"The case for a new offence describes the nature and size of the problem of strangulation in family violence circumstances. The key problems are that it's seriousness is under-recognised and it tends to be prosecuted as a minor offence, particularly of 'male assaults female' which carries a maximum penalty of only two years imprisonment. Of particular note, strangulation in family violence circumstances is associated with a significantly increased risk of a future fatal attack on the victim. The report analyses the case for a new, specific offence of strangulation, including an examination of alternative options to address the problems. It recommends that a new offence of strangulation should be enacted."--Publisher information
