El Semestre Europeo ha venido siendo el cauce a través del cual se ha aplicado la
Gobernanza Económica de la Unión Europea. En el período más reciente, al calor del
auge de los diferentes mecanismos soft law, ha ido también incorporando objetivos
y métodos de seguimiento propios de otros ámbitos, sin que la vertiente económica
haya perdido fuerza por ello. Así, el Semestre también incluye una evaluación de la
manera en que los Estados miembros están cumpliendo los Objetivos de Desarrollo
Sostenible de las Naciones Unidas. En el mismo sentido, tras la proclamación en 2017
del Pilar Europeo de Derechos Sociales, el Semestre Europeo también proporciona
un marco de coordinación y supervisión de los esfuerzos de los Estados miembros
por cumplir sus principios articuladores. Al modo en que esto se ha llevado a cabo
y a cómo se interrelacionan Semestre, Gobernanza y Pilar dedicaremos el presente
trabajo.
La crisis sanitaria derivada de la pandemia de COVID-19 ha colocado al mundo en una tesitura que no se veía desde la de la mal llamada "gripe española". Sus consecuencias económicas y sociales no son tampoco menores. La paralización de la economía está teniendo un efecto notable sobre el empleo. Ante tal situación los Estados se han visto obligados a adoptar medidas extraordinarias, en especial, en materia de protección frente al desempleo. Esto se va a traducir, lógicamente, en importantes incrementos del gasto, de la deuda y del déficit públicos. El problema que nos podemos encontrar después es que esta situación derive en ataques especulativos como consecuencia de nuestra debilidad económica. De ahí la importancia de la intervención europea. Varias son las propuestas que hay en estos momentos encima de la mesa, como los llamados "coronabonos", el Plan de recuperación para Europa, la reorientación del MEDE o el que es objeto del presente estudio, el instrumento europeo de apoyo temporal para atenuar los riesgos de desempleo en una emergencia (SURE). Para abordarlo, centraremos las páginas que siguen en, para empezar, enmarcar el mencionado instrumento dentro del debate en torno a la articulación de una prestación por desempleo para la Unión. A continuación, estudiaremos sus elementos configuradores básicos, entroncándolos en tres vectores de análisis: su naturaleza excepcional, su carácter temporal y su finalidad financiera. Por último, cerraremos el estudio con unas breves conclusiones sobre la implicación política y jurídica que la puesta en marcha del SURE supone y qué proyección de futuro podría tener. ; The health crisis arising from the COVID-19 pandemic has placed the world in a situation not seen since the so-called "Spanish flu". El libre comercio se ha situado en el centro del debate político. La renegociación de algunos tratados comerciales o la llamada "guerra comercial" con China quizá sean los ejemplos más paradigmáticos. Aunque los motivos que explican esta situación son muy variados, no debe perderse de vista que aunque el comercio produzca beneficio neto, también genera externalidades negativas en el plano social y laboral que es preciso compensar mediante la adopción de instrumentos adicionales adecuados y eficaces. Entre éstos destacan la incorporación de cláusulas laborales a los tratados de libre comercio, en cuya virtud se garantizan unos estándares mínimos (frecuentemente los marcados por los convenios de la OIT) entre las partes firmantes. El objeto de este trabajo es analizar hasta qué punto estas cláusulas están cumpliendo la función que tienen encomendada, en qué medida contribuyen a alcanzar el objetivo de trabajo decente y sostenible y cuál es el rol que los agentes sociales pueden jugar a este respecto. ; Free trade has been placed on the centre of the political debate. The renegotiation of certain trade agreements or the so-called "trade war" with China maybe are the most important examples. Despide the reasons of this situation are varied, it must take into consideration that in spite of the fact that free trade produces beneficial effects, it also generates negative externalities social and working conditions which must be compensated on by the adoption of some parallel instruments. The paper focused on one of these tools, the labour provisions included in trade agreements, which aims to guarantee certain minimum labour conditions (frequently set by ILO's conventions) among the parties involved. The main objective is to analyse to what extense they are working properly and contributing to achieve the objective of decent and sustainable work and which role the social partners can play concerning it.

