This article discusses the political effects of two different conceptions of democracy in ethnically deeply divided societies. It considers the conflicts with clear historical roots by analysing the case of the Election Law of Bosnia and Herzegovina which involves two irreconcilable ideas of democracy expressed by the political elites of two communities, the Bosniaks and the Croats. The first part explains the conflict between Bosniak and Croat political elites, which have respectively, been trying to impose either the majoritarian or the consociational system since the 1990s. The second part discusses the decisions of the European Court of Human Rights and of the Constitutional Court of Bosnia and Herzegovina on electoral rules. It is argued that the imposition of integrationist-like rules and the suspension of consociational arrangements in the Election Law has increased divisions between the two ethnic communities. Finally, the article analyses the proposed amendments to election rules submitted to both state and entity parliaments, which confirm the existence of clearly irreconcilable visions of democracy within the Bosniak-Croat Federation. ; U članku se razmatraju politički učinci dvaju različitih shvaćanja demokracije u etnički duboko podijeljenim društvima na primjeru izbornog zakona Bosne i Hercegovine, a koje zastupaju političke elite bošnjačke i hrvatske zajednice u zemlji. U prvom dijelu članka objašnjava se sukob bošnjačke i hrvatske političke elite oko modela većinske i konsocijacijske demokracije koji traje od devedesetih godina 20. stoljeća. U drugom dijelu razmatraju se odluke Europskog suda za ljudska prava i Ustavnog suda Bosne i Hercegovine o izbornim pravilima. Tvrdi se da su institucionaliziranje centripetalističkih i suspendiranje konsocijacijskih aranžmana u izbornom zakonu povećali političke podjele među dvjema etničkim zajednicama. U trećem dijelu raspravlja se o prijedlozima izbornih pravila što su podastrijeti državnom i entitetskim parlamentima, koji potvrđuju postojanje nespojivih shvaćanja demokracije u bošnjačko-hrvatskoj Federaciji.

Rad istražuje kako proces europeizacije utječe na oblikovanje kolektivnih ‎kultura sjećanja i zaborava, te osobito pokazuje kako je institucionalizirana ‎praksa europskih institucija u pogledu sjećanja na Holokaust. Metodološki, ‎rad se usmjerava na istraživanja novoga institucionalizma te ih povezuje s nekim elementima socijalnog konstruktivizma u teoriji europske integracije. S ‎jedne strane, kultura sjećanja i kultura zaborava opisuje se djelovanjem europeizacijskih momenata u politici ne samo Europske unije već i njezinih država ‎članica u povijesno-institucionalnom razvoju, dok se interpretacija europskog ‎identiteta ostavlja otvorenom i pluralnom. Istraživanje se oslanja na brojne ‎radove iz područja konstrukcije europskog identiteta i procesa europeizacije, ‎osobito na radove koji su značajno doprinijeli ovom području političke teorije ‎europske integracije.‎‎

AbstractAfter the signing of the Dayton Agreement, critical literature has attempted to portray consociation in Bosnia and Herzegovina as the predominant source of the country's political problems. At the same time, this literature has widely neglected the centripetal rules that have existed since the first elections of the tripartite Presidency. The paper analyzes the outcomes of the existing centripetal cross‐ethnic vote pooling rules. It concludes that such outcomes are negative and it then discusses a possible solution by drawing inspiration from the application of the Bernese Jura's geometric mean. The paper focuses on the election of the Croat member in the tripartite Presidency as representative of the least numerous ethnic group. We argue that the application of the geometric mean based upon results in Croat‐majority municipalities could eliminate certain grievances and weakens the chances for election of the Croat member by voters from dominantly Bosniak areas.

Ovaj članak analizira razlike između konsocijacijske i centrifugalne demokracije, nudeći pojmovni pregled tih dvaju modela i uspoređujući ih na primjerima Švicarske i Bosne i Hercegovine. Po prvi se put modelu demokracije u Bosni i Hercegovini pripisuje pojam centrifugalne demokracije. Takvo određenje potvrđuje se analizom povijesnog razvoja institucija te analizom postojećih glavnih društvenih rascjepa i sukoba među političkom elitom. Razvoj konsocijacijske demokracije na primjeru Švicarske analizira se od 1848. godine, a centrifugalna demokracija u Bosni i Hercegovini od 1878. godine. U članku se također razmatraju "politički korektivi" koji stabiliziraju i aktivno usmjeravaju rad političkih elita u Švicarskoj i Bosni i Hercegovini. To su referendum i pučka inicijativa u prvom slučaju te prisutnost međunarodne zajednice u drugom slučaju. Zaključno se razmatra možebitni proces transformacije bosanskohercegovačkog poretka iz centrifugalne u konsocijacijsku demokraciju i oprimjeruje se potencijalnim inovacijama u institucionalnom dizajnu koje bi slijedile švicarski model. ; This paper analyzes differences between consociational and centrifugal democracy. It offers a conceptual framework for the two models and compares them through the Swiss and Bosnian Herzegovinian cases. For the first time, the concept of centrifugal democracy is attributed to the Bosnian-Herzegovinian model of democracy. This attribution is confirmed through an analysis of the historical institutional development, and of existing cleavages and conflicts among political elites. The development of Swiss consociational democracy is examined since 1848, while the development of Bosnian-Herzegovinian centrifugal democracy is assessed since 1878. The paper also considers "political correctives", which stabilize and direct the work of political elites in Switzerland and Bosnia and Herzegovina. These comprise referenda and popular initiatives in the first case and international community in the second case. The paper concludes with an assessment of a possible process of transformation of Bosnian-Herzegovinian centrifugal democracy into consociational democracy, and provides examples of potential institutional innovations that would follow the Swiss model.
