In Europe, the rise of the regulatory state was accompanied by a broad diffusion of research on the processes of privatisation, liberalisation, and reregulation of utilities, previously managed directly by the state. This article offers an empirical and theoretical discussion of the paradigm of the regulatory state. It proposes to evaluate the transformation of the actual functions of the welfare state in a context of reforms of network industries over the last twenty years. Relying on cases from the electricity and railways sectors, it studies the changing balance between the traditional functions of the welfare state and the new regulatory functions introduced by the reforms. This article explains how, alongside the strengthening of regulatory functions, states maintained and developed powerful redistribution functions. The emerging regulatory state is not substituted for the positive/welfare state, but partly juxtaposed with it, making the structures for governing these sectors much less easy to read.

Résumé En Suisse, la mobilisation de l'eau en ville semble s'être faite concomitamment comme force motrice pour les ateliers (avant l'invention de l'électricité) et comme alimentation en eau ; la double clientèle a facilité la levée des fonds nécessaires à l'installation puis à la généralisation des réseaux, tout en stimulant, sous l'influence du modèle germanique, une culture de services industriels bien gérés par des municipalités puissantes en régime fédéral. Tout au long du xx e siècle, ces services industriels municipaux multiservices étendront progressivement leurs réseaux (notamment d'approvisionnement en eau potable et de traitement des eaux usées) dans les communes suburbaines et périurbaines, menant souvent à des concentrations sectorielles ou multisectorielles à l'échelle supra-communale. Cette montée en puissance et cette extension des grands services urbains municipaux de l'eau connaîtront une nouvelle étape sous la forme de leur participation au développement, à partir des années 1950, des grands barrages alpins, prolongeant ainsi dans les espaces montagnards les compétences en matière de mobilisation de l'eau comme force motrice acquises au début du xx e siècle dans les villes.

Meanwhile, firms have undertaken organizational reforms in order to promote commercial strategies and demand-side management. Based on a method of political sociology, this dissertation aims to analyze how the new strategies and practices of the different stakeholders i.e. State, local authorities, regulatory bodies, firms and consumer organizations tends to modify the users status. This is achieved through the construction of three theoretical figures of the user : the consumer, the customer and the citizen. The results underline that the deregulation reforms induce the domination of the consumer figure. This transformation can be illustrated by the rise of consumption issues such as cost and price transparency, performance assessment, quality standards and individual consumers protection. However, the domination of the consumer doesnt imply the exclusion of citizenship issues. Obviously, social and spatial cohesion, which were at the heart of the French model of public service built after WWII, are now seldom included in the claims of consumer groups. But, new issues are emerging quickly, focused on two main subjects : the environmental protection and the management transparency of municipal utilities. ; Depuis le début des années 1990, l'ouverture à la concurrence, les nouvelles normes réglementaires et la transformation du rôle de l'État et des collectivités locales ont mis en cause les modèles historiques de régulation des services d'eau, d'électricité et de télécommunications, en accordant une place centrale à la relation marchande. En parallèle, les entreprises se sont lancées dans de profondes réformes organisationnelles afin de promouvoir de nouvelles logiques commerciales et gestionnaires et de renforcer le degré de prise en compte des attentes des clients. En se fondant sur une démarche de sociologie politique, l'objet de la thèse est d'étudier comment les nouvelles stratégies et pratiques des acteurs du système de régulation État, collectivités locales, autorités de régulation, entreprises, associations de consommateurs tendent à modifier le statut de l'usager. Pour cela, une grille d'analyse a été élaborée grâce à la construction de trois figures théoriques de l'utilisateur : le consommateur, le client et le citoyen. Les résultats soulignent que les réformes et les mutations des services de réseaux entraînent une domination de la figure du consommateur. Le passage de l'usager au consommateur s'illustre par la prégnance croissante du référentiel consumériste : vérité des prix, évaluation des performances, standards de qualité, dispositifs de protection du consommateur individuel. Cependant, la domination du consommateur ne se traduit pas par une exclusion des enjeux de citoyenneté. Certes, les problématiques de cohésion socio-territoriale ne sont pratiquement plus présentes parmi les revendications des usagers, alors quelles constituaient le cœur du modèle de service public bâti après-guerre. Mais de nouveaux enjeux émergent parfois rapidement autour de deux thématiques : la transparence de gestion des services urbains et la protection de l'environnement.

AbstractPerformance reporting in sunshine regulation is subjected to disclosure biases, because agents may game the regulation or encounter difficulties in complying. These biases limit the appraisal of the impact of sunshine regulation on performance. We investigate the behavioral causes of such disclosure biases by focusing on transaction cost economizing and opportunism. We provide an original methodology to take into account information asymmetries in principal–agent relationships. We focus on water utilities management in France. Our data set includes 795 observations covering water utilities and performance indicators characteristics. It allows for comparisons of revealed and observed performances and identifies different types of disclosure biases. Findings indicate that opportunism is a significant motivation for disclosure biases, while, unexpectedly, transaction costs are not a direct trigger of disclosure biases.

Since the 2000s, facing the increasing globalization and commodification of common-pool resources, community-based organizations managing water and forests at the local scale started to create transnational networks. Their main goal is to get a direct representation in international decision-making arenas, as to promote their model of community-based governance and transform existing norms. Two main strategies to impact the norm-building process are the reframing of the resources essence (from market goods to human rights or commons…) and the claim on appropriate scales of governance for these resources (local, regional, global…). In this global context, to what extent the reframing of water and forests essence by transnational community-based networks impacts their respective scales of governance? The paper aims to answer this interrogation using transnational political sociology and discourse analysis. The analysis relies on two case studies: the Latin-American Confederation of Community Organizations for Water Services and Sanitation (CLOCSAS), and the Mesoamerican Alliance of Peoples and Forests (AMPB). From one side, CLOCSAS is framing water as a global common and a universal human right, in order to become an alternative international expert on water issues. Distinctively, AMPB is framing forests as collective territorial rights, in order to differentiate from technical international experts, such as UN-REDD. Finally, the objective of this paper is to highlight the influence of framing strategies, used by transnational community-based networks, on the definition of what are the appropriate scales of governance for common-pool resources.