Tras la crisis más devastadora desde la década de los 30, atravesamos un nuevo escenario econó-mico y político propicio no solamente para la reversión de buena parte de los recortes aplicados en políticas sociales, sino para progresar en el desarrollo de un Estado del Bienestar avanzado.Los llamados "viernes sociales" y los Reales Decretos-Leyes que de ellos han resultado invitan a pensar que nos adentramos en esa senda y que, por consiguiente, iniciamos un nuevo ciclo para las políticas sociales en nuestro país. Sin embargo, al menos del análisis de las medidas en materia de protección social del RDL 8/2019, no puede decirse que hayamos ido tan lejos. El presente estudio analiza esta batería de propuestas prestando especial atención a la medida es-trella, la reforma del subsidio de prejubilación o, ahora, de nuevo, para mayores de 52 años. En concreto, abordaremos en qué medida nos encontramos ante un auténtico cambio de ciclo, nos de-tendremos en las modificaciones introducidas en el mencionado subsidio, realizaremos un análisis sucinto del resto de acciones en materia de protección social, para concluir con algunas reflexiones acerca de en qué medida las políticas sociales están sabiendo adaptarse a los nuevos tiempos y de qué forma pueden encarar los retos que plantea el período post-crisis. ; Following the most devastating crisis since the 1930s, we are going through a new economic and political scenario conducive not only to the reversal of much of the cuts applied to social policies, but to progress in the development of a state of Advanced Wellness. The so-called "social Fridays" and the Royal decrees-laws that have resulted from them invite us to think that we are entering that path and that, therefore, we begin a new cycle for social policies in our country. However, at least the analysis of the social protection measures of RDL 8/2019, it cannot be said that we have gone so far. The present study analyses this battery of proposals paying special attention to the star measure, the reform of the preretirement subsidy or, now, again, for over 52 years. In particular, we will deal with the extent to which we are faced with a genuine change of cycle, we will stop in the amendments introduced in the aforementioned subsidy, we will undertake a concise analysis of the rest of social protection actions, to conclude with some reflections on the extent to which social policies are knowing how to adapt to the new times and how they can address the challenges posed by the post-crisis period

Las llamadas empresas multiservicios se encuentran en el centro del debate político y social debido a su vinculación con diversos tipos de precariedad. Ello se explica, se dice, por su tendencia a escapar de la regulación del convenio colectivo de la empresa principal. A pesar de que el salario y la jornada son las condiciones de trabajo más frecuentemente afectadas, el abuso en la utilización de contratos temporales es también mencionado por la doctrina como otra vía de degradación. Este trabajo analiza si existe base empírica para esta última afirmación y el modo en que la negociación colectiva de este tipo de empresas está afrontando el problema de la temporalidad. ; Multi-utility companies, those whose provide different kinds of services to other companies, are on the core of both social and political debate. They are frequently shown as source of precariousness owed to usually skip from the collective bargaining agreements of the companies they serve. Despite salary and working time are the most frequent working conditions affected, the massive use of fixed-term contracts is usually mentioned by the legal literature. The first Great Repression of the 21st cen- tury, from 2007 to 2013, which saw the collapse of the most important economies in the world, had significant consequences, including high unemployment rates. In the case of the EU and the Eurozone, some particular difficulties had to be overcome, which made the crisis even deeper. The so- called "Eurozone crisis" arrived when several countries assumed private debts from their bailed-out banks. Hence, it start- ed the second part of the depression char- acterized by the difficulties of these states to repay or refinance their own sovereign debt. The special state of development of the Eurozone contributed in reinforcing the crisis, because some structures had not been worked out and the traditional nation- al tools linked to the monetary policy were no longer available. In this context, the proposal of the Europe- an Unemployment Benefit Scheme (EUBS) was raised. On the one hand, it would act as an automatic stabilizer, that is, giving the Eurozone those kinds of macroeco- nomic policies to fight against the effects of crisis whose lack reinforced it. On the other hand, it would allow a human face of the European economic governance to be shown, revitalising the social spirit of the European project. This article analyses the general framework of this proposal from an interdisciplinary perspective, highlighting his pros and cons and the different varieties which have been introduced. The first Great Repression of the twenty-first century, which collapsed the most important economies in the world since 2007 to 2013, has produced a number of important effects, including high unemployment rates. In the case of the EU and the Eurozone, some particular difficulties had to be overcome, what made the crisis even deeper. The so-called «Eurozone crisis» arrived when several countries assumed private debts from their bail outed banks. Hence, it started the second part of the depression characterized by the difficulties of these states to repay or refinance their own sovereign debt. The special state of development of the Eurozone contributed to reinforce the crisis, because some structures hadn't been developed and the traditional national tools linked to the monetary policy were no more available. This produced a new phase within the recession, in which the so-called austerity measures played a central role. Without other alternatives and in exchange of financial help, these European countries were forced to reduce their budget