Lack of cooperation and compliance with the International Criminal Tribunal (ICTY) was one of the biggest obstacles to Serbia's integration into Euro-Atlantic political structures following the overthrow of Miloševic. By scrutinising the attitudes of the Serbian authorities towards the ICTY and the prosecution of war crimes, Ostojic explores the complex processes set in motion by the international community's policies of conditionality and by the prosecution of the former Serbian leadership in The Hague.

This paper demonstrates that the interests of American banking and government have converged after the early 1980s and relates this trend to modern financial deregulation, revealing a symbiosis that would later influence the global financial crisis of 2007-2008. An examination of corporate profit and taxation in the United States reveals an anomaly: from the early 1980s until the financial crisis, banking profits after tax sharply outpaced those of the corporate average despite their effective tax rates having simultaneously increased relative to those of the corporate average. These conditions thereby created a mutually beneficial relationship between American banking and government in which banks earned higher profits and the government earned higher tax revenues. However, this tax arrangement ultimately depended on unsustainably deregulated banking profits, and fell apart during the financial crisis of 2007-2008.

This paper maps an empirical history of corporate profit and taxation in the United States, with a special focus on the differential profit and taxation of banks relative to other corporations. An examination of these trends reveals a striking anomaly within the American banking sector: from the early 1980s until the financial crisis of 2007-2008, its after-tax profits sharply outpaced those of the corporate average despite its effective tax rates having simultaneously increased relative to those of the corporate average. This curious combination of improved differential performance and an increased differential tax burden may have been due to banking deregulation – strong enough to boost pre-tax profits so much that they more than offset the effects of increased taxation and also raised after-tax profits along the way. In addition, these trends reveal a convergence of interests between American banking and government, with the former earning higher profits and the latter earning higher tax revenues. L'impact du Tribunal pénal international pour l'ex-Yougoslavie (TPIY) a été principalement évalué en fonction de sa contribution à la paix et à la réconciliation dans la région. Cet article offre une perspective différente en explorant les effets des politiques de conditionnalité associées au TPIY sur la consolidation démocratique en Serbie. Dans son analyse, l'auteur avance que l'imposition du droit pénal international sur des États récalcitrants peut entraver la stabilité démocratique et saper les objectifs de la justice transitionnelle dans les pays concernés. Dans le contexte d'une transition fragile et incertaine, les autorités serbes ont dû concilier les exigences et les priorités du TPIY avec celles de différents groupes d'intérêts nationaux.
