ABSTRACT: This essay explores the intersection of religious symbols and judicial populism, focusing on the case-law related to the kirpan in Italy and Canada. In an era of rising populism, religious symbols become political tools, creating an "us-versus-them" narrative. The kirpan, a Sikh ritual dagger, can serve as a case-study for judicial populism, examining contrasting approaches in Italian and Canadian case-law. Italian case-law prioritizes public safety over religious freedom, while Canadian case-law adopts a nuanced approach, accommodating the wearing of the kirpan under some conditions. The kirpan's legal ambiguity highlights the tension between religious freedom and public safety, reflecting the broader challenges of recognizing different identities in a multicultural society.

The U.S. motto "In God We Trust" in light of the history and tradition "of the First Amendment
ABSTRACT: This essay reflects upon the U.S. national motto "In God We Trust" and religious liberty. It describes the birth and the life of the U.S. national motto from an historical and a normative perspective, and in relation with three crucial events that forged the United States' historical conscience: the American Revolution, the Civil War, and the Cold War. It highlights how the motto has embraced different purposes and meanings, as well as attained varying levels of religiosity. After having introduced the main features of American civil religion, the paper pays attention to the various obiter that the Supreme Court has offered about the constitutionality of this symbol. The conclusions focus on two aspects: a brief comparison with the Italian legal system, which underlines the existing similarities between the "history and tradition" argument fostered by the U.S. Supreme Court and the appeal to the "historical heritage" and the "religious culture" that can be found in the Italian legal and political debates on the display of the crucifix in the classroom and the teaching of the Catholic religion. Secondly, they reflect about the ideological and illiberal turn that the American civil religion may take.

"Security, Religion, and the Rule of Law argues that true, substantive, and sustainable national security is only possible through respect for the rule of law, human rights, and religious freedom. Despite the emphasis on national security and the war on terror that has preoccupied governments for over two decades, nations-and the world-seem to be more divided than ever, with a concomitant impact of increasing the risk of terrorism and religious and political violence. The national security paradigm, previously reserved primarily for foreign threats, has been turned increasingly inwards, focussing on a state's own citizens as potential threats. This is often along religious lines, threatening fundamental human freedoms. This book provides a series of critical engagements on some of the most pressing issues at the interface of religion and security today, including: proposing a deeper engagement with theology when dealing with freedom of religious belief; exploring a better understanding between domestic peace and international relations; abiding by the rule of law while countering terrorism; and developing a broader understanding of identities and of the nature of citizenship. It provides the resources to further reflect upon and address these topics, as well as stimulating further discussions on religion and security matters across a range of different disciplines. Wide-ranging case studies consider Australia, China, Europe, the Kurdish people, Nigeria, Russia, Ukraine, the United Nations, and the United States. This book will appeal to students and scholars across a range of disciplines, including international relations, law, philosophy, political science, religious studies, security studies, and theology.
