La nuova posizione del Senato della Repubblica nel sistema costituzionale, derivante dalla sua mutata composizione e dalla sua esclusione dal rapporto di fiducia con il Governo, si riflette anche in una pluralizzazione dei procedimenti legislativi, che trova proprio nel ruolo del Senato la sua variabile fondamentale. Nel tentativo di offrire una chiave di lettura unitaria delle innovazioni recate ai modi di produzione legislativa, nel contributo sono presentate le caratteristiche fondamentali dei procedimenti previsti nell'art. 70 Cost., come novellato, a partire dagli elementi di novità rispetto al testo costituzionale originario. In conclusione, alla luce della differenziazione dei procedimenti, sono accennate alcune considerazioni sui prodotti legislativi, relativamente alla possibilità che si sia tracciata la strada verso una stratificazione interna al novero degli atti legislativi, ulteriore e amplificata rispetto a quanto già il regime costituzionale originario non avesse prodotto in relazione al "gruppo di tipi" di legge ascrivibile al livello primario delle fonti. ; The new position of the Senate in the constitutional system, defined by its revised composition and its exclusion from the confidence relationship with the Government, reflects also in the pluralisation of the legislative processes, which has the exactly in the role of the Senate its fundamental variable. Attempting to offer an unitary key to read the innovation to the lawmaking process, in the essay there have been presented the basic features of the new Article 70, starting from the novelties from the original constitutional text. In conclusion, in the light of the differentiation among proceedings, some considerations are sketched on the resulting legislative products, with regard to the possibility to the stratification within legislative acts, further and amplified than what already contained in the original constitution, which already contained a variegated "group of types" of laws in the primary level of the sources of law.

The essay presents the new law no. 234/2012 which implemented in the Italian legal order the new parliamentary powers attributed to the national parliaments by the Lisbon Treaty. Due to the uncertain political stability of Italian government in 2009–2011, the implementation of these new powers suffered of a significant delay and had to rely mainly upon parliamentary initiatives. The essay focuses in particular on the procedural solutions for the approval and opposition powers. Differently from the models adopted in other UE Member States (such as, significantly, the UK and Germany), rather than strengthening the role of the parliament, one of the aim of the Italian law seems not to slow down the activity of the Government within the European institutions. The approval of a parliamentary statute has been required only in very few cases and the opposition powers are subject to a very short deadline. However, the overall result seems to be in line with the spirit of the Treaties and may also help Italy in improving the implementation of the EU law, which has been historically fragmented and belated. ; Il saggio presenta la nuova legge 234/2012, che attua nell'ordinamento italiano i nuovi poteri attribuiti ai parlamenti nazionali dal Trattato di Lisbona. A causa dell'instabilità politica del governo italiano nel triennio 2009-2011, tale attuazione a subito notevoli ritardi e ha dovuto affidarsi, per lo più all'iniziativa parlamentare.Il punto di osservazione principale sono le soluzioni procedurali per l'attuazione dei poteri di approvazione e di opposizione, nell'ambito di procedure multilivello. Diversamente dai modelli adottati in altri Stati membri (e, significativamente in Germania e Regno Unito), più che rafforzare il ruolo del Parlamento, uno degli obiettivi della legge italiana appare quello di non rallentare l'azione del Governo sul piano europeo. Infatti, nei poteri di approvazione si prevede il ricorso alla legge in pochissimi casi e l'utilizzo dei poteri di veto è soggetto a termini di decadenza molto stretti.
