Contracts of carriage by air are standard-form contracts in which the passenger is considered to be a consumer. Hence, the regulations on consumer and user rights apply, that is, in Spain the consolidated text of the General Act for the Defence of Consumers and Users and other Complementary Acts, approved by Royal Legislative Decree No 1/2007, of 16 November. Practice has shown that general conditions of airlines frequently contain unfair terms. The present paper analyses existing case law on some of the clauses that allegedly restrict passenger rights, especially in Spain, where decisions are not always uniform.
Regulation (EC) No 1371/2007 of the European Parliament and of the Council, of 23 October 2007, on Rail Passengers' Rights and Obligations, contains the basic EU rules regarding the protection of passengers in rail transport, both on a domestic and an international level. Simi-larly to what happens in carriage by air (Regulation No 2027/1997, as amended by Regulation No 889/2002) and sea (Regulation No 392/2009), the Rail Passenger Regulation refers —in its Articles 4, 11 and 15— to an international Convention, the Uniform Rules concerning the Con-tract of International Carriage of Passengers by Rail (Appendix A to the 1999 COTIF Conven-tion). However, it introduces some additional rights that do not always fit easily into the frame-work designed by the Rules, especially as regards the liability of the carrier in case of delay, missed connections and cancellation. The only judgment of the European Court of Justice on this issue (Case C-509/11, ÖBB-Personenverkehr) addresses only part of the problem, in par-ticular, the compensation of the ticket price in case of delay. Furthermore, Regulation No 1371/2007 does not prohibit the existence of national measures that improve the passengers' protection, so domestic law has to be taken into account, too. In Spain, the relevant legislation was adopted in 2004 and has not been amended after the Regulation came into force, so some of its provisions are clearly inconsistent with the acquis communautaire. The paper seeks to describe the exact content of the passengers' rights under Regulation No 1371/2007 and to identify those domestic rules that cannot be applied any more since they are contrary to Euro-pean Union law and should therefore be repealed.
El Reglamento (CE) núm. 1371/2007, del Parlamento Europeo y del Consejo, de 23 de octubre, sobre los derechos y obligaciones de los viajeros por ferrocarril, representa la norma europea básica en materia de derechos del pasajero en transporte ferroviario, tanto doméstico como internacional. De forma similar a como sucede en el transporte aéreo (Reglamento núm. 2027/1997, modificado por el Reglamento núm. 889/2002) y marítimo (Reglamento núm. 392/2009), el Reglamento ferroviario remite - en sus arts. 4, 11 y 15- a un convenio internacional: las Reglas Uniformes relativas al contrato de transporte internacional de viajeros por ferrocarril (Apéndice A al COTIF 1999). El Reglamento, sin embargo, contempla algunos derechos adicionales del viajero que no siempre encajan con fa cilidad en el marco diseñado por dichas Reglas Uniformes, especialmente en lo que se refiere a las obligaciones del porteador en caso de retraso, enlaces perdidos y cancelación. La única sentencia del Tribunal de Justicia de la Unión Europea sobre este particular (as. C-509/11, ÓBB-Personenverkehr) resuelve el problema solo parcialmente, esto es, en relación a la compensación por el precio del billete en caso de retraso. Además, el Reglamento (CE) núm. 1371/2007 no prohíbe la existencia de medidas nacionales que mejoren la protección del pasajero, de manera que el ordenamiento doméstico ha de tenerse en cuenta también. Pero ello no es óbice para constatar que la legislación sectorial española fue adoptada en el año 2004 y no ha sido reformada después de la entrada en vigor del Reglamento comunitario, con la consecuencia de que algunos de sus preceptos son incompatibles con el acervo comunitario. The scientific and technological progress, the economic globalization and the liberalization of the air sector have meant that the Project of Latin American Aeronautical Code , approved by the ALADA General Assembly in 1985, has been largely obsolete. The present work makes a revision of the concept and classification of aircraft contained in said Project with the purpose of providing an updated regime and, at the same time, in accordance with