deficits severely. The final result was more crisis, higher unemployment and an increasing anti-Europeism feeling all over Europe. In this context, the proposal of European unemployment benefit raised. On the one hand, it would act as an automatic stabilizer, that is, giving the Eurozone those kinds of macroeconomic policies to fight against the effects of crisis whose lack reinforced it. On the other hand, it would permit to show the human face of the European economic governance, revitalising the social spirit of the European project. This paper aims to give a first approach to the basic characteristics of this proposal. It will be divided as follows. Firstly, the economic background of the proposal will be explained in order to highlight what kind of objectives are followed. Second, the basic lines of the different alternatives will be analysed. Ante las insuficiencias de los sistemas normativos tradicionales, la búsqueda de soluciones alternativas y «flexibles» por parte de los propios sujetos implicados se viene abriendo paso. This transformation has affected very different fields and drives to the phenomenon known as Globalization. Regarding labour issues, two successful and parallel circumstances have taken place. En virtud de un pacto parlamentario, el Gobierno incrementará el salario mínimo interprofesional (SMI) un 8% en 2017, hasta los 707,60 euros. Tras casi diez años sin subidas o con crecimientos mínimos, el incremento anunciado será uno de los mayores de las últimas tres décadas. Esta novedad ha hecho resurgir el debate acerca de los efectos económicos y sociales del salario mínimo. Este artículo aborda este debate, analizando los diferentes puntos de vista acerca del SMI desde una perspectiva tanto jurídica, como económica. Para ello, se divide como sigue. Tras una breve introducción, en el apartado segundo se analizará su regulación jurídica y los factores determinantes para su fijación. A continuación, en el apartado tercero se estudiará cuál es la situación de España comparativamente con otros Estados próximos, así como las principales teorías acerca de su impacto en el mercado de trabajo y los resultados empíricos alcanzados. ; Thanks to a political agreement, the Government will raise the minimum wage by 8% in 2017, up to 707.60 euros. After almost ten years without or with minimum changes, this will be one of the highest increase since the last three decades. This novelty has relaunched the debate about the economic and social effects of the minimum wage. This article focuses on this discussion, analysing the different points of view regarding this issue from a legal and an economic point of view. It is divided as follows. After a brief introduction, section two will study its basic regulation and the variables taken into account in order to determine it. After that, section three will analyse the different theories on the impact of minimum wage on labour market and the main empirical results. Sin lugar a dudas, la última crisis económica se ha dejado notar de forma muy significativa en los mercados de trabajo de buen parte de los países del mundo. Mientras el desempleo crecía de forma alarmante, especialmente en las economías más desarrolladas, los gobiernos trataron de encontrar soluciones para este importante problema social, especialmente en relación a aquellos colectivos que mayores dificultades de acceso al empleo presentaban. Entre estos grupos tradicionalmente ha ocupado un lugar central el de las mujeres. Este capítulo se dedicará a analizar los efectos de esta crisis sobre la empleabilidad de las mujeres. En este sentido, se prestará especial atención a los diferentes instrumentos que desde el Derecho se ofrecen para luchar contra el paro y el modo en que son capaces de adaptarse a las especiales características del desempleo femenino. Veremos que estas herramientas están basadas en las principales explicaciones que desde la Economía se han dado al fenómeno del paro y que muestran una capacidad de adaptación muy diversa en relación a la particular posición de las mujeres en el mercado de trabajo. Para alcanzar este objetivo, dividiremos el capítulo de la siguiente forma. Tras una breve introducción que se centrará en analizar el modo en que la crisis ha afectado al empleo de las mujeres en comparación con el resto de la sociedad, analizaremos las diversas políticas de empleo presentes en todos los ordenamientos jurídicos con el objetivo de crear empleo. En particular, se prestará especial atención al modo en que éstas se modulan para adaptarse a las concretas necesidades de las mujeres desempleadas. Tras ello, se analizará detenidamente el tipo de política de empleo que muestra una mayor capacidad de adaptación para resolver estos problemas. Finalmente se cerrará el trabajo con unas breves conclusiones. ; One of the most important effects of the last financial crisis has been its impact on labour markets all over the world. Whereas unemployment rate rocked in most countries, governments tried to find solutions to this huge problem, especially for those groups with more difficulties. Traditionally, women have been one of the collectives who have received more attention. This chapter analyses the effects of the crisis on the employability of women. Additionally, it will pay attention to the different tools offered by the law in order to fight against unemployment and how they adapt to the special circumstances of unemployed women. These instruments are based on the diverse economic explanations to the unemployment phenomenon and show different capabilities in order to solve the employment problems of women after the downturn. In order to address this issue, the article is divided as follows. After a brief introduction focused on the impact of the crisis on female unemployment compared to the rest of population, it will analyse the diverse employment policies offered by all legal systems which aims to create employment. It will pay attention to their adaptation to women's circumstances specifically. After that, it will analyse the tool which shows the greatest capability of adaptation to solve problems related to female unemployment.
