Di fronte alla crisi che attraversa oggi la forma di governo parlamentare appare utile rileggere – accompagnati dalla lezione metodologica di Galizia - alcune pagine di Carré de Malberg che nei primi decenni del secolo scorso si fece interprete delle trasformazioni della forma di governo parlamentare in un contesto di profonde trasformazioni dovute al passaggio dallo stato liberale allo stato di democrazia pluralista.

The essay focuses on the dialogue between Parliaments and Courts with a particular interest on the role that representative assemblies can play in protecting human rights in relation with the Courts' activity. Due to their democratic legitimacy, parliaments fulfill a particularly relevant function in protecting and promoting human rights, and they should fulfill it more and more. Hence, the importance in each legal system to define efficient mechanism of parliamentary control on human rights in the light of jurisprudence of the Courts and in particular of the Court of Strasburg. Among the most significant experiences, the English experience and the role played by the Joint Committee on Human Rights in the light of the Human Rights Act 1998 are analyzed.

The essay focuses on the parliamentary oversight on state secret and intelligence in the light of some experiences such as the Italian, French and Belgian ones. The issues of security and respect for democratic rules in the exercise of the Executive powers under state secret and intelligence are matters on which the legal systems are having to face more and more: they take political relevance just for the "sensitive" content of the inherent activities. Historically, the secret state and the activities of the security services have always been a prerogative of the Executive which had not only the monopoly of its use but also a total discretion in the definition of the rules relating to its use and its protection. Since some decades, however, all countries have revealed the need to guarantee full respect for the separation of powers and the rule of law through the provision of effective controls. The path towards un effective parliamentary control, however, has struggled to establish itself fully.