international and comparative legislation ; La globalizzazione e la liberalizzazione del comparto aeronautico, il progresso scientifico e tecnologico, l'avvento di nuove macchine destinate al trasporto per aria di persone o cose o il perfezionamento quelle esistenti, sono alcuni tra fattori che hanno determinato l'obsolescenza del Proyecto de Código aeronáutico latino americano , aprobado por la Asamblea General de ALADA de 1985 . Il presente lavoro, sulla base della disciplina contenuta Proyecto del 1985 provvede alla revisione della nozione e all'ammodernamento della classificazione degli aeromobili, mediante proposte per un nuovo Proyecto che, nelle intenzioni dei compilatori del presente saggio, si dimostri, al tempo stesso, rispettoso della tradizione e conforme alla disciplna di diritto uniforme. ; El progreso científico y tecnológico, la globalización económica y la liberalización del sector aéreo han comportado que el Proyecto de Código aeronáutico latino americano, aprobado por la Asamblea General de ALADA de 1985 haya quedado en buena medida obsoleto. El presente trabajo efectúa una revisión del concepto y de la clasificación de las aeronaves contenidos en dicho Proyecto con la finalidad de proporcionar un régimen actualizado y, al mismo tiempo, acorde con la legislación internacional y comparada.
El rasgo distintivo de los puertos deportivos es que la costa y las aguas marítimas asociadas, los fondos marinos y el subsuelo se explotan económicamente para la construcción y uso de un puerto que proporciona servicios de turismo náutico. El presente trabajo analiza el régimen jurídico de los puertos deportivos en cuatro Estados mediterráneos miembros de la Unión Europea: Croacia, España, Italia y Malta. La característica común de todos ellos es que sus costas y puertos son bienes de dominio público marítimo, es decir, bienes extra commertium o de propiedad del Estado inalienables, sin que puedan ser de propiedad privada o de otros derechos reales. En consecuencia, la explotación económica del dominio marítimo solo es posible mediante concesión. Es en este contexto en el que los autores analizan las legislaciones de dichos Estados, su interpretación y aplicación, teniendo en cuenta, en particular, la influencia del derecho europeo y las sentencias del Tribunal de Justicia de la Unión Europea. ; The distinctive feature of nautical tourism ports is that the shore and associated sea area, seabed and subsoil are economically exploited for the construction and use of a port to provide services in nautical tourism. This paper presents and analyses legal regimes for nautical tourism ports in four Mediterranean countries, members of the European Union: Croatia, Spain, Italy and Malta. The common characteristic of these legal regimes is that their shores and ports are under the legal regime of a common or public maritime domain, i.e. either extra commertium or property owned by the state, but inalienable and incapable of being the subject matter of private ownership or other real rights. Consequently, the economic exploitation of the maritime domain is possible exclusively by means of concession. It is in this context that the authors analyse the applicable national legal rules, their interpretation and enforcement having in mind in particular the specific impact of the European Union rules and the case-law of the Court of Justice of the European Union. ; Le trait distinctif des ports de plaisance est que la côte et les eaux maritimes associées, les fonds marins et le sous-sol sont exploités économiquement pour la construction et l'utilisation d'un port fournissant des services de tourisme nautique. Cet article analyse le régime juridique des ports de plaisance dans quatre États méditerranéens, membres de l'Union européenne: la Croatie, l'Espagne, l'Italie et Malte. Leur caractéristique commune est que leurs côtes et leurs ports sont des biens appartenant au domaine public maritime, c'est-à-dire des biens extra commertium ou des biens inaliénables de l'État, sans pouvoir appartenir à des particuliers ni à d'autres droits réels. Par conséquent, l'exploitation économique du domaine maritime n'est possible que par concession. C'est dans ce contexte que les auteurs analysent les règles de droit national applicables, leur interprétation et leur application, en tenant compte notamment de l'incidence spécifique des règles de l'Union européenne et de la jurisprudence de la Cour de justice de l'Union européenne.
