1970, sin poder convertirse en un adecuado canal de intermediación para con el Estado peruano.
This paper reconstructs the history of the Peruvian Communist Party-Red Flag in the city of Ayacucho, from the individual memories of its militants. Individual memories that come together in a sole emblematic memory of the party. Through these memories, this paper penetrates the history of the group and identifies its main characteristic. Thus, in Ayacucho, Red Flag was a group of friends, relatives and neighbors gathered around an ideology but, above all, around a caudillo or charismatic leader who acted as the father of a family with political children. This group had an ephemeral peasant and neighborhood base, which disappeared when the party took an ideological turn at the end of the 1970s, without being able to become an adequate channel of intermediation with the Peruvian State. ; El presente artículo reconstruye la historia del Partido Comunista Peruano-Bandera Roja en la ciudad de Ayacucho, a partir de los recuerdos personales de sus militantes, que confluyen en una memoria emblemática del grupo político. The Constitution of the Bolivarian Republic of Venezuela in its Transitory Provisions established that within the first year, starting from its installation, the National Assembly should approve the reform of the LOT. The arrears of Parliament to comply with the constitutional mandate has been extended in time, initiating the debate on this subject in 2002 with the introduction of a reform project, approved in first reading in June 2003, whose passage to the second discussion not successfully completed. In late 2009, amid deep conflicts of interests of the sectors involved and the adoption of legislative reforms to strengthen the national significance of the model XXI Century Socialism promoted by President Chávez, the deputies representing the Standing Committee on Developing. Comprehensive Social fidel, known unofficially, a working paper that exceeds the constitutional guidelines for tuning the native labor law framework to the new socioproductive scheme which currently governs the country. We developed a descriptive documentary research, which aims to systematically noted the partnership between the variables under study, analysis and interpretation of the current nature and composition of both the processes and internal and external relations of the phenomena associated with it. The tendency to impose the Reformation of the LOT strengthens the active participation of workers in the management of the processes carried into the workplace, stresses the protectionist nature of Venezuelan labor law and deviates from the trend flexibilization hosted by the native legal framework adopted in 1997, in order to adjust the text to the new figures, demands and requirements demanded by the Bolivarian Revolution, which undoubtedly has penetrated all Venezuelan institutions. ; La Constitución de la República Bolivariana de Venezuela, en sus Disposiciones Transitorias, estableció que dentro del primer año, contado a partir de su instalación, la Asamblea Nacional debía aprobar la reforma de la LOT. La mora del Parlamento en cumplir con el mandato constitucional se ha extendido en el tiempo, iniciándose el debate sobre este tema en el año 2002, con la presentación de un Proyecto de Reforma, aprobado en primera discusión en junio de 2003, cuyo paso a segunda discusión no culminó con éxito. A finales de 2009, en medio de profundos conflictos de intereses de los sectores involucrados, y de la aprobación de reformas legislativas con trascendencia nacional para consolidar el modelo del Socialismo del Siglo XXI promovido por el Presidente Chávez, los diputados representantes de la Comisión Permanente de Desarrollo Social Integral presentaron, conocido extraoficialmente, un papel de trabajo que supera los lineamientos constitucionales, buscando sintonizar el marco jurídico laboral patrio al nuevo esquema socioproductivo que actualmente rige en el país. Se desarrolló una investigación de tipo documental descriptiva, cuyo objetivo fue señalar en forma sistemática las relaciones de asociación entre las variables objeto de estudio; el análisis e interpretación de la naturaleza actual y composición, tanto de los procesos como de las relaciones internas y externas de los fenómenos vinculados a ella. La tendencia a imponerse con la Reforma de la LOT afianza la participación protagónica de los trabajadores en la gestión de los procesos llevados dentro de los centros de trabajo, recalca el carácter proteccionista de la legislación laboral venezolana y se aparta de la tendencia flexibilizadora acogida por el marco jurídico patrio aprobado en 1997, a fin de adecuar el texto a las nuevas figuras, demandas, y requerimientos exigidos por la Revolución Bolivariana, que sin duda alguna ha ido penetrando toda la institucionalidad venezolana.

El presente trabajo estudia el caso de Francisco Buendía, un poblador de la microcuenca de San Miguel, en la provincia de La Mar (Ayacucho), desaparecido por Sendero Luminoso en 1984. A partir de la propuesta teórica de Stathis N. Kalyvas, reconstruye las dinámicas locales subyacentes al caso, que se engarzaron con el conflicto armado interno. Para encontrar dichas dinámicas, recurre a los recuerdos y silencios de los familiares y a la información que revelan los documentos notariales y judiciales y que la memoria precisamente intenta esconder. Muestra que las dinámicas locales contienen disputas que tienen que ver con el proceso de reestructuración de la tierra que en la localidad viene desde el siglo XIX. Dichas disputas finalmente devinieron en políticas, ocasionando la desaparición del referido Buendía.